RECEIVED: Final Plat and CC & R's on August 21, 2006

The subject project has been reviewed. The subject submittal can not be approved at this time. We offer the following comments:

Final Plat:

1. The Tentative Plat has not been approved yet.
2. Call out the centerline and provide the centerline information for Drexel Road, Bilby Road (D.S. 2-03.6.5.B.).
3. The distance and bearings between all monuments used shall be labeled whether they are measured or calculated (D.S. 2-03.6.5.C.5.). It does not appear that this comment was addressed properly in this submittal.
4. Sheet 8 of 13 does not show the 12' wide ADA compliant multi-use trail and trail easement, shown on the Tentative Plat (Sheet 10 of 12, extending east from Hoptree Place Cul De Sac. Clarify if this easement is existing (include the recording information) or if it is proposed to be dedicated by the Final Plat.
5. Provide a recent copy of the Title Report (more recent than January 18, 2006) in order to verify the easements that are shown on the Plat. It appears that there are several easements, included in the Title Report, are not shown on the Final Plat (look at items A5, A9, A10, A11, A12). Additionally, the Conservation Easement, DKT 12781, PG 2040, does not appear to be included in the Title Report. Clarify and revise as needed.
6. Submit a copy of the Assurances package.

Assurances:

1. Remove the word "Grading" from Common Area "B" description in the Original Agreement recitals, the Amendment and all exhibits "A".
2. Add, in Exhibit "B", the following assurable item "All applicable fees, e.g. permit fees, impact fees must be paid in full to the City of Tucson prior to the final release of subdivision assurances.
3. Include the "Trust Agreement" in the Assurances Package.
4. Include the "Special Warranty Deed" in the Assurances Package.
5. Include in the Assurances Package and up to date Title report.


Prepare a detailed response that explains the revisions that were made and references the exact location in the drainage report and on the Tentative Plat where the revisions were made.
