SUMMARY: Engineering Division of Development Services Department has received, Sheet 1 of the proposed Final Plat, a copy of the CC&R's and a copy of the Title Report. Engineering Division has reviewed the submitted Final Plat, CC&R's and Title Report and does not recommend approval of the Final Plat at this time. The following items need to be addressed:


FINAL PLAT COMMENTS: Provide a copy of the last approved Tentative Plat with the resubmittal for verification of dimensions, locations and uses.

1) DS Sec.2-03.6.1.G: Revise the Final Plat to add the words "Book ____ Page ____" in the upper right hand corner outside of the margin line.

2) DS Sec.2-03.6.1.H.1: Revise the title block on the proposed Final Plat and/or all applicable wording in the CC&R's to match each other. All names, lot numbers and common areas, with descriptions, must have the same wording in the CC&R's as in the Title Block.

3) DS Sec.2-03.6.2.H: Revise General Note #7 to state the following from the Development Standards: "There will be no further division of lots without the expressed approval of the City of Tucson."

4) DS Sec.2-03.6.3.C: Revise the Beneficiary Block to show all of the information required. Provide the Trust Number along with the phone number for the beneficiary contact. Provide the Trust Number in the Dedication paragraph also.

5) DS Sec.2-03.6.3.C: Revise the Acknowledgment and Approval sections to include the correct year, 2008.

6) DS Sec.2-03.6.3.D: Revise Approvals section verbiage on Sheet 1 to state: "The undersigned, Clerk of the City of Tucson, Arizona, hereby certifies that this plat was approved by the Mayor and Council of the City of Tucson, Arizona, on this __ day of ________, 200__. For this and all future projects remove the name "Kathleen S. Detrick" from the Final Plat language.

7) DS Sec.2-03.6.3.D: Revise the Final Plat and the Recording Data section on Sheet 1 to include the correct year, 2008.

8) DS Sec.2-03.6.3.D: Revise the Recording paragraph to include the "No." and "Fee" lines as required by this section.

9) DS Sec.2-03.6.5.A: Revise the Final Plat to indicate primary control points, or descriptions and ties to such control points, to which all dimensions, angles, bearings, and similar data on the plat will be referred. Specifically, at least one (1) corner of the subdivision must be tied by course and distance to the section corner or the quarter section corner shown on the Final Plat that was used to establish the basis of bearing. The plat must include an accurate description of that corner marker and an indication of how the bearings were determined. Corner tie recordation information is to be provided on the plat.


COVENANTS, CONDITIONS, AND RESTRICTIONS (CC&R'S): A final signed original copy of the CC&R's is required for approval of the Final Plat.

10) DS Sec.2-03.6.6.A: Revise the CC&R's to accurately reflect all of the proper common area label and responsibility for maintenance and liability for any proposed commonly-owned area. Revise the following information within the CC&R's:

a) Revise Page 1; paragraph 1 to accurately describe the property (Name, number of units, Common Area A, with descriptions) per the Title Block. Either the CC&R's or the Title Block must be revised and must match with exact wording for the name and Common Area A.

b) Provide Exhibit A within the CC&R's as stated. The legal description for the subdivision must be provided within Exhibit A prior to CC&R approval.

c) A final signed original notarized copy of the CC&R's will be needed prior to approval of the Final Plat.


ASSURANCE PACKAGE COMMENTS:

DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are approved. Assurances must be approved by time of Final Plat Mylar approval. Address the following assurance package comments:

a) For third party trust, provide a compiled package with the following:
i) a copy of the original TRUST AGREEMENT;
ii) original copy of the AGREEMENT TO CONSTRUCT SUBDIVISION IMPROVEMENTS / THIRD PARTY TRUST with attached Exhibit A property description;
iii) original copy of the AMENDMENT TO TRUST / THIRD PARTY TRUST with attached Exhibit A legal description and an Exhibit listing the Assurable items;
iv) Assure that all exhibits are correctly placed/attached, and the case number "S06-179" is at the top of the first page of the AGREEMENT TO CONSTRUCT, EXHIBIT B, and AMENDMENT TO TRUST at minimum;
v) A Title Report that is current within the last 30 days will be required at Mylar review;
vi) Provide a copy of a sample Warranty Deed.

b) Before submitting the assurance paperwork, assure that all descriptions of the Final Plat title block match the assurance paperwork descriptions of the subdivision. Please be aware that the legal office may reject the assurance paperwork if the verbiage does not match exactly the verbiage on the Final Plat's Title Block. Check first pages of both the AGREEMENT TO CONSTRUCT and the AMENDMENT TO TRUST and make sure that the wording exactly matched the Title Block of the plat.

c) For this and future projects, please provide an 8½" by 11" location map sheet for assurance submittals that go to Mayor & Council. Typically, these are similar to an enlarged location map on Final Plats.


GENERAL COMMENTS:

Provide a revised Final Plat, a revised original CC&R package and an Assurance Package at re-submittal.

The revised Final Plat, CC&R's and Assurance Package must address the comments provided above. Include a comprehensive response letter addressing in detail responses to all of the above comments.

Further comments may be generated upon resubmittal of the Final Plat, CC&R's and Assurance Package.

The proposed sewer collection lines for the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). Sheet 1: Fill in the trust number.

The Pima County Department of Environmental Quality and Wastewater Management Department hereby approve the above referenced submittal of the final plat as submitted.

Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. Prior to the construction of such features, a Construction Authorization (Approval To Construct) may need to be obtained from the Pima County Environmental Quality.

Tucson Electric Power Company (TEP) has received the final plat
submitted for review December 18, 2007. TEP is unable to approve the
plat at this time.



TEP received the approved tentative plat dated July 11, 2007. TEP
requested the following plans in order to complete a preliminary
electrical design. TEP will provide an electrical design upon receipt
the required additional plans. The completion of the electrical design
is necessary to determine our easement requirements and review the final
plat.



Additional plans necessary for preparation of the design are: building
plans including water, electrical, landscape, sidewalk and paving plans.
Also, submit the AutoCAD version of the plat on a CD or email to
lcastillo@tep.com <mailto:lcastillo@tep.com> .



Electronic AutoCad Plan format:

1. An Electronic AutoCad plan must be complete and identical to the
official hard copy (paper) project (subdivision, commercial) plat.

2. The AutoCAD plan must be a civil site plan drawing. (The
majority of time an electrical site plan drawing does not have the
required information.)

3. A single AutoCAD plan drawing containing all the layers should
be submitted.

4. AutoCAD plan should be in DWG format.

5. AutoCAD Version can be 2007 or lower.

6. 2D only, not 3D (Please take out reference images and 3D
images.)

7. Please take out the topography Layer.

8. Layers relate to a unique set of CAD features within the
drawing. (For example all lot lines should be on one layer, street
centerlines another layer.)

9. Include the required Layers: Lot Lines, Right of Way lines,
Street Centerlines, Buildings, Curbs, Basin, Section Lines, Boundary
of Property, Footages, Bearings, Lot Numbers, Street Names, and Tie Down
(Section or Quarter Pins.)

10. At least three tie points are required; one must be a Section or a
Quarter pin and the others may be street intersections or lot corners.
Bearings and distances must be designated from the tie points.

11. Please include the Boundary Line of Property. It must be
designated with bearings and distances.

12. Any special fonts, X-REFs, or attachments should be submitted along
with the CAD drawing.
