Tucson Electric Power Company (TEP) has received the final plat
submitted for review May 9, 2007. TEP is unable to approve the plat at
this time.



When the tentative plat has been approved by the City of Tucson submit
to my attention a copy of the signed Approved Tentative Plat. TEP will
provide an electrical design within fifteen (15) working days upon
receipt of the plat and the required additional plans. The completion
of the electrical design is necessary to determine our easement
requirements and review the final plat.



Additional plans necessary for preparation of the design are: building
plans including water, electrical, landscape, sidewalk and paving plans.
Also, submit the AutoCAD version of the plat on a CD or email to
lcastillo@tep.com <mailto:lcastillo@tep.com> . The AutoCAD should be in
the following format:



A. Complete and identical to the official hard copy (paper) subdivision
plat.

B. DWG format

C. AutoCAD Version 2002 or lower

D. 2D, not 3D

E. Layers relate to a unique set of CAD features within the drawing.
(For example all lot lines should be on one layer, street centerlines
another layer)

F. Required Layers: Lot Line, Right of Way, and Street Centerline

G. At least three tie points are required; one must be a Section or a
Quarter and the others may be street intersections or lot corners.
Bearings and distances must be designated from the tie points

H. Any special fonts, X-REFs, or attachments should be submitted along
with the CAD drawing.

SUMMARY: Engineering Division of Development Services Department has received, Sheet 1, 2 and 3 of the proposed Final Plat, a copy of the Covenants, Conditions, & Restriction's (CC&R's), the Title Report, and proposed Assurance Package. Engineering Division has reviewed the submitted Final Plat, CC&R's, and Assurance Package and does not recommend approval of the Final Plat or Assurances at this time. The following items need to be addressed:

FINAL PLAT COMMENTS:

1) DS Sec.2-03.6.1.B: Revise the Final Plat Sheets to include a 2-inch margin on the left side and ½-inch margins on the remaining sides to comply with standardization requirements of state law for recorded plats.

2) DS Sec.2-03.6.1.H.2: Revise the Title Block on all sheets to include the legal description by section, township and range.

3) DS Sec.2-03.6.2.C: Revise the Final Plat General Note # 3 to include the verbiage; "Total miles of new private streets are 0."

4) DS Sec.2-03.6.3.B.1: Revise the Certification of Title paragraph to accurately read the following statement from the Development Standard section referenced, "I, the undersigned, hereby warrant that I am the owner and the only party having any interest in the land shown on this plat, and I consent to the subdivision of said land in the manner shown hereon."

5) DS Sec.2-03.6.3.A: Revise the Dedication Language paragraph to include the recreation area and drainage basins within the verbiage for dedication.

6) DS Sec.2-03.6.3.CorD: Provide the dedication paragraph that best suits the conditions of this Final Plat. The dedication paragraph should read per DS Sec.2-03.6.3.c or d and include verbiage of the CC&Rs and the maintenance responsibility.

7) DS Sec.2-03.6.3.E: Revise the signature line under the Assurance Block to accordingly reflect the following information,

8) DS Sec.2-03.6.4.A: Revise the Final Plat to label common areas "A", "B", "C" and "D" as either private or public. Dimension all easements specifically the Use and Access Easement per keynote #1.

9) DS Sec.2-03.6.4.C: Revise the Final Plat to clearly delineate Common Area "A" throughout the entire subdivision. Each common area must be enclosed with a solid line showing that they have separate restrictions or homeowners association.

10) DS Sec.2-03.6.4.D: Revise the Final plat to label the square footage of Common Area "C" and "D." The square footage must be shown in plan view.

11) DS Sec.2-03.6.5.A: Revise the Final Plat to indicate primary control points, or descriptions and ties to such control points, to which all dimensions, angles, bearings, and similar data on the plat will be referred. Specifically, at least one (1) corner of the subdivision must be tied by course and distance to the section corner or the quarter section corner shown on the Final Plat that was used to establish the basis of bearing. The plat must include an accurate description of that corner marker and an indication of how the bearings were determined. Corner tie recordation information is to be provided on the plat.

12) DS Sec.2-03.6.5.C.4: Revise the Final Plat to show that the required one-half inch iron rod tagged by a registered land surveyor will be set at all corners of the proposed subdivision upon completion of the project.

13) DS Sec.2-03.6.5.C.5: Revise the Final Plat to indicate whether the distance and bearings between monuments were measured or calculated for all property line boundary information.

Covenants, Conditions, and Restrictions (CC&R's):

14) DS Sec.2-03.6.6.A: Revise the CC&R's establishing responsibility for construction, maintenance, and ownership for all recreational areas, private drainage and landscape easements, vehicular use easements and all other similar joint uses. Specifically the maintenance section must provide clear responsibility for construction and maintenance of the proposed recreational areas located within the private detention/retention basins.

15) A final signed original notarized copy of the CC&R's will be needed prior to approval of the Final Plat.

ASSURANCE PACKAGE COMMENTS:

16) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are approved. Revise the assurance package and address the following comments:

I. Amendment to Trust:
a) Provide a legal description in the Amendment to Trust, Exhibit "A" to accurately reflect the Title Block on the proposed Final Plat.
b) Provide the activity number near the top of the 1st page of the Amendment to Trust.
II. Agreement to Construct:
a) Revise Item #1 of Assurable Items located in Exhibit "B" to state private or public for all paving and vehicular use areas.
b) Revise Item #8 of Assurable Items located in Exhibit "B" to include onsite improvements along with the offsite improvements.
III. For this and future projects, please provide a 8½" by 11" location map sheet for assurance submittals that go to Mayor & Council. Typically, these are similar to an enlarged location map on Final Plats.
IV. Verify Items 4 and 7 on the Title Report. Show all easements in plan view on the Final Plat with the referenced docket and page information. All easements that are to be abandoned by this pat must have a letter from every utility approving the abandonment of such easement.

17) The original Assurance package, with seals and signatures must be submitted prior to Final Plat approval.

GENERAL COMMENTS:

Provide a revised Final Plat, a revised original CC&R package, a revised Assurance Package, and letter from all utility companies for easement abandonment at re-submittal.

The revised Final Plat, revised CC&R's, and revised Assurance Package must address the comments provided above. Include a comprehensive response letter addressing in detail responses to all of the above comments.

Further comments may be generated upon resubmittal of the Final Plat, CC&R's, Assurance Package and utility letters.
