This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.


The Pima County Department of Environmental Quality and the Wastewater Management Department hereby approve the above referenced submittal of the Final Plat as received by us on October 16, 2007.

Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. Prior to the construction of such features, a Construction Authorization (Approval To Construct) may need to be obtained from the Pima County Environmental Quality.

Also, air quality activity permits must be secured by the developer or prime contractor from the Pima County Department of Environmental Quality before constructing, operating or engaging in an activity which may cause or contribute to air pollution.

SUMMARY: Development Services Department Engineering Division has completed the review of the revised Final Plat package that included the second supplement to CC&R's, location map, original agreement to construct, original amendment to trust, warranty deed, trust agreement, docket 7098, title report schedule B, and response letter. Engineering recommends conditional approval of the Final Plat. The following conditions associated with the assurances, CC&R's, and minor plat items may be addressed with mylar submittal.

FINAL PLAT CONDITIONS OF APPROVAL:
1) City of Tucson Development Standards (DS) Section No. 2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are acceptable. Address the following items for the third party trust package:
a) Assure that the descriptions of the common areas on the plat and in the descriptions in the Final Plat title block match the descriptions of the subdivision common areas in the assurance paperwork. 'Common Areas "B-1"' is shown on the plat, and 'Common Area "B-1"' is called out on the assurance documents. Either change the plat or the assurances so that descriptions match. Provide revised AMENDMENT TO TRUST / THIRD PARTY TRUST, revised AGREEMENT TO CONSTRUCT and revised CC&R's, or, revise plat's title block.
b) Provide a copy of the updated/latest title report.
2) DS Sec.2-03.7.1.E: Provide master CC&R's to show basin/drainage maintenance (including offsite drainage easement), or, assure that the CC&R's are revised to include any maintenance checklist as provided in the Drainage Report for the approved Tentative Plat. Provide signed original of CC&R's.
3) DS Sec.2-03.6.5.B: Assure all existing easements as listed in the Title Report Schedule B are clearly drawn, identified, and labeled on the Final Plat. Specifically, Item 5 slope easement dkt 7494 pg shall be labeled on plat or removed from Title Report if not existent. Revise plat or submit revise title report. Provide status of these easements in response letter.
4) DS Sec.2-03.6.5.C.5: Address the following boundary data and other minor survey items remaining:
a) DS Sec.2-03.6.5.B: Provide surveyable distance/bearings for drainage easement along west property boundary. Provide tie for easement to boundary corner or lot / common area corner.
b) On mylar, verify crow's feet for distance 74.59' to clarify whether this distance goes to east quarter section line, or to survey monument in Tucson Boulevard.

Submit complete assurance package, copy of the updated title report, revised Final Plat (check with CDRC if this is mylar stage), master CC&R's and supplement CC&R's, and response letter. The above referenced project has been CONDITIONALLY APPROVED by the Community Design Review Committee. Please make any necessary corrections and submit the following documents:

(1) Executed Final Plat Double Matte Océ or Photo Mylar.
(1) * Check in the amount of $8.50 per plat page for Mayor & Council distribution made payable to the local print company of your choice or provide an account number to charge.
(1) * Check in the amount of $55.00 per plat page for recorded plat distribution made payable to the local print company of your choice or provide an account number to charge.
(1) Check made payable to "Pima County Recorder" in the amount of $20.00 per plat page plus a $4.00 handling fee, along with CC&R fees if applicable. CC&R fees are $9.00 for the first 5 pages and $1.00 for each additional page.

*Please do not combine the checks for the printing charges. They are processed at different times and require separate checks. An account number is also acceptable and you can include this information on your transmittal sheet when submitting the above listed items.

Assurances (if applicable) must be reviewed by the City Attorney's Office prior to being presented to the Mayor and Council. Plats, CC&R's and assurances must be approved at the same Mayor and Council Meeting. Please expect 7 - 8 weeks from the date submitted to the date scheduled for Mayor and Council approval.
