COMMENTS:

1.This review is in follow up to the review comments generated by Peter McLaughlin to ensure those comments were addressed, and for the review of this submittal. Staff confirmed Peter McLaughlin's review requests were addressed, except for a letter advising how 4.1.9.2 of the LUC would be met (building conditions information to tenants).

2. Per discussion with Craig Gross, staff noted the final plat shows the current single lot being divided into three lots. There is no information on the "remaining lot" - with legal description or square footage. This remainder lot is technically a result of this platting process only if it is identified.

To address this, there are two options.
A) revise plat to include data on "remainder lot" and include as parcel C
B) undergo separate lot split application process at counter

Choice A involves a full resubmittal that will be reviewed by all CDRC groups.
Choice B involves submitting a survey document with legal descriptions for all lots to staff as an over the counter review on how the separate lots will function - including easement documents and the last approved site plan for this development. The sections involved in this review process are Zoning, Engineering, Mechanical/Plumbing, Fire and Structural.

3. In addition to the above, the reconfiguration of lot lines around the building site is an issue for building code - as the lot line is proposed only 2' away from the building and there are openings along the building walls. Staff is advising that the assistance of our Building Code review division is sought immediately for any proposed lot line adjustments.

4. The other issue of concern is the parking for this project. It is staff's understanding the parking for the condos may be relocated to a parking garage across the street to the south at a future date. Coupled with the lot split proposal, a perpetual lease agreement must be recorded on the proposed lot containing the parking. This is to ensure all required parking for this condo project is maintained regardless of land sale. The perpetual lease agreement would then run on the property until such time as an alternative parking site, approved by the city, is developed to code and the same amount of parking can be provided on the future site.

5. It is the consensus of staff that we issue a recommendation for the progress of this project to proceed with the condo conversion element of the project. Staff is recommending the plat be revised to show one lot, show the condos as they are proposed, with all easements proposed, and come in for lot line reconfigurations and any splits at a later process with consultation of the building code division as well. This will allow the condo process to proceed without having to address the above issues at the same time.
