SUMMARY: Engineering Division of Development Services Department has received and reviewed the submitted Condominium Conversion Final Plat package, Title Report, and the copy of the Covenants, Conditions, and Restrictions (CC&R's) and does not recommend approval of the Final Plat at this time. The following items still need to be addressed:


FINAL PLAT COMMENTS:

1) DS Sec.2-03.6.1.C: Revise the lettering for The WLB Group address and telephone number to the equivalent of 12 point to assure that the lettering is legible when reproduced or when photographically reduced for record keeping purposes.

2) DS Sec.2-03.6.1.H: Update the Title Block to specify what elements are associated within the Common Elements and Limited Common Elements. Provide a description for each element in the Title Block.

3) Provide the right-of-way lines for Franklin Street, Granada Avenue and the I-10 Frontage Road. Line weights must reflect the nature of the line and must be more prominent than lot lines or easements.

4) DS Sec.2-03.6.1.K: Place the subdivision case number (S06-142) on all sheets of the final plat in the lower right hand corner of each sheet were indicated by "Case Number: 000-000".

5) DS Sec.2-03.6.2.I: Provide a General Note on Sheet 1 of 9 that states the following: "Any relocation, modification, etc., of existing utilities and/or public improvements necessitated by the proposed development will be at no expense to the public."

6) DS Sec2-03.6.3.A: Revise the Certification of Survey paragraph to accurately read the following statement from the Development Standard section referenced, "I hereby certify that the boundary survey as shown on this plat was performed under my direction and that all existing or proposed survey monuments and markers shown are correctly described. I further certify that this plat was prepared under my direction."

8) DS Sec.2-03.6.3.B.3: Revise the hold harmless statement to accurately read the following statement from the Development Standards section referenced, "We, the undersigned, do hereby hold harmless the City of Tucson, its successors and assigns, their employees, officers, and agents from any and all claims for damages related to the use of the property depicted on this plat now and in the future by reason of flooding, flowage, erosion, or damage caused by water, whether surface flood or rainfall."

9) DS Sec.2-03.6.3.B.4: Revise the signature line for the property owners to list authorizing agent and a place for the date.

10) DS Sec.2-03.6.3.D: Revise the approval paragraph statement to accurately read the following statement from the Development Standards Section referenced, "I, Kathleen S Detrick, Clerk of the City of Tucson, Arizona, hereby certify that this plat was approved by the Mayor and Council of the City of Tucson, Arizona, on this ____ day of __________, 2006."

11) Ds Sec.2-03.6.3.D: Revise the recording data paragraph to allow more room for the Official Seal next to the State of Arizona and County of Pima.

12) DS Sec.2-03.6.3.D: Under recording data statement, provide a signature line for the Deputy County Recorder. Remove the word Deputy placed before Pima County Recorder.

13) DS Sec.2-03.6.3.E: Revise the signature lines under the Assurance Block to accordingly reflect the following information,

14) DS Sec.2-03.6.4.C: Label all common areas individually with a separate designation. Specify what is included in the Common Elements and Limited Common Element must match Title Block. Otherwise remove the pool and main structure foot print and any other floating extraneous lines from plan view if the are part of a Common Element.

15) DS Sec.2-03.6.4.H: Include a discussion in a response letter for offsite parking along the North property line. Provide a cross access agreement or an easement to allow for offsite parking that is not included on the final plat. If a cross access agreement or an easement can not be provided then a 1-foot No-Access-Easement must be provided and recorded. Provide discussion in a response letter regarding any parcel combination or other recent changes to parcel boundaries.

16) DS Sec.2-03.6.6: Revise the Introduction Paragraph in the CC&R's to include a list of Common Elements and Limited Common Elements. The Common Elements and Limited Common Elements must match the Title Block on the final plat.

17) DS Sec.2-03.6.6: Revise Section 2.6 on page 8 in the CC&R's establishing responsibility for construction, maintenance, and ownership of all existing Common Elements, Limited Common Elements, or similar joint use. A final signed original copy of the CC&R's will eventually be needed for approval of the Final Plat. Assure that the CC&R's provide for:
a) In response letter include page number in the CC&R's where the liability and maintenance verbiage is found;
b) Includes the various conditions of any rezoning or other special situations requiring permanent administration by owners' association.

18) DS Sec.2-03.7.1.F: Since the development is a conversion to a residential condominium development, the affidavits and information, as indicated in the LUC, Section 4.1.9.2 needs to be submitted with the resubmittal of the final plat. Please provide all documentation required.

19) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until one of the following has been provided:
c) if there is any remaining construction, the financial assurances shall be submitted and approvable; or,
d) Provide a copy of Certificate of Occupancy paperwork accepted by the City of Tucson for the final construction.

20) DS Sec.7-01.3.A: All easements that are shown on the Title Report must either be abandoned or the easement is to be shown on the Final Plat with the width, purpose of granting, and recording data of the original subdivision plat or separate instrument shown. Specifically explain Items #10 and #11 in Schedule B of the Title Report and in the response letter describe the location of the easement.

21) DS Sec.7-01.3.A: Discuss the easements listed in Item #19 in Schedule B of the Title Report. The Docket and Page provided for the easements show that the purpose of the recordation is for 1) Order of Immediate Possession and 2) Final Order of Condemnation. This comment may require input from the Title Company.


GENERAL COMMENTS:

Provide a revised Final Plat and a revised CC&R package at re-submittal.

Prior to resubmittal and to expedite your Final Plat review a meeting can be scheduled to go over these comments. The revised Final Plat, revised CC&R's, and revised Schedule B of the Title Report must address the comments provided above. Include a comprehensive response letter addressing in detail responses to all of the above comments.

Further comments may be generated upon resubmittal of the Final Plat, CC&R package, and Title Report.

COMMENTS: Please resubmit revised drawings along a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.


1. An applicant has one (1) year from the date of approval of tentative plat to obtain approval of a final plat that complies with zoning and other development requirements in effect at the time of application. This final plat must be approved and recorded on or before July 18, 2007.

2. Under the current I1 zoning for this parcel, residential use is not permitted. Zoning is reviewing this plat on the assumption that the residential use is permitted under the "La Entrada Redevelopment Plan/ Planned Area Development (PAD 2). Zoning has asked for a clarification from the Zoning Administrator. A letter to the Zoning Administrator may be required clarifying the change of use from a hotel to single family units. Per the L.U.C residential use is not allowed in an I1 zone. If a determination as already been made by the Zoning Administrator please provide a copy of the letter. Once the clarification has been received additional comments may be forth coming.

3. This project has been assigned subdivision case number S06-142. Please note the subdivision case number in the lower right corner of each sheet of the final plat. (D.S. 2-03.6.1 K)

8. Based on the provided approved site plan, there are 410 parking spaces on site. Per General note #8 there are 347 parking spaces provide per this final plat. Zoning acknowledges that parking was removed due to the I-10 frontage road R.O.W. Please provide a current plan showing the parking and revised entry area at the northeast end of the property.

9. Based on information provided zoning is unable to verify required parking. Please provide information showing the number of bedrooms for each unit i.e. studio, 1 & 2 bedroom units proposed.

10. Please provide the planned uses and square footage for each use within the Main Building. This information will be used in calculating the required parking.

11. The cover sheet of the Condominium Declaration should match the title block of the Final Plat i.e. condominium name, units and common elements listed.

12. Per L.U.C section 4.1.9.1 the subdivider shall submit the following affidavits: Notice of Intent to Convert, Exclusive Right to Purchase, Statement of Availability of Other Rental Units, Relocation Payments, and Housing Code Compliance.

13. Per L.U.C section 4.1.9.2 the subdivider shall submit a Disclosure Requirements report prior to final plat improvement.
