This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use. The Pima County Department of Environmental Quality and Wastewater Management Department hereby approve the above referenced submittal of the final plat as submitted. Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. Prior to the construction of such features, a Construction Authorization (Approval To Construct) may need to be obtained from the Pima County Environmental Quality. Also, air quality activity permits must be secured by the developer or prime contractor from the Pima County Department of Environmental Quality before constructing, operating or engaging in an activity which may cause or contribute to air pollution. Engineering Division has reviewed the submitted Final Plat, CC&Rs, and Assurance Package and does not recommend approval of the Final Plat or Assurances at this time. The following items need to be addressed: FINAL PLAT COMMENTS: 1) DS Sec.2-03.6.3.B.2.c or d: Provide the dedication paragraph that best suits the conditions of this Final Plat. The dedication paragraph should read per DS Sec.2-03.6.3.B.2.c or d and include verbiage of the CC&Rs with Docket and Page spaces for recordation information and the maintenance responsibility. This item was not fully addressed on this submittal. 2) DS Sec.2-03.6.3.D: Revise the Approval block per the following; "I, ROGER W. Per conversation with David Rivera the original CC&Rs must be provided at the Final Plat review stage not at the Mylar submittal. Provide any Zoning Decision Letter for this project as stated in your response letter. ASSURANCE PACKAGE COMMENTS: 4) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are approved. The resubmittal needs to include all documentation for a complete Assurance Package. DSD Engineering will not piece meal the Assurance Package together as they come in on resubmittal. Revise the assurance package and address the following comments: I. Original Trust Agreement: " Provide the original Trust Agreement. Only the cover sheet for the original was included with this resubmittal. II. Amendment to Trust: " Provide a legal description in the Amendment to Trust, Exhibit "A" to accurately reflect the Title Block on the proposed Final Plat. This comment was not addressed. III. Title Report: " Provide a copy of the Title Report that needs to be current within 30 days of recordation of the proposed plat. IV. Warranty Deed: " Provide a sample copy of the special warranty deed. V. Location Map: " For this and future projects, please provide a 8½" by 11" location map sheet for assurance submittals that go to Mayor & Council. Typically, these are similar to an enlarged location map on Final Plats. VI. Provide the complete Assurance Package at resubmittal that includes all items for Assurances; 1) Original Trust Agreement, 2) Amendment to Trust, 3) Agreement to Construct, 4) Title Report, 5) Warranty Deed, and 6) a location map. The Assurance will not be reviewed if the entire package is not submitted for review. 5) The original Assurance package, with seals and signatures must be submitted prior to Final Plat approval (not Mylar processing, all information must be in house prior to Final Plat approval). If a decision was made by the Zoning Department provide the letter with the next submittal for verification. However since DSD Engineering is responsible for reviewing the Assurances and the Assurance package all of Engineering comments still stand unless a letter from the Director is included with the Zoning Decision letter. The Zoning Department does not review for Assurance therefore they can not make that kind of decision without approval from DSD Engineering. GENERAL COMMENTS: Provide a revised Final Plat, a revised original CC&R package, and a revised original Assurance Package. The revised Final Plat, revised CC&Rs, and revised Assurance Package must address the comments provided above. Include a comprehensive response letter addressing in detail responses to all of the above comments.
