This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.

The Pima County Department of Environmental Quality and the Wastewater Management Department hereby approve the above referenced submittal of the Final Plat as received by us on October 25, 2006.

Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. Prior to the construction of such features, a Construction Authorization (Approval To Construct) may need to be obtained from the Pima County Department of Environmental Quality.

Also, air quality activity permits must be secured by the developer or prime contractor from the Pima County Department of Environmental Quality before constructing, operating or engaging in an activity which may cause or contribute to air pollution.

Engineering has reviewed the received items and does not recommend approval of the Final Plat.


1. Include a response letter with the next submittal that states how all comments have been addressed.

2. Under the project location map call out the section, township, and range. DS 2-03.6.1.D.3

3. If applicable, the following BENEFICIARY block must be included on the title page. DS 2-03.6.3.C

5. Protective Covenants. Protective covenants or Covenants, Conditions, and Restrictions (CC&Rs) establishing responsibility for construction, maintenance, and ownership of any proposed common area, open space, private street, or similar joint use, when needed, is required: DS 2-03.6.6 The Final Plat will not be approved until the CC&R's have been accepted

6. Maintaining the storm drain facilities on this site is critical therefore the Covenants, Conditions, and Restrictions (CC&Rs), and the Final Plat, shall have a note stating (a) that the owner or owners shall be solely responsible for operation, maintenance, and liability for drainage structures and detention basins; (b) that the owner or owners shall have an Arizona Registered Professional Civil Engineer prepare a certified inspection report for the drainage and detention/retention facilities at least once each year, and that these regular inspection reports will be on file with the owner for review by City staff, upon written request; (c) that City staff may periodically inspect the drainage and detention/retention facilities to verify that scheduled and unscheduled maintenance activities are being performed adequately; and (d) that the owner or owners agree to reimburse the City for any and all costs associated with maintaining the drainage and detention/retention facilities, should the City find the owner or owners deficient in their obligation to adequately operate and maintain their facilities. SMDDFM 14.3.4.2

7. Due to the assurable items that are proposed for this project an Assurance Package is required with the Final Plat. The Final Plat will not be approved until the Assurance Package has been accepted.

6. Per DS 2-03.6.3.D, Approval Paragraph, instead of 2006 at end of sentence, revise year to 20___. Could be 2007 when recorded. Please add a period at the end of the year.

7. Easements: list telephone easement per T.Plat, list declaration for lots in dkt 12431/pg 1448 per T.Plat, advise what utilities in public utility easement proposed per this plat & dkt/pg recorded or state "docket____, pg____" next to public utility easement note to be included with final plat. Is this proposed utility easement overhead or underground?
