The proposed sewer collection lines to serve the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.


Provide a letter from PCWWM Planning Services, written within the past 90 days, stating that treatment and conveyance system capacity for this project is available. A capacity request form may be found at http://www.pima.gov/wwm/forms/docs/CapResponseRequest.pdf.

ALL SHEETS. Add the project number, S06-066, to the title block of each sheet. This number should be shown larger or bolder than any cross-reference numbers.

Based on the evaluation of the proposed sewer design, this project qualifies for Standard sewer connection fee rates.

Subject to the above required revisions, the Pima County Department of Environmental Quality and Wastewater Management Department hereby approve the above referenced submittal of the final plat.

Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. Prior to the construction of such features, a Construction Authorization (Approval To Construct) may need to be obtained from the Pima County Department of Environmental Quality.

Also, air quality activity permits must be secured by the developer or prime contractor from the Pima County Department of Environmental Quality before constructing, operating or engaging in an activity which may cause or contribute to air pollution.

2. If the project has common areas, label each common area individually with a separate letter designation. Enclose with a solid line each common area, private street, etc., that will have separate restrictions, a separate homeowners' association, or any common area that is separated by a public right-of-way. DS 2-03.6.4.C

3. If applicable, show no-vehicular access easements. DS 2-03.6.4.H

4. Indicate primary control points, descriptions and ties to all control points, to which all dimensions, angles, bearings, and similar data on the plat will be referred. At least one (1) corner of thus project will be tied by course and distance to a section corner, a quarter section corner, or an established City or County survey monument. The plat must include a description of that corner marker and an indication of how the bearings were determined. Corner tie recordation information is to be provided on the plat. DS 2-03.6.5.A

5. Basis of bearings - The purpose of the basis of bearings on a survey is to enable another surveyor to retrace the original survey. As such, the statement must be referenced to found, readily locatable monuments. The basis of bearings should be described and shown on the final plat. If the monuments at each end of the reference line are fully described on the plat, they need not be described in the "Basis of Bearings" statement. DS 2-03.6.5.C.1

COMMENTS:

1. An applicant has one (1) year from the date of submittal of a final plat to obtain approval of the final plat that complies with zoning and other development requirements in effect at the time of application. This final plat must be approved and recorded on or before March 20, 2007.

This plan was reviewed for compliance with the Land Use Code (LUC), Development Standard (DS), and American National Standard Institute (ANSI). This submittal was reviewed for compliance with final plat content requirements of DS 2-03.6.0.

2. This site is developed as a commercial office complex. Please clarify if the condominium process underway is to allow the ownership of individual office space, or is for the purpose of converting the site to residential uses.

BE ADVISED, IF THIS A CONVERSION FROM COMMERCIAL TO RESIDENTIAL - A CHANGE OF USE -, A SITE PLAN INVOLVING FULL CODE COMPLIANCE IS REQUIRED TO BE SUBMITTED TO DSD AND APPROVED PRIOR TO THE RESUBMITTAL OF THIS FINAL PLAT.

3. Per DS 2-03.6.1.D, on the location map:
A) Show Glenn Street
B) Revise section number to northwest to read "25"
C) Provide list of recorded subdivisions by book and page number

4. Per DS 2-03.6.1.H, Development Services has assigned case number S06-066 to this project. Please provide this case number in the lower right corner near the title block.

6. Per DS 2-03.6.3.D, please move the recording and approval data paragraphs to be directly adjacent to one another.

7. Per DS 2-03.6.4.C, with regards to common areas and limited common elements:
A) label common area (yard) with a letter (common area "A") and revise title block note.
B) Unrestricted access to parking must be provided for all uses/tenants on this site. Please explain the purpose of the limited common element parking areas, and provide calculations in a response letter how each use/tenant would have enough parking common area parking spaces based upon their square footage. Keep in mind, the entire site was parked at 1:200 parking ratio for offices/retail uses. A tenant/unit list should be provided.
C) For clarification, label the number of parking spaces inside the proposed limited common element parking areas or provide this information in a response letter.
D) Since there are two types of limited common elements proposed, parking spaces and restricted roof access areas, label each type with a letter (limited common element A,B) and revise title block note.

8. Per DS 2-03.6.6.A, the association CCRs state the association has the right to restrict use of the common areas. As the access PAAL and parking are common area, at no time should access to those common elements be restricted. Please review and revise page 8 of the CCRS.

In addition, please make it clear in page 13 of the CCRs that permits from the City of Tucson should be obtained, if required, prior to any interior or exterior building or mechanical modifications.

9. Be advised, the City Attorney's Office is reviewing whether an affidavit of compliance for LUC 4.1.9.1 and 4.1.9.2 is required for commercial to commercial conversions. Note that it is required for commercial to residential conversions.
