The activity number is S06-180. SUMMARY: The Final Plat and CC&Rs were received by Engineering on August 11th, 2006. Engineering has reviewed the received items and does not recommend approval of the Final Plat or the CC&Rs. RESUBMITTAL REQUIRED: FINAL PLAT, CC&Rs SUBMITTAL REQUIRED: TITLE REPORT, ASSURANCES (if applicable), BOUNDARY CLOSURE CALCS The next submittal must address the following items: CC&Rs COMMENTS 1. Provide a table of contents for the CC&R's. 2. Submit revised copies of the CC & R's that specifically address the maintenance of any drainage facilities. Add language in the text, which addresses the maintenance of the drainage structures in detail (i.e. what facilities to be inspected and maintained, how, when, by whom, record keeping and repair decisions, etc). Drainage structures include scuppers, rain gutters, etc. SMDDFM 14.03.2. FINAL PLAT COMMENTS 1. After researching the Development Services permitting system (Permits Plus) it has been brought to my attention that the Certificate of Occupancy inspections are not complete. Therefore there is no verification that all the site infrastructure is complete. If the site infrastructure is not complete, assurances are required to ensure that all site work has been constructed and passed inspections. Please clarify. If the intent is to provide assurances for the site infrastructure revise the plat and submit a complete assurance package. The complete assurances package must include a copy of the original trust, the original amendment to trust with exhibit A, the original agreement to construct with exhibit B, a copy of the warranty deed, a current title report and a location map on an 8 ½ x 11 sheet. DS 2-03.7.1.G. 2. Revise the Final Plat Standard paragraphs on the first sheet so that they are listed in the following order for better understanding and clarity DS Sec.2-03.6.3: 1. Dedication Paragraph 2. Beneficiary Block Paragraph (if applicable) 3. Acknowledgement Paragraph 4. Approval Paragraph 5. Recordation Data Block Paragraph 6. Assurance Block 7. Certification of Survey 3. Place the subdivision case number in the lower right hand corner of each sheet. DS 2-03.6.1.K. 4. Add the following note; "Prior to issuance of any building permit, a Flood Plain Use Permit is required for units 1 - 4, 7 and 8." 5. A beneficiary block is required if there are any assurable items regarding development of this site. Assurable items is site infrastructure like sidewalks, pavement, etc. (please refer to comment number 1) Provide a beneficiary block on the plat, if applicable. 6. Use a different line weight for the 100 year floodplain delineation. Provide the line weight in the legend. DS 2-03.6.1.J. 7. A final plat is survey document. Any site information should be removed from the plat. Remove all references to parking (i.e. number of parking spaces), handicap parking spaces and garages. 8. "Limited common element" means a portion of the common elements specifically designated as a limited common element in the declaration and allocated by the declaration or by operation of section 33-1212, paragraph 2 or 4 for the exclusive use of one or more but fewer than all of the units. It is not necessary to indicate on the plat the distinction between the different types of limited common elements. Remove the reference to garages in the title block and on the plat view. Replace the verbiage "garage # 1- 8" on the plat view and replace with "LCE." ARS 33-1202 9. Please clarify if the two garages shown on the plat have interior walls separating each garage or if the garage is one structure; without interior walls. If the structure has interior walls there must be a solid bold line to distinguish each limited common element. Clarify in detail in the response letter and revise the plat appropriately. DS 2-03.6.0. 10. The 100 year floodplain limit must be shown on the plat in a surveyable and readily retraceable manner with frequent ties to lot lines. Revise the plat appropriately. DS 2-03.6.4.F. 11. If applicable, show no vehicular access easements on the plat. DS 2-03.6.4.H. 12. Indicate if the easements shown on the plat are public or private. DS 2-03.6.4.A. 13. The plat shows an alley width of 40', however 30' of the alley is within common elements and limited common elements. Is the intent to purchase part of the alley? Clarify in detail in the response letter. 14. Corner tie information is to be provided on the plat. At least one corner of the subdivision must be tied by course and distance to a section corner or a quarter section corner. The plat must include a description of that corner marker and an indication of how the bearings were determined. Provide the corner tie recordation information on the plat. DS 2-03.6.5.A. 15. Indicate whether the distances and bearings between all monuments are measured or calculated. DS 2-03.6.5.C.5. 16.
