Glenn Street TRANSMITTAL DATE: June 14, 2006 DUE DATE: May 15, 2006 COMMENTS: 1. Section 4.1.7.1, LUC, permits a maximum of one year from the date of application to obtain approval of a final plat. If, at the end of that time, the final plat has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this final plat is April 17, 2007. 2. This plat was reviewed for compliance with the Land Use Code (LUC) and Development Standards (DS). Specifically, the project was reviewed under requirements of final plat content listed in DS 2-03.6.0. 3. Per DS 2-03.6.1.B, please ensure the resubmittal has half-inch margins on all sides, excluding the left, to meet recordation standards. 4. Per DS 2-03.6.1.H.1, please list the elements of the common areas (separated common areas recommended A,B,C - see comments 8 and 9) - pool, recreation building, play area, parking area, office, etc. As for limited common elements, please clarify if stairways and covered parking areas are included in this category. 5. Per DS 2-03.6.3.D, to meet recording requirements, please revise the recording paragraph to match 2-03.6.3.D exactly as shown on page 22 of the platting process - final plat section. There are several extra words to be removed and some periods and commas needed. 8. General note 8 of the plat states the parking will not be assigned, however, page 16 of the CCRs state that the covered parking is reserved and will be allocated at time of unit sale. Please show assigned parking as a Limited Common Element, with a space number designation and measurements. 9. Page 22 of the CCRs states that the association has the right and easement of enjoyment in and to the common elements, subject to the provision that if the assessments are unpaid these rights are suspended. As the plat infers that parking is a common element, this provision must be either removed or modified to ensure that at no time vehicular (and obviously pedestrian and handicapped) access is prevented to a unit. This is where the common elements may be more appropriately labeled individually as A, B, C, etc and what they contain. Be sure to change the title block appropriately if this is done. 10. It appears that 2 units and a public office for the condominiums will be located, as is currently for the apartments, in building 4. The plat does not clarify the square footage of the office and whether it is limited to the 1st floor. Please clarify. 11. The recreation building is not addressed in the plat, as to whether it is to become a common area, a condo conversion, etc. The square footage of the building should be provided in whatever element it will become with this project. 12. Provide a note on the plat (in general note of parking information is fine)and in the CCRs that each unit shall be provided a minimum of one parking space. (The site is legal nonconforming for the amount of parking spaces provided on the last approved site plan for the development, and thus with current code not being able to be met for the parking required for each unit, one space minimum shall be provided for each unit.) 13. Provide an affidavit certifying how LUC 4.1.9.1 and 4.1.9.2 will be met. 14. Provide cubic volume calculations for each condo unit. 15.
