COMMENTS: Please attach a response letter with the next submittal, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.


1. An applicant has one (1) year from the date of approval of tentative plat to obtain approval of a final plat that complies with zoning and other development requirements in effect at the time of application. This final plat must be approved and recorded on or before December 28, 2007.

2. This review is for a Residential Cluster Project (RCP-9) Final Plat in the C-1 zone (LUC Sections 2.5.3.2.E.2, 3.2.3.1.F & 3.2.6.1 and DS 2-03.6.0).

3. Provide a complete copy of the Covenants, Conditions, and Restrictions (CC&Rs) to be recorded with the Final Plat (DS 2-03.6.6.A). The CC&Rs must be for this subdivision and the label must identically match the title of the subdivision. The CC&Rs provided are for "Blue Indigo Visionary Town Homes." The CC&Rs cannot be replaced by any operating agreement or management agreement.

4. If the name of the subdivision is being changed than all documents including the CC&Rs, Tentative Plat and Final Plat must have the same names, lot numbers and common areas.

Please be aware that additional comments may be necessary relative to revisions and additional information provided on both the Tentative and Final Plats.

The drawings for the proposed Final Plat for the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.

The Pima County Department of Environmental Quality and the Wastewater Management Department hereby approve the above referenced submittal of the final plat received on March 16, 2007.

Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. Prior to the construction of such features, a Construction Authorization (Approval to Construct) may need to be obtained from the Pima County Environmental Quality Department.

Also, air quality activity permits must be secured by the developer or prime contractor from Pima County Department of Environmental Quality before constructing, operating, or engaging in any activity which may cause or contribute to air pollution.
