Harrington (520-740-6579), representing the Pima County Departments of Wastewater Management and Environmental Quality Subject: La Mirada Condominiums Units 1-201, Limited Common Elements C1 thru C60 and Common Element Final Plat - 1st Submittal S06-120 The proposed final plat for the above-referenced project has been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use. This project will be tributary to both the Ina Road Water Pollution Control Facility and the Roger Road Wastewater Treatment Facility via the South Rillito Central Interceptor and the North Rillito Interceptor. This project is an apartment to condominium conversion. Sewers are existing and private, except for public sewer manhole #4981-46 and a portion of 8” public sewer main, G-93-103. No new sewers are proposed. Per written guidance provided by the PCWMD Development Services Section, sufficient conveyance and treatment capacity exists in the downstream public sewerage system for this project, and a formal capacity response letter from the PCWMD is not be required. All Sheets: Add the subdivision case number, S06-120, to the title block of each sheet. This number should be shown larger or bolder than any cross-reference numbers. No wastewater review fees will be charged for sheets where this is the only required revision. Sheet 2: During my research, I was unable to locate a public sewer easement, for the existing manhole IMS # 4981-46 (plan G-93-103), located at the northwest PAAL entrance on N. Goyette Avenue, that allows for legal access, operation and maintenance of this portion of the public sewerage collection system. Provide evidence of a found legal easement by inclusion on this site plan with appropriate recording information or: Grant a 20’ PUBLIC SEWER EASEMENT, BY FINAL PLAT, that extends from the property line to at least 10’ past the center of the existing manhole to correct any prior easement omission. Sheet 1: In the Dedication block, 4th paragraph, 1st sentence. Although City of Tucson may accept that the COMMON ELEMENT is granted to the PUBLIC, Pima County WMD would prefer that: These elements are granted as easement to the CITY OF TUCSON, PIMA COUNTY AND ALL UTILITY COMPANIES FOR THE PURPOSE OF… Sheet 1: In the Dedication block, 4th paragraph, 1st sentence. Revise this same sentence so that: After the word UTILITIES, you replace the word PRIVATE, with the word PUBLIC, before the word SEWERS. This office will require a revised set of bluelines, and a response letter, addressing these comments. Additional comments may be made during the review of these documents. Pima County Code Title 13.20.030.A.2 requires that a wastewater review fee be paid for each submittal of the final plat. The fee for the first submittal is $166 plus $50 per sheet. For the second submittal, the review fee is $50 per sheet. For all subsequent submittals, the review fee is $39 per sheet. The next submittal of this project will be the second (2nd) submittal. A check for the review fee of this submittal in the amount of $100.00 (made out to PIMA COUNTY TREASURER) must accompany the revised set of bluelines and response letter. If the number of sheets changes, please adjust the review fee accordingly. The following items still need to be addressed: FINAL PLAT COMMENTS: 1) DS Sec.2-03.6.1.H: Revise the Title Block to add "A Condominium Conversion Project" in the lower right corner of each Sheet. 2) DS Sec.2-03.6.1.K: Place the subdivision case number (S06-120) on all sheets of the final plat in the lower right hand corner near the title block. 3) DS Sec.2-03.6.2.E: Provide a General Note on Sheet 1 of 9 to list all Units that are affected by the FEMA floodplain requirements. Under FEMA regulations if a portion of a structure touches a mapped floodplain then the entire structure falls within the mapped floodplain. Add the following note: "Prior to issuance of any building permit, a Floodplain Use Permit is required for Units 126-163." 4) DS Sec.2-03.6.2.I: Provide a General Note on Sheet 1 of 9 that states the following: "Any relocation, modification, etc., of existing utilities and/or public improvements necessitated by the proposed development will be at no expense to the public." 5) DS Sec.2-03.6.4.A: Revise the Final Plat to indicate the width of the drainageway easement and label the drainage easement as private. 6) DS Sec.2-03.6.4.B: Revise the tables on Sheets 8 and 9 to include for each unit the interior volume (in cubic feet) and interior floor area (in square feet). 7) DS Sec.2-03.6.6: Revise the CC&R's establishing responsibility for construction, maintenance, and ownership of all proposed common areas, drainageways, open space, private streets, or similar joint use. A final signed original copy of the CC&R's will eventually be needed for approval of the Final Plat. Assure that the CC&R's provide for: a) establishing responsibility for maintenance, and ownership of the existing drainageway easements areas; b) maintenance of, and liability for any channels, and drainage structures; c) maintenance of and liability for any other existing commonly-owned areas; d) In response letter include page number in the CC&R's where the drainage liability and maintenance verbiage is found. e) includes the various conditions of any rezoning or other special situations requiring permanent administration by an owners' association. 8) DS Sec.2-03.7.1.F: Since the development is a conversion to a residential condominium development, the affidavits and information, as indicated in the LUC, Section 4.1.9.2 needs to be submitted with the resubmittal of the final plat. Please provide all documentation required. 9) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until one of the following has been provided: f) if there is any remaining construction, the financial assurances shall be submitted and approvable; or, g) provide a copy of Certificate of Occupancy paperwork accepted by the City of Tucson for the final construction. 10) DS Sec.7-01.3.A: All easements that are shown on the Title Report must either be abandoned or the easement is to be shown on the Final Plat with the width, purpose of granting, and recording data of the original subdivision plat or separate instrument shown. Specifically explain Items #6, 12 and 13 in Schedule B of the Title Report. GENERAL COMMENTS: Provide a revised Final Plat and a revised CC&R package at re-submittal. Prior to resubmittal and to expedite your Final Plat review a meeting can be scheduled to go over these comments. The revised Final Plat and revised CC&R's must address the comments provided above.
