The proposed final plat for the above-referenced project has been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.


Sheet 1: Add a General Note that states:

THE LANDSCAPING WITHIN ALL PUBLIC SEWER EASEMENTS SHOWN HEREON SHALL BE IN ACCORDANCE WITH THE PLANTING GUIDELINES OF PC/COT STANDARD DETAIL WWM A-4.

Sheet 1: Add a Permitting Note that states:

1. An applicant has one (1) year from the date of approval of tentative plat to obtain approval of a final plat that complies with zoning and other development requirements in effect at the time of application. As of this final plat review date the tentative plat has not been approved therefore the one year date of the final plat approval is based on the date of submittal of the final plat documents (May 24, 2007). Once the tentative plat has been approved the approval date of the final plat will be on one year from the tentative plat approval date. This date will be provided on a future review of the final plat.

2. Please correct the overlay zone case number. The correct number is T07SA00049. It is shown as T07500049.

Tucson Electric Power Company (TEP) has received the final plat
submitted for review May 25, 2007. TEP is unable to approve the plat at
this time.



When the tentative plat has been approved by the City of Tucson submit
to my attention a copy of the signed Approved Tentative Plat. TEP will
provide an electrical design within fifteen (15) working days upon
receipt of the plat and the required additional plans. The completion
of the electrical design is necessary to determine our easement
requirements and review the final plat.



Additional plans necessary for preparation of the design are: building
plans including water, electrical, landscape, sidewalk and paving plans.
Also, submit the AutoCAD version of the plat on a CD or email to
lcastillo@tep.com <mailto:lcastillo@tep.com> . The AutoCAD should be in
the following format:



A. Complete and identical to the official hard copy (paper) subdivision
plat.

B. DWG format

C. AutoCAD Version 2002 or lower

D. 2D, not 3D

E. Layers relate to a unique set of CAD features within the drawing.
(For example all lot lines should be on one layer, street centerlines
another layer)

F. Required Layers: Lot Line, Right of Way, and Street Centerline

G. At least three tie points are required; one must be a Section or a
Quarter and the others may be street intersections or lot corners.
Bearings and distances must be designated from the tie points

H. Any special fonts, X-REFs, or attachments should be submitted along

SUMMARY: The Final Plat, CC&R's, and title report were received and reviewed for Final Plat conformance. This subdivision project is subject to ERZ and HDZ overlay applicability and is adjacent to ERZ Silvercroft Wash. The Final Plat is not recommended for approval at this time.

FINAL PLAT COMMENTS:
1) City of Tucson Development Standards (DS) Section No. 2-03.7: Submittal of the final plat prior to approval of the tentative plat is done at the applicant's risk since changes could be required of the tentative that may affect the final plat. Address all Tentative Plat comments prior to resubmittal of Final Plat, including assuring basin area is sufficient to account for all basin improvements within the basin common area.
2) DS Sec.2-03.6.1.D.2: Clarify leader line for Silvercroft Wash watercourse on the project location map on sheet 1.
3) DS Sec.2-03.6.1.H.3: Block B of plat Bk58 pg20 is labeled as block 1 on sheet 2. Since the final plat is a resubdivision of a previously recorded plat, clarify Title Block at lower right corner of each sheet, that Block A as referenced of the existing subdivision is this plat, not other blocks.
4) Assure that the descriptions of the common areas of the Final Plat title block match the CC&R's descriptions of the subdivision common areas and the descriptions in the assurance paperwork. Please be aware that the City of Tucson's legal office may reject the assurance paperwork if the verbiage does not match exactly the verbiage on the Final Plat's Title Block.
5) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are approved. Submit the following for the assurance package:
a) If a third party trust is proposed for the subdivision assurances, provide:
i) original copy of the AGREEMENT TO CONSTRUCT SUBDIVISION IMPROVEMENTS / THIRD PARTY TRUST with the assurable items list;
ii) original copy of the AMENDMENT TO TRUST / THIRD PARTY TRUST;
iii) assure that all exhibits are attached, and the case number "S06-185" is at the top of the first page of the AGREEMENT TO CONSTRUCT and AMENDMENT TO TRUST;
iv) copy of the original Trust Agreement;
v) copy of a sample Warranty Deed;
vi) copy of the current Title Report.
b) If retention is required for the project, revise title block to reflect basin as a detention retention basin.
c) For this and future projects, please provide a 8½" by 11" location map sheet for assurance submittals that go to Mayor & Council. Typically, these are similar to an enlarged location map on Final Plats.
6) DS Sec.2-03.6.2.A: Clarify gross area in note 1 to reflect correct area for this project.
7) DS Sec.2-03.6.1.J: Revise line weights for right-of-way lines to be more prominent than lot lines or easements. Clarify/revise west boundary line to be more prominent and consistent with other portions of the plat boundary, as well as to differentiate between west boundary and wash delineations.
8) DS Sec.2-03.6.1.L: Address the following legend comments:
a) The legend shows similar delineations for easements, landscape buffer line, and Erosion Hazard Setback line. Differentiate for clarification in legend and in planview.
b) Add star to legend for stars shown on lots 2, 6, 10, 14, 18, and 22.
9) DS Sec.2-03.6.2.E: Revise/update lot numbers for general note 4: "Prior to issuance of any building permit, a Flood Plain Use Permit is required for Lots ____."
10) DS Sec.2-03.6.2.F: Since the property is subject to the requirements of the Hillside Development Zone, add as a general note to sheet 1: "Prior to the issuance of any building permits, Hillside Development Zone approval is required for all lots."
11) DS Sec.2-03.6.3.C: For the BENEFICIARY block, assure beneficiary statement includes contact name for US Homes.

c) Besides boundary data, clarify bearings and distances for tie to section corner.
d) DS Sec.2-03.6.4.F: For the surveyable 100-year floodprone limits, show frequent ties to intersecting lot lines.
e) DS Sec.2-03.6.5.C.1: Label basis of bearing on a planview.
20) DS Sec.2-03.6.5.B: Address the following easement comments:
a) All existing easements will be drawn on the plat, and recordation information, locations, widths, and purposes shall be included. The engineer shall assure that all easements listed on the Title Report Schedule B are clearly drawn, labeled with Book/page or Docket/page, and/or listed as a blanket easement, and/or labeled with accurate dimensions and bearings on the Final Plat.
b) Show any related easements from Schedule B item 7 on the plat planview sheet 3.
c) DS Sec.2-03.8.1.D: An updated title report current within 30 days will be required for final plat approval.
d) Explain in response letter purpose of Docket 8608 Page 545 (116-26-205D) adjacent to project parcel on northeast corner of project.
21) DS Sec.2-03.6.6.A: Address the following CC&R comments:
a) Provide copy of master declaration of CC&R's as referenced on sheet 1.
b) Revise all pages to reflect reference to City of Tucson not Pima County, including Article 3.
c) DS Sec.10-02.14.3.2: Revise CC&R's / amend Article 3 to include verbiage regarding basin and drainage maintenance per drainage report.
d) Update the description on cover page of CC&R's to reflect common area name changes if any.
e) Assure that the descriptions of the common areas of the Final Plat title block match the CC&R's descriptions of the subdivision common areas in appendix, as well as the descriptions in the assurance paperwork.
f) Add easement maintenance verbiage to CC&R's: All erosion protection and revegetation in all easements shall be the responsibility of the Homeowners Association.

h) Provide page numbering for every and all pages of the CC&R's including appendix and update table of contents accordingly.
i) An original signed copy of the CC&R's will be required for Final Plat approval.
22) Due to remaining comments on the plat, Tentative Plat approval is required prior to resubmittal of the revised Final Plat.
