Harrington, representing the Pima County Departments of Wastewater Management and Environmental Quality Subject: Bear Canyon Condominium Units 2101 to 2201 et al, and Common Elements "A" & "B" Final Plat - 1st Submittal S06-008 The proposed final plat for the above-referenced project has been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use. This project will be tributary to the Ina Road Water Pollution Control Facility via the North Rillito Interceptor. Treatment and conveyance capacity was allocated for this project, Bear Canyon Apartments, under development case number CD9-84-34N, and improvement plans, G-95-055 (public) and PV-96-020 (private), sewer construction plans. On-site sewers are both public and private and existing. No new sewers are proposed. All Sheets: Add the subdivision case number, S06-008, to the title block of each sheet. This number should be shown larger or bolder than any cross-reference numbers. No wastewater review fees will be charged for sheets where this is the only required revision. Catalina Highway Final Plat TRANSMITTAL DATE: March 2, 2006 DUE DATE: February 8, 2006 COMMENTS: 1. Section 4.1.7.1, LUC, permits a maximum of one year from the date of application to obtain approval of a final plat. If, at the end of that time, the final plat has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this tentative plat is February 7, 2007. 2. . This plan was reviewed in accordance with requirements of the Land Use Code (LUC), Development Standards (DS), American National Standard Institute (ANSI), and International Building Code 2003 (IBC). For reference, see DS 2-08 for pedestrian access, DS 2-09 for bicycle parking, 3-01 for sight visibility triangles and 3-05 for vehicular circulation requirements. Specifically, this project was reviewed for compliance with requirements of DS 2-03.6.0, which delineates information to be presented on the final plat. 3. Development Services has assigned case S06-008 to this project. Provide this case number in the lower right hand corner , near title block. 4. Per DS 2-03.6.1.K, provide annexation case C9-84-32 to this plat. 5. Per DS 2-03.6.2.G, provide note "This plat is subject to Board of Adjustment variance C10-95-44, unless expired or superseded by a subsequent application." 6. Per DS 2-03.6.2.J, provide note "This subdivision is subject to Ordinance No 5962, which established zoning in the Tanque Verde/Wrightstown Annexation Area." 7. Per DS 2-03.6.3.D, remove 2005 notation and replace with 2006 notation in Approval paragraph. Move Approval paragraph to be next to the Recording Data paragraph. 8. Per DS 2-03.6.D, add a period (.) before the "M" time reference in the Recording Data paragraph. 9. Provide a notation and dimensions for the space designated as "R" on pages 8-11, it appears to be a storage room option. 10. Per DS 2-03.6.6., the following protective covenants must be revised: A) page 4, Sec.1.17 states that the ow3ner of the unit has the obligation to maintain the Limited Common Elements for which their unit is assigned. The limited common elements include patios, stairwells, landings and balconies. This statement implies that structural components, which are not owned by the condo holder, must be repaired by the condo owner - yet page 10 Sec. 5.3. states the Association has an easement over each unit for the purpose of maintaining, repairing, replacing or painting the Common Elements. The repair and maintenance of structural components should fall on the association for all limited common elements. B) The intention on page 6, Sec. 1.29.6 is unclear. The owner of a unit is entitled to the right to use EITHER a garage unit AND one covered parking space. Clarify. Does the owner have the right to purchase a garage unit AND is entitled to one covered parking space? Keep in mind, parking requirements for a unit, and the amount to be provided, are based upon the approved development plan for this project, which states parking is to be provided based upon the number of bedrooms per unit. Please refer to the Development Plan Parking Requirement Notes to ensure all units get the amount of parking provided to them as recorded on the plan. Should a parking requirement call out 1.55 spaces, it should be rounded up to 2, and so forth. Note, further comments on this issue may be forthcoming. C) Page 32, Section 11.16, talks about the possibilities of combining two or more condo units, and states that removing intervening walls or floors is permitted with the approval of the association. Please add a note that a permit must be issued by the City of Tucson prior to conducting any structural, plumbing, mechanical or electrical work to any units. 11. Please provide written documentation on how sections 4.1.9.1. and 4.1.9.2. of the LUC will be met with this proposed condominium conversion project. 12.
