An applicant has one (1) year from the date of application to obtain approval and recordation of a final condominium plat that complies with zoning and other development requirements in effect at the time of application. This final condominium plat must be approved and recorded on or before August 2, 2007. 2. Lettering used for the legal description on sheet 1 appears to be smaller than twelve (0.12) point. Please increase it's size and check that all lettering complies to required size. DS2-03.6.1.C 3. Please center the subject property within the location map on sheet 1. DS 2-03.6.1.D.1 4. LUC 4.1.9.1.A 8. Please provide an affidavit stating that the subdivider will provide existing tenants an exclusive right to purchase the unit the tenant leases at a price which is not more than the price at which the subdivider intends to offer the unit to the general public for a period of not less than sixty (60) days from the date a tenant's units is offered for sale. LUC 4.1.9.1.B 9. Please provide an affidavit that the subdivider will provide to each tenant, who has indicated to the subdivider his/her intention not to exercise his/her right to purchase, a written statement listing at least three (3) rental units unique to that tenant of comparable size and price to the unit occupied by the tenant. LUC 4.1.9.1.C 10. Please provide an affidavit stating that the subdivider will provide to tenants a relocation payment of three hundred fifty (350) dollars per residential unit to be paid prior to termination of the tenants occupancy, including written notice of the availability of such payment prior to termination, provided that: a) The tenant has occupied his unit for at least two (2) years prior to the date on which the tenant was eligible to receive a notice of intent to convert pursuant to Sec. 4.1.9.1.A. b) The tenant has made a written request to the subdivider for the relocation payment. c) The tenant has a total annual income at or below maximum eligibility limits established by the U.S. Department of Housing and Urban Development for the participation in the Section 8 Housing Assistance Payments Program or is sixty-two (62) years of age or older. LUC 4.1.9.1.D 11. Please provide an affidavit stating that the units to be converted meet the applicable standards of the Housing Code, Tucson Code, Chapter 16. LUC 4.1.9.1.E 12. Please submit a copy of a report on the physical condition of all buildings, structures, and other improvements to the property to be subdivided prior to approval of a final plat by the Mayor and Council. This report shall be provided by the subdivider to all prospective purchasers of units prior to execution of a binding contract of purchase. The report shall contain the following. a. A statement of the estimated fees or assessments, if any, that the purchaser of a unit will pay, on a monthly and yearly basis, for at least a two (2) year period following purchase. b. A report from a licensed pest control operator on each building or structure and each unit within the building or structure. c. A statement of the unit's average monthly utility costs based on the preceding twelve (12) month period, where the subdivider has access to such utility cost data. d. A report describing, to the best knowledge or estimate of the subdivider, the physical condition of elements of the structure, equipment, or appliances in a unit, the repair or replacement of which will be the responsibility of the purchaser. The report shall state the approximate date on which the element, equipment, or appliance was originally constructed or installed; the approximate date on which it was subsequently replaced or will likely require replacement; and the current estimated cost of replacement. This report shall not be construed to create any warranties, express or implied. e. A report containing information to be obtained from the City Fire Department describing the extent to which the buildings and structures to be converted by the plat submitted by the subdivider deviate from applicable requirements of the Building Code, Tucson Code, Chapter 6, and the Fire Prevention Code, Tucson Code, Chapter 13, in the following specified areas of fire safety. 1. Accessibility of buildings and structures to fire-fighting equipment; and 2. Proximity and frequency of fire hydrants. 13. The manager's office should be assigned it's own common element designation (Common Element "D") to clarify it's use. 14. Please revise the title block grouping those items that are defined as common elements and those that are defined as limited common elements, much like what is done in the second paragraph of the dedication. 15. Original plans and the 2002 aerial shows that a great number of the parking spaces where covered parking. The new final plat does not identify carports. Please clarify whether all carports still exists or whether they have been removed. If parking is modified resulting in an increase in spaces handicap accessibility items will be imposed on the vehicle use area. 16. It appears that through the reproduction process information on all pages along a line is blurred or missing. Please make sure that copies provided are readable.
