However, should there be any changes requested by other CDRC members, the Zoning Review Section approval is void, and we request copies of the revised final plat to verify that those changes do not affect any zoning requirements.

1. The final plat approval is based on the approval of the tentative plat. At this time the tentative plat has not been approved by CDRC. Once the tentative is approved the final plat is approved.

Tucson Electric Power Company (TEP) has received the final plat
submitted for review October 5, 2007. TEP is unable to approve the plat
at this time.



When the tentative plat has been approved by Pima County submit to my
attention a copy of the signed Approved Tentative Plat. TEP will
provide an electrical design within fifteen (15) working days upon
receipt of the plat and the required additional plans. The completion
of the electrical design is necessary to determine our easement
requirements and review the final plat.



Additional plans necessary for preparation of the design are: building
plans including water, electrical, landscape, sidewalk and paving plans.
Also, submit the AutoCAD version of the plat on a CD or email to
lcastillo@tep.com <mailto:lcastillo@tep.com> . The AutoCAD should be in
the following format:



1. Complete and identical to the official hard copy (paper) project
(subdivision, commercial) plat.

2. The CAD file must be a civil site plan drawing. The majority of
time an electrical site plan drawing does not have the required
information.

3. DWG format.

4. AutoCAD Version 2007 or lower.

5. 2D only, not 3D (Please take out reference images and 3D
images.)

6. Please take out the topography Layer.

7. Layers relate to a unique set of CAD features within the
drawing. (For example all lot lines should be on one layer, street
centerlines another layer.)

8. Please include the required Subset Layers: Lot Line, Right of
Way, Street Centerline, Building, Curb, Basin, Section Line, Boundary of
Property, Footages, Bearings, Lot Numbers, Street Name, and Tie Down
(Section or Quarter Pins.)

9. At least three tie points are required; one must be a Section or
a Quarter pin and the others may be street intersections or lot corners.
Bearings and distances must be designated from the tie points.

10. Please include the Boundary Line of Property. It must be
designated with bearings and distances.

11. Any special fonts, X-REFs, or attachments should be submitted along
with the CAD drawing.

SUMMARY: The revised Final Plat, assurance documents, location map, CC&R's for original plat, boundary closure document, and title report were received and reviewed for Final Plat conformance. This subdivision project is subject to ERZ and HDZ overlay applicability and is adjacent to ERZ Silvercroft Wash. The Final Plat is not recommended for approval at this time.

FINAL PLAT COMMENTS:
1) City of Tucson Development Standards (DS) Section No. 2-03.7: Submittal of the final plat prior to complete approval of the tentative plat is done at the applicant's risk since changes could be required of the tentative that may affect the final plat. Address all Tentative Plat conditions of approval prior to resubmittal of Final Plat, including assuring basin area is sufficient to account for all basin improvements within the basin common area.
2) Assure that the descriptions of the common areas of the Final Plat title block match the CC&R's descriptions of the subdivision common areas and the descriptions in the assurance paperwork. Please be aware that the City of Tucson's legal office may reject the assurance paperwork if the verbiage does not match exactly the verbiage on the Final Plat's Title Block.
3) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are approved.
4) DS Sec.2-03.6.1.L: Address the following legend comments:
a) Add TOB line for clarification in legend.
b) Clarify 25' wash buffer zone line as either 25' wash buffer zone (ERZ) or 25' ERZ wash buffer zone.
5) DS Sec.2-03.6.2.E: Revise/update lot numbers for general note 4: "Prior to issuance of any building permit, a Flood Plain Use Permit is required for Block 1."
6) Update all plan sheets to reflect correct year as Mayor and Council date for this plat is expected to be in 2008.
7) DS Sec.2-03.6.4.I: Show any applicable minimum geotechnical basin setback in lots 14 and 13.
8) DS Sec.2-03.6.5.C.3: Provide parcel boundary legal description as well as project boundary closure calculations with closing error, for the residential village 1 (excluding block 1), as well as block 1.
a) The boundary closure submitted does not match the lengths/bearings as shown on the plat planview.
b) Re-check boundary descriptions so that each length/bearing callout is identified with crow's feet for clarification.
9) DS Sec.2-03.6.5.C.5: Address the following survey comments:
a) DS Sec.2-03.6.5.C.4.b: Show or explain whether a survey monument will be set at northwest property corner. Provide indication of monuments for all west property boundary.
b) On sheet 3, add recorded (R) plat boundary data to phase 1 boundary and indicate other bearings and distances for project boundary data as measured or calculated. Check boundary data for clarity; it may be necessary to use crow's feet for some lengths.
c) DS Sec.2-03.6.4.F: For the surveyable 100-year floodprone limits, show frequent ties to intersecting lot lines.
10) DS Sec.2-03.6.5.B: Address the remaining easement comments:
a) DS Sec.2-03.8.1.D: An updated title report current within 30 days will be required for final plat approval.
b) Explain in response letter, the purpose of Docket 8608 Page 545 (116-26-205D), adjacent to project parcel on northeast corner of project. Provide documentation from Tucson Water accepting proposed improvements in parcel 116-26-205D.
c) Add a general note to the plat that an El Paso Gas easement lies to the east of the project; all work within this easement must be coordinated with the proper utilities prior to any site construction.
11) DS Sec.2-03.6.6.A: Only a copy of the original plat's CC&R's were submitted. Address the remaining CC&R comments:
a) DS Sec.10-02.14.3.2: An original signed copy of the CC&R's will be required for Final Plat approval. For plat approval, the Covenants, Conditions, and Restrictions (CC&Rs) or Final Plats (cover sheet notes) shall have the following statements:
i) that the owner or owners shall be solely responsible for operation, maintenance, and liability for drainage structures and detention basins;
ii) that the owner or owners shall have an Arizona Registered Professional Civil Engineer prepare a certified inspection report for the drainage and detention/retention facilities at least once each year, and that these regular inspection reports will be on file with the owner for review by City staff, upon written request;
iii) that City staff may periodically inspect the drainage and detention/retention facilities to verify that scheduled and unscheduled maintenance activities are being performed adequately; and
iv) that the owner or owners agree to reimburse the City for any and all costs associated with maintaining the drainage and detention/retention facilities, should the City find the owner or owners deficient in their obligation to adequately operate and maintain their facilities.
b) If a revised CC&R's is to be submitted, address the following remaining comments:
i) Copy of master declaration of CC&R's as referenced on sheet 1 does not include basin maintenance.
ii) Revise all pages to reflect reference to City of Tucson not Pima County, including Article 3.
iii) DS Sec.10-02.14.3.2: Revise CC&R's / amend Article 3 to include verbiage regarding basin and drainage maintenance per drainage report.
iv) Update the description on cover page of CC&R's to reflect common area name changes if any.
v) Assure that the descriptions of the common areas of the Final Plat title block match the CC&R's descriptions of the subdivision common areas in appendix, as well as the descriptions in the assurance paperwork.
vi) Provide page numbering for every and all pages of the CC&R's including appendix and update table of contents accordingly.
vii) Add case number S06-185 to first sheet of CC&R's.
c) Add easement maintenance verbiage to CC&R's or a general note to the Final Plat cover sheet: All erosion protection and revegetation in all easements shall be the responsibility of the Homeowners Association.
12) DS Sec.2.3.1.6.C: The CC&R's shall also provide the list of maintenance recommendations for the drainage areas as outlined in the project's Drainage Report or as provided by the project's engineer and accepted by the City of Tucson DSD engineer.
