SUBJECT: Starr Pass Vistas Village 2 (S07-033) Final Plat and assurances 3RD Review

SUMMARY: The revised Final Plat, assurance documents, CC&R's, title report, and response letter were received and reviewed for Final Plat conformance. The Final Plat and assurances are not recommended for approval at this time until remaining comments are addressed.

FINAL PLAT CC&R COMMENTS:
1) DS Sec.2-03.6.6.A: Address the remaining CC&R's comments:
a) Assure that the description of the project on the Final Plat title block match the CC&R's description of the subdivision on page one of the CC&R's.
b) DS Sec.10-02.14.3.2, DS Sec.2.3.1.6.C: The drainage maintenance list in the CC&R's remains incomplete. In the drainage maintenance exhibit for the CC&R's, revise the list of maintenance recommendations for the drainage areas to include all drainage improvements (basins, box culvert, drainage channels, drainage pipes, and other drainage structures or improvements) as outlined in the project's Drainage Report or as provided by the project's engineer and accepted by the City of Tucson DSD engineer.

ASSURANCES COMMENTS:
2) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are approved. Address the following for the third party trust subdivision assurance package:
a) Revise pages of the AGREEMENT TO CONSTRUCT and AMENDMENT TO TRUST according to the following comments:
(1) My previous comment regarding removing "additional verbiage for exhibit titles; exhibits should be referencing the exhibit letter only, not another exhibit" does not comply with recent request from Clerk's Office. Revise exhibit's to include "Exhibit A to Exhibit A" etc as the resolution to Mayor and Council refers to the assurance package as Exhibit A and the attached exhibits for the assurance paperwork are exhibits to the resolution assurances. Call me if you need clarification.
(2) Correct verbiage in the exhibits for the legal descriptions in both the AGREEMENT and AMENDMENT to match the title block of the Final Plat - or correct the title block to match the assurance paperwork. Please be aware that the City of Tucson's Legal and Clerks offices may reject the assurance paperwork if the verbiage does not match exactly the verbiage on the Final Plat's Title Block. The following items may be an issue to the Clerk's Office at their review:
(a) In the assurance paperwork, remove the extra comma in the description after VISTAS.
(b) Correct 'Street' to 'Streets'.
b) Provide the following for the recompiled assurance package resubmittal:
(1) original copy of the AGREEMENT TO CONSTRUCT SUBDIVISION IMPROVEMENTS / THIRD PARTY TRUST with the Exhibit A (legal description), assurable items list (Exhibit B), and Exhibit C (copy of the original Trust Agreement);
(2) original copy of the AMENDMENT TO TRUST / THIRD PARTY TRUST with the Exhibit A (legal description);
(3) copy of a sample Warranty Deed;
(4) copy of the current Title Report.

Submit the Final Plat, revised CC&R's, a revised assurance package with a copy of the title report, and response letter. An original signed copy of the CC&R's will be required for Final Plat approval. You may call to go over these comments, or if you have any questions, please call me at 837-4934.
