The last approved site plan for this site, submitted with this project, was approved with erroneous information regarding the right of way on it. It appears in actuality, the parking and the parking maneuvering areas extend into the right of way, which is not permitted per LUC 3.3.4. - parking shall be provided on site. The result of this is an insufficient amount of parking, which requires a Board of Adjustment variance to be granted to maintain the parking as delineated. Any use of the right of way also requires a Temporary Revocable Easement through the City Real Estate division. Note, should the original approved site plan for this development show parking/maneuvering within the right of way, a variance would not be required. Please review the records division at Development Services for further assistance on seeking this document. 2.
