The proposed final plat for the above-referenced project has been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.



This project will be tributary to the both the Ina Road Water Pollution Control Facility and the Roger Road Wastewater Treatment Plant via the Pantaño Interceptor. Treatment and conveyance capacity was allocated for this project by the Sewer Service Agreement prepared under case number S01-043, for Mission De Oro.

All Sheets: Add the subdivision case number, S06-122, to the title block of each sheet. This number should be shown larger or bolder than any cross-reference numbers. No wastewater review fees will be charged for sheets where this is the only required revision.

Subject to the above, the Pima County Department of Environmental Quality and Wastewater Management Department hereby approve the above referenced submittal of the final plat.

SUMMARY: Engineering Division of Development Services Department has received and reviewed the submitted Condominium Conversion Final Plat package, Title Report, and the copy of the Covenants, Conditions, and Restrictions (CC&R's) and does not recommend approval of the Final Plat at this time. The following items still need to be addressed:


FINAL PLAT COMMENTS:

1) DS Sec.2-03.6.1.H: Update the Title Block, Common Element A to include Private Drainage Area that is associated with the mapped floodplain on Sheet 2 and 3.

2) DS Sec.2-03.6.1.K: Place the subdivision case number (S06-122) on all sheets of the final plat in the lower right hand corner of each sheet were indicated by "PXXXX-XXX".

3) DS Sec2-03.6.3.A: The Condominium Conversion Final Plat must have both original seals stamped and signed by both of the registrants, John K Melton, RLS and Richard Steve Murillo, PE, under the Certificate of Survey and on each Sheet associated with the registrant prior to Final Plat approval.

4) DS Sec.2-03.6.3.B.2.d: Revise the dedication language in paragraph 4 to include "….in the office of the Pima County Recorder."

5) DS Sec.2-03.6.3.E: Revise the signature lines under the Assurance Block to accordingly reflect the following information,

6) DS Sec.2-03.6.6: Revise the Recital Paragraph on page 1 in the CC&R's to include in Common Element A, private driveways and Private Drainage Area. Revise Common Element B to state private detention/retention areas.

7) DS Sec.2-03.6.6: Revise Section 5.5 on page 11 in the CC&R's establishing responsibility for construction, maintenance, and ownership of all existing common elements, detention/retention basins, Private Drainage Area, open space, private driveways, or similar joint use. A final signed original copy of the CC&R's will eventually be needed for approval of the Final Plat. Assure that the CC&R's provide for:
a) In the Common Element B statement specify that all detention/retention basins in Common Area B will require the schedule and unscheduled maintenance and certification of compliance by an Arizona registered civil engineer;
b) Provide a statement that Common Element A (Private Drainage Area, private driveways, general parking spaces, recreation and landscape areas will also require the schedule and unscheduled maintenance and certification of compliance by an Arizona registered civil engineer;
c) In response letter include page number in the CC&R's where the drainage liability and maintenance verbiage is found;
d) Includes the various conditions of any rezoni2`ng or other special situations requiring permanent administration by an owners' association.

8) DS Sec.2-03.7.1.F: Since the development is a conversion to a residential condominium development, the affidavits and information, as indicated in the LUC, Section 4.1.9.2 needs to be submitted with the resubmittal of the final plat. Please provide all documentation required.

9) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until one of the following has been provided:
e) if there is any remaining construction, the financial assurances shall be submitted and approvable; or,
f) Provide a copy of Certificate of Occupancy paperwork accepted by the City of Tucson for the final construction.

10) DS Sec.7-01.3.A: All easements that are shown on the Title Report must either be abandoned or the easement is to be shown on the Final Plat with the width, purpose of granting, and recording data of the original subdivision plat or separate instrument shown. Specifically explain Item #6 in Schedule B of the Title Report and in the response letter describe the location of the easement.

11) DS Sec.2-03.6.6: Provide a copy of the previously recorded CC&R's that are shown in Items #4 & #5 in Schedule B of the Title Report for review.


GENERAL COMMENTS:

Provide a revised Final Plat and a revised CC&R package at re-submittal.

Prior to resubmittal and to expedite your Final Plat review a meeting can be scheduled to go over these comments. The revised Final Plat and revised CC&R's must address the comments provided above. Include a comprehensive response letter addressing in detail responses to all of the above comments.

Further comments may be generated upon resubmittal of the Final Plat and CC&R package.

COMMENTS:

1. Section 4.1.7.1, LUC, permits a maximum of one year from the date of application to obtain approval of a final plat. If, at the end of that time, the final plat has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this tentative plat is May 29, 2007.

2. This project was reviewed for compliance with requirements of the Land Use Code (LUC), Development Standard (DS), American National Standard Institute (ANSI) and International Building Code 2003 (IBC). Specifically, this project was reviewed for compliance with the content outlined in DS 2-03.6.0.

3. Per DS 2-03.6.1.K, place case number S06-122 in the lower right hand corner.

4. Per DS 2-03.6.2.J, list note, "This subdivision is subject to Ordinance No. 5339, which established zoning in the Tanque Verde/Speedway Annexation area in 1981."

5. Per DS 2-03.6.3.D, move Approval paragraph adjacent to the Recording paragraph.

6. Show office/recreation building (see 27 on site plan) with square footage, state use.

7. Separate recreation areas and associated buildings into a different common area designation from landscaping/vehicular use areas. Revise title block, CCRs.

8. Revise title block LCE description to include: patios, balconies, storage & entrances.

9. Give affidavit certifying how compliance with LUC 4.1.9.1 and 4.1.9.2 is to be met.

10. Development was created from RCP density bonus, clarify which criteria were used for density bonus, and how continued (i.e. offer of low income housing?) with this plat.
