Harrington, representing the Pima County Departments of Wastewater Management and Environmental Quality Subject: La Playa Condominiums Units 1-16, Common Elements and Limited Common Elements (Yard Area) Final Plat - 1st Submittal S06-045 The proposed final plat for the above-referenced project has been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use. This project will be tributary to the Roger Road Wastewater Treatment Facility via the South Rillito - West (South Line) Interceptor. Per written guidance provided by the PCWMD Development Services Section, sufficient conveyance and treatment capacity exists in the downstream public sewerage system for this project, and a formal capacity response letter from the PCWMD will not be required for this small project. The on-site sewers are existing and private. No new public sewers are proposed for this apartment to condominium conversion project. Sheet 1: Revise the Dedication block, 4th paragraph, last sentence so that: PRIVATE SEWERS are included as part of the list of COMMON ELEMENTS that the ASSOCIATION will accept responsibility for managing, controlling and maintaining. Subject to the above, the Pima County Department of Environmental Quality and Wastewater Management Department hereby approve the above referenced submittal of the final plat. The required revision(s) may be shown on the Mylars. Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. Prior to the construction of such features, a Construction Authorization (Approval To Construct) may need to be obtained from the Pima County Environmental Quality. Also, air quality activity permits must be secured by the developer or prime contractor from the Pima County Department of Environmental Quality before constructing, operating or engaging in an activity which may cause or contribute to air pollution. An applicant has one (1) year from the date of submittal to obtain approval of a final plat that complies with zoning and other development requirements in effect at the time of application. This final plat must be approved and recorded on or before 3/26/07. 2. DS 2-03.6.1.K This project has been assigned the subdivision case number S06-045. Please list the case number in the lower right corner of all final plat sheets. 3. The last approved site plan submitted dated 1959 does not appear to reflect the site conditions at present. The area on the north side of the buildings, according to the last site plan, was for a play area. The aerial photos indicate that this area has at some time in the past been converted to a vehicular parking area. The same photos indicate a roof structure has been added to the west side of unit number 15 (the second unit from the south on the west set of buildings). The indicated swimming pool appears has been filled in. If the submitted last approved site plan is not the most current plan please submit the stamped and approved site plan that addresses the above issues. If the above mentioned roofed structure is an enclosed room it becomes a portion of unit number 15 and must be included in the square footage and cubic footage matrix. The square footage of the limited common area for this unit then would need to be reivised. If it is a open porch in a limited common area clearly indicate it as such. If there is not a stamped and approved site plan that addresses the above issues a new site plan will be required to be submitted, stamped and approved by DSD before approval of the final plat can be completed. Some of the issues that may arise if a new site plan is submitted for are: 1. A DDO may be required for the structure added to unit #15. It appears to be built to close to the property line. 2. Full LUC code compliance for the entire site may be required if the vehicular use area has been expanded greater than 25%. 3. How are the new parking spaces on the north side of the buildings being provided with access to the site? 4. If access is being provided from the property to the northeast, how has the access affected that property. Is there a cross access agreement with this property owner? One other option is to return the property to match the approved site plan from 1959. A demo permit could be secured for the swimming pool if one had not been obtained previously. 4. DS 2-03.6.3.C Label each common area individually with a separate letter designation. 5. Please provide written documentation on how sections 4.1.9.1. and 4.1.9.2. of the LUC will be met with this proposed condominium conversion project. 6. Per DS 2-03.6.2.J, provide note "This subdivision is subject to Ordinance No 2658 , which established zoning in the Pima - 22nd St.- City Limits - Craycroft Rd. Annexation Area." This does not mean that water service is currently available to the proposed development. This development lies within the exterior boundary of Tucson Water's planned 50-year service area. Therefore, water supply is assured. WATER SERVICE The approval of water meter applications is subject to the availability of water service at the time an application is made. The developer shall be required to submit a water master plan identifying but not limited to: Water Use Fire Flow Requirements Offsite / Onsite Water Facilities Loops and Proposed Connection Points to Existing Water System Easements / Common Areas Any specific area plan fees, protected main / facility fees and / or other needed facilities' cost are to be paid by the developer.
