Engineering Division has reviewed the submitted Final Plat, CC&R's, and Assurance Package and does not recommend approval of the Final Plat or Assurances at this time. The following items need to be addressed: FINAL PLAT COMMENTS: 1) DS Sec.2-03.6.1.D.2: Revise the location map on Sheet 1 to identify conditions within the square mile area shown, such as the major watercourse (Earp Wash) and the Rodeo Wash Regional Detention Basin. 2) DS Sec.2-03.6.2.D: Provide a General Note to state that the property is subject to conditions of rezoning, add the following note: "This plat is subject to the conditions of rezoning case number C9-90-18, unless superseded by a subsequent rezoning ordinance." 3) DS Sec.2-03.6.3.A: Revise the Final Plat so that the Certificate of Survey paragraph has both original seals stamped and signed by both of the registrants, T. Wayne Ashby, RLS and William H Baker, JR, RLS prior to Final Plat approval. 4) DS Sec.2-03.6.3.B.1: Revise the Certification of Title paragraph to accurately read the following statement from the Development Standard section referenced, "We, the undersigned, hereby warrant that we are the owner(s) and the only (party/parties) having any interest in the land shown on this plat, and we consent to the subdivision of said land in the manner shown hereon." 5) DS Sec.2-03.6.3.C: Revise the Beneficiary paragraph to include the contact phone number for the beneficiary. 6) DS Sec.2-03.6.3.E: Revise the signature line under the Assurance Block to accordingly reflect the following information, _______________________________________________ City of Tucson Development Services Department Engineering Administrator 7) DS Sec.2-03.6.4.I: Revise the Final Plat to provide the dimensions for all shown easements. Specifically the Private Drainage and Landscape Easements, sewer easements, and all other easements that state varying widths. All easements must be drawn in a surveyable manner or be provided with dimensions from one known point. 8) DS Sec.2-03.6.4.K: Revise the Final Plat to label and dimension the ingress/egress easement areas that are being used as Parking Area Access Lanes (PAALs) throughout the multiphased project. The ingress/egress easements can be provided as a blanket easement within the General Notes. Provide the cross access agreement that is required prior to final plat approval, which indicates that access is guaranteed through the site to future sites. 9) DS Sec.2-03.6.5.A: Revise the Final Plat to indicate primary control points, or descriptions and ties to such control points, to which all dimensions, angles, bearings, and similar data on the plat will be referred. Specifically, at least one (1) corner of the subdivision must be tied by course and distance to the section corner or the quarter section corner shown on the Final Plat that was used to establish the basis of bearing. The plat must include a description of that corner marker and an indication of how the bearings were determined. Corner tie recordation information is to be provided on the plat. 10) DS Sec.2-03.6.5.C.4: Revise the Final Plat to include all boundary monumentation that needs to be labeled as found or set. Fully describe and show all markings on found monuments. A one-half inch iron rod tagged by a registered land surveyor is required to be set at all corners of the proposed subdivision. 11) DS Sec.2-03.6.5.C.5: Provide on the Final Plat the distance and bearing between all monuments used. Indicate whether measured or calculated for all property line boundary information. Covenants, Conditions, and Restrictions (CC&R's): 12) DS Sec.2-03.6.6.A: Revise the CC&R's establishing responsibility for construction, maintenance, and ownership for all private drainage and landscape easements, vehicular use easements and all other similar joint uses. A final signed original copy of the CC&R's will eventually be needed for approval of the Final Plat. ASSURANCE PACKAGE COMMENTS: 13) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are approved. Revise the assurance package and address the following comments: I. Provide a copy of the original Trust Agreement. II. Amendment to Trust: a) Revise the legal description in the Amendment to Trust, Exhibit "A" to accurately reflect the Title Block on the proposed Final Plat. b) Provide the Amendment to Trust original seal(s). III. Agreement to Construct: a) Revise the legal description in Exhibit "A" to match the Title Block on the proposed Final Plat. b) Provide Agreement to Construct original notary seal(s) and signatures. c) Revise Item #1 of Assurable Items located in Exhibit "B to state private or public for all paving and vehicular use areas. IV. For this and future projects, please provide a 8½" by 11" location map sheet for assurance submittals that go to Mayor & Council. Typically, these are similar to an enlarged location map on Final Plats. 14) The original Assurance package, with seals and signatures must be submitted prior to Final Plat approval. GENERAL COMMENTS: Provide a revised Final Plat, a revised original CC&R package, and a revised Assurance Package at re-submittal. The revised Final Plat, revised CC&R's, and revised Assurance Package must address the comments provided above. Include a comprehensive response letter addressing in detail responses to all of the above comments. Further comments may be generated upon resubmittal of the Final Plat, CC&R's, and Assurance Package,.
