The proposed final plat for the above-referenced project has been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.



The Pima County Department of Environmental Quality and Wastewater Management Department hereby approve the above referenced submittal of the final plat as submitted.

Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. Prior to the construction of such features, a Construction Authorization (Approval To Construct) may need to be obtained from the Pima County Environmental Quality.

Also, air quality activity permits must be secured by the developer or prime contractor from the Pima County Department of Environmental Quality before constructing, operating or engaging in an activity which may cause or contribute to air pollution.

SUBJECT: Engineering review of the Villas at Hacienda Del Sol Final Plat. The activity number is S06-089.

SUMMARY: The Final Plat and CC&Rs were received by Engineering on June 9th, 2006. Engineering has reviewed the received items and does not recommend approval of the Final Plat or the Assurances.

RESUBMITTAL REQUIRED: FINAL PLAT, ASSURANCES, BOUNDARY CLOSURE CALCS,

SUBMITTAL REQUIRED: original CC&Rs

CC&Rs are approvable. Once the mylars for the final plat please submit the signed original CC&Rs.

The next submittal must address the following items:

GENERAL COMMENTS

1. The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are approved. The complete assurances package must include a copy of the original trust, the original amendment to trust with exhibit A, the original agreement to construct with exhibit B, a copy of the warranty deed, a current title report and a location map on an 8 ½ x 11 sheet. DS 2-03.7.1.G

The Final Plat will not be approved until the Assurance Package is approved.

ASSURANCE COMMENTS

1. The first page of the "Amendment to Trust" and the "Agreement to Construct" must be revised. The Subdivision Case number, S01-045 is not correct, the Subdivision Case number for this project is S06-089. Revise both documents to show the correct Subdivision Case number, S06-045 at the top of each document.

2. The title in section one, first page of the "Amendment to Trust" and section A of the "Agreement to Construct" is incorrect. Provide the verbiage, "Units 1 Thru 218, Units G1 Thru G29, limited Common Elements C1 Thru C205 and Common Element," after the verbiage, "The Villas at Hacienda Del Sol." Revise both documents as requested.

3. Exhibit A "legal description" In the "Amendment to Construct" appears to not be correct. Typically Exhibit A the reads for example something like; lots 1-100 of Saguaro Estates, and CA's of Saguaro Estates … in Book ___ page ___ (blank). It is not clear why a legal description with bearings and distances has been provided. Please clarify in the response letter or submit a revised Exhibit A.

4. It is not clear why an "Exhibit B" was attached to the "Amendment to Trust." Typically "Exhibit B" is attached to "Amendment to Construct." This office will change the documents appropriately. No revision required.

5. Replace the verbiage found in Exhibit B, number 9, with the following verbiage, "If any offsets against impact fees have been requested, all improvements that are the subject of the requested offsets shall be completed and accepted by the City prior to the final release of assurances. Assurances may be partially released prior to the completion of all improvements provided the releases are proportional to the level of completion of improvements."

6. A full explanation of the easements found in the title report must be shown on the final plat. There are several easements listed in the title report that are not shown on the final plat. Revise the plat to show all easements listed on title report or explain the discrepancies in the response letter

7. Submit a copy of an 8.5x11 index map - they are used for final plat assurances processing, tracking lot releases and construction progress. Provide a (8½ by 11) copy of a location map.


FINAL PLAT COMMENT

1. It has been brought to this office attention that the plat activity number, S01-045, pertains to a development, Hacienda Del Sol Office Complex just north of The Villas at Hacienda Del Sol. Is this project a resubdivision of S1-045, Hacienda Del Sol Office Complex? If this project is a resubdivision of a previously recorded subdivision, indicate the appropriate verbiage in the title block. If this project is not a resubdivision, remove the S01-045 activity number from each page of the plat.

2. It has also been brought to the attention of this office a submittal of a revised grading plan has been requested by the City of Tucson Engineering Inspector. Be advised any changes on the revised grading plan that affect the final plat must be made on the final plat. For example if the square footage any of the common elements have changed this would effect the final plat. Revise if necessary and it is recommended to submit the revised grading plan to Development Services Permit Counter as soon as possible.

COMMENTS:

1. Section 4.1.7.1, LUC, permits a maximum of one year from the date of application to obtain approval of a final plat. If, at the end of that time, the final plat has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this final plat is April 19, 2007.

2. The zoning comments issued June 4, 2006 (as follows) were not addressed. Resubmit a revised final plat and a response letter indicated how zoning comments were addressed.

3. Label the location map with both Allen/Tucson streets.

4. Clarify if building G29 will be assigned a building number and label.

5. Common elements should be delineated or enclosed with solid line and labeled separately as "A" landscape, "B" vehicular. Title block should also show these changes.

6. Show and label 1' no vehicular access easements where applicable.

7. The title sheet of the CCR's should include unit numbers, limited common elements and common area designations.

8. Cubic volumes should be listed for each unit on sheet 7 of 7.
