submitted July 24, 2006. TEP is unable to approve the plat at this
time.



In order for this Company to approve the final plat, the following
dedication is required.



"An easement is granted for the purpose of access, installation
replacing repairing and maintenance of electrical meters, cable and
conduits, which grouped electrical meters are attached to the exterior
walls."



Show the required dedication on the resubmittal of the final plat.
Submit two bluelines to the City of Tucson for TEP's final approval.
Any additional easements that are required after TEP prepares an
electrical design will be secured by separate instrument.

Final Plat:

1. Please include a response letter to the comments along with the corrected copies of the FP.
2. Submit the Subdivision Improvement Assurances for review. The following items are required in the assurance package if a Third Party Trust Agreement will be used:
· Title Report
· Special Warranty Deed
· Trust Agreement
· Amendment to Trust
· Agreement to Construct
Submit the above documents containing original signatures, copies of the documents and signatures will not be forwarded to the City of Tucson attorney for review.
3. Correct the title block to match the plan views to read "Common Elements "A" and "B" instead of "Common Areas "A" and "B".
4. The title block of the plat must match the Subdivision Assurances verbatim.
5. Please re-label all common areas that may be used in a dual and/or single use capacity per D.S. 2-03.6.4.C. For example, a Ret./Det. Basin may also be used as a recreation facility or only as a drainage facility or drainage channel and this must be reflected on the Final Plat. A key note explaining the labels could be used in conjunction with the labels, ie.:
Common Element "A" - Streets
Common Element "B" - Drainage/Recreation Facilities
Common Element "C" - Recreation Facilities
Common Element "D" - Drainage Facilities

The proposed final plat for the above-referenced project has been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.


Obtain a letter from the PCWMD's Development Services Section, written within the past 90 days, stating that treatment and conveyance system capacities for the project is available in the downstream public sewerage system and provide a copy of that letter to this office. The required form to request such a letter may be found at:

The final plat for this project cannot be approved until this office has received a copy of this letter. This is the 3rd request.

Sheet 1: In the DEDICATION block, 5th paragraph. There is no Trust Number shown. Once the ownership is resolved we will send to your office via e-mail, a .pdf file containing a Sewer Service Agreement for the proposed number of residential units. Three originals will need to be printed out from this file for notarized signatures by the Owner of Record. The three signed originals of the Agreement must be returned to this office in order to satisfy the necessary requirements needed to approve the final plat.

Sheet 1: In the DEDICATION block, 4th paragraph. There is no mention of the Common Areas “A” & “B” that appear in the project Title block. Please clarify. The Common Areas will need to be:

GRANTED AS EASEMENTS TO THE CITY OF TUCSON, PIMA COUNTY AND ALL UTILITY COMPANIES FOR THE PURPOSE OF ACCESS, INSTALLATION AND MAINTENANCE OF PUBLIC SEWERS, UTILITIES AND DRAINAGE.

And also, the Dedication block does not address the ownership of the Common Areas.

Sheet 2: Revise the site plan so that it shows:

The common areas mentioned in the project title, COMMON AREAS “A” & “B”.

This office will require a revised set of bluelines, and a response letter, addressing these comments. Additional comments may be made during the review of these documents.

Pima County Code Title 13.20.030.A.2 requires that a wastewater review fee be paid for each submittal of the final plat. The fee for the first submittal is $166 plus $50 per sheet. For the second submittal, the review fee is $50 per sheet. For all subsequent submittals, the review fee is $39 per sheet.

The next submittal of this project will be the second (2nd) submittal. A check for the review fee of this submittal in the amount of $100.00 (made out to PIMA COUNTY TREASURER) must accompany the revised set of bluelines and response letter.

If the number of sheets changes, please adjust the review fee accordingly.

COMMENTS: Please resubmit revised drawings along a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. An applicant has one (1) year from the date of approval of tentative plat to obtain approval of a final plat that complies with zoning and other development requirements in effect at the time of application. As of this final plat review date the tentative plat has not been approved therefore the one year date of the final plat approval is based on the date of submittal of the final plat documents. This final plat must be approved and recorded on or before July 23, 2007. Once the tentative plat has been approved the approval date of the final plat will be on one year from the tentative plat approval date. This date will be provided on a future review of the final plat.

2. Please correct the rezoning case number from Co9-05-19 to "C9-05-19". Co9 would indicate a Pima County rezoning case. Please make correct on all sheets of the final plat and to general note 4.

3. The reviewer for the tentative plat is requesting that the RCP be removed and that the applicant use R-3 development designator "P". If the applicant changes the tentative plat by removing the RCP designation please do the same to the title block of the final plat.

4. Please provide the cubic air volume for each condo unit on the final plat.

5. Please indicate in response if these units are single units or multiple units (1st, 2nd , 3rd) floor occupied by several families. The CC&Rs discusses noise impact to unit below floor. If multiple units these must be indicated and volumes and SF provided.
