The proposed final plat for the above-referenced project has been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.


This project will be tributary to the Roger Road Wastewater Treatment Facility via the Northwest Outfall Interceptor. This is an existing apartment complex to condominium units conversion. The on-site and off-site sewers are existing and private. No new sewers collection systems are proposed. Per written guidance provided by the PCWMD Development Services Section, sufficient conveyance and treatment capacity exists in the downstream public sewerage system for this project, and a formal capacity response letter from the PCWMD will not be required.

All Sheets: Add the subdivision case number, S06-162, to the title block of each sheet. This number should be shown larger or bolder than any cross-reference numbers. No wastewater review fees will be charged for sheets where this is the only required revision.

Subject to the above, the Pima County Department of Environmental Quality and Wastewater Management Department hereby conditionally approve the above referenced submittal of the final plat.

Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. Prior to the construction of such features, a Construction Authorization (Approval To Construct) may need to be obtained from the Pima County Environmental Quality.

12. Please submit a copy of a report on the physical condition of all buildings, structures, and other improvements to the property to be subdivided prior to approval of a final plat by the Mayor and Council. This report shall be provided by the subdivider to all prospective purchasers of units prior to execution of a binding contract of purchase. The report shall contain the following.
a. A statement of the estimated fees or assessments, if any, that the purchaser of a unit will pay, on a monthly and yearly basis, for at least a two (2) year period following purchase.
b. A report from a licensed pest control operator on each building or structure and each unit within the building or structure.
c. A statement of the unit's average monthly utility costs based on the preceding twelve (12) month period, where the subdivider has access to such utility cost data.
d. A report describing, to the best knowledge or estimate of the subdivider, the physical condition of elements of the structure, equipment, or appliances in a unit, the repair or replacement of which will be the responsibility of the purchaser. The report shall state the approximate date on which the element, equipment, or appliance was originally constructed or installed; the approximate date on which it was subsequently replaced or will likely require replacement; and the current estimated cost of replacement. This report shall not be construed to create any warranties, express or implied.
e. A report containing information to be obtained from the City Fire Department describing the extent to which the buildings and structures to be converted by the plat submitted by the subdivider deviate from applicable requirements of the Building Code, Tucson Code, Chapter 6, and the Fire Prevention Code, Tucson Code, Chapter 13, in the following specified areas of fire safety.
1. Accessibility of buildings and structures to fire-fighting equipment; and
2. Proximity and frequency of fire hydrants.

SUMMARY: The Final Plat and a copy of the Development Plan were received by Development Services Department Engineering Division. Engineering Division has reviewed the condo plat package items and does not recommend approval of the Final Plat until the following comments are addressed.

FINAL PLAT COMMENTS:
1) City of Tucson Development Standards (DS) Section No. 2-03.6.1.D: Clarify Bill Martin Drive more clearly on location map.
2) DS Sec.2-03.6.1.K: Place the subdivision case number (S06-162) on all sheets of the final plat.
3) DS Sec.2-03.6.3.D: Under the "RECORDING DATA" next to "SS", provide more space for seal. There is an additional state/county seal area under the Acknowledgement paragraph on sheet 1; clarify if this was intended area for the seal area for the notary - which may be beneficial to be located below the notary public signature line. Explain in response letter.
4) DS Sec.2-03.6.3.B.2.c: Provide length of private streets in general note 7. If they are not private streets then the general note would need to match the common element reference to private driveways. There may be further comments including clarification of the third paragraph of the Dedication after resubmittal.
5) DS Sec.2-03.6.4.A: Address the following easement comments:
a) Provide some dimension clarifications for locating the water easement.
b) Clarify what appears to be balconies at corners of the units; clarify on planview whether these are part of the unit or common element A, or remove.
6) DS Sec.2-03.6.5.C.3: Provide boundary closure calculations.
7) DS Sec.2-03.6.5.C.4: Clarify all boundary corner monuments are found or to be reset. Identify each monument.
8) DS Sec.2-03.6.5.C.5: Label or clarify whether the bearings or distances are recorded, measured or calculated.
9) DS Sec.2-03.6.6: Submit a revised copy of the Covenants, Conditions, and Restrictions (CC&R's) addressing the following:
a) In response letter include page number in the CC&R's where the drainage liability and maintenance verbiage is found.
b) Complete exhibits B and C.
c) Provide a original signed copy for final plat approval.
10) DS Sec.2-03.7.1.F: For conversion to a residential condominium development, the affidavits and information, as indicated in the LUC, Section 4.1.9.2 will be submitted with the initial submittal of the final plat.
11) DS Sec.2-03.6.5.B: Assure that all easements listed in the title report are labeled on the plat. In response letter provide explanation of items 6-9 in schedule B.
12) The following is recommended before Final Plat recordation.
a) Provide enclosures for all solid waste pick-up areas.
b) Provide truncated domes at all handicap access areas.
13) DS Sec.2-03.7.1: The sidewalk along the north side of the project is undermined by loss of soil adjacent to the sidewalk. It will be necessary to reconstruct slope or assure otherwise that the sidewalk is stabilized. Call for inspection.
14) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until one of the following has been provided:
a) when there is any remaining construction (including sidewalk), the financial assurances are submitted and approvable; or,
b) provide a copy of Certificate of Occupancy paperwork accepted by the City of Tucson for the final construction.
15) DS Sec.2-03.6.4.A: In response letter, state whether the sewer is private, public, or both.
