Section 4.1.7.3, LUC, permits a maximum of one year from the date of application to obtain approval of a final plat plat. If, at the end of that time, the final plat has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this final plat is October 2, 2006. REVISION NOTE: ZONING CANNOT APPROVE THIS MINOR SUBDIVISION UNTIL A WRITTEN ADVISEMENT IS ISSUED FROM BUILDING CODES THAT INDICATES THIS PROPOSED LOT LINE BETWEEN LOTS 2 AND 3 CAN BE POSITIONED UP AGAINST THE EXISTING BUILDING. (An email, memo etc. is acceptable.) 2. (Per last review) Per DS 2-03.6.4.A, cross access and cross parking easements and agreements are required to be provided for lot 3, as direct street access is not shown. Per this review: Staff acknowledges the CCR's for this project lists the Common Area A as the shared access point for all uses/lots in this development. The concern is with the wording of the CCR's in Section 3.1, specifically the right to use the Common Area. On the plat, the Common Area is the access and parking area for all uses. The CCR's state the Common Area is subject to limitations and suspensions, such as delinquent assessments. Access and parking must be provided and maintained at all times for this development, and cannot be restricted. Please review the CCR's and revise them to ensure that it is clearly stated cross-parking and cross-access to all properties is provided and maintained in perpetuity. (Staff acknowledges Section 3.3 of the CCR's indicates an easement for ingress and egress is created, however, the wording of Section 3.1. appears to limit the use of that ingress and egress easement). 3. The proposed property line between lots 2 and 3 on the plat contradicts the building dimensions on the approved development plan. The development plan shows a building line (which will be on lot 2 once the split is done) at 40 feet in length, whereas the same line proposed on the final plat is only 38.75 feet in length. Please address this discrepancy, and revise the plat accordingly. 4. (520-740-6563), representing the Pima County Departments of Wastewater Management and Environmental Quality Subject: Drabs Pueblo Complex, Lots 1-3 and Common Areas A and B Final Plat - 2nd Submittal S05-179 The proposed final plat for the above-referenced project has been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use. This office's understanding of this project is as follows: Your client will expand the existing building on this lot to construct the "Future Expansion – Professional Offices" and "Future Expansion – Medical Offices" that were shown on the approved development plan. The resulting larger building will be split into three condominium type units that will be sold to different owners. All three condominium type units in the resulting larger building will discharge to the public sewer system via the existing connection from the existing building. The parking area access lanes and spaces shown on the approved development plan will be in Common Area A. The retention / detention basin shown on the approved development plan will be in Common Area B. The following comments are based on this understanding. If any portion of this understanding is incorrect, please meet with me at the earliest opportunity so that this letter may be revised appropriately. Sheet 1: Revise the 1st sentence of the 3rd paragraph of the Dedication to read: COMMON AREAS, AS SHOWN HEREON, ARE RESERVED FOR THE PRIVATE USE AND CONVENIENCE OF ALL OWNERS OF PROPERTY WITHIN THIS SUBDIVISION, AND ARE GRANTED AS EASEMENTS TO THE CITY OF TUCSON, PIMA COUNTY, AND ALL ULITITIES COMPANIES FOR THE PURPOSES OF ACCESS, INSTALLATION, MAINTENANCE AND IMPROVEMENT OF ABOVEGROUND AND UNDERGROUND UTILITIES AND PUBLIC SEWERS. Sheet 1: Add a General Note that states: PRIOR TO THE ISSUANCE OF BUILDING PERMITS, A JOINT USE AND MAINTENANCE AGREEMENT MUST BE RECORDED FOR ANY SHARED PRIVATE SEWER LINES ON THIS DEVELOPMENT. THIS AGREEMENT SHALL BE REVIEWED AND APPROVED BY THE PIMA COUNTY DEPARTMENT OF WASTEWATER MANAGEMENT PRIOR TO RECORDATION. Sheet 2: A common area is a parcel of land that is be owned by the property owner's association, so that it may be used any of the lot owners. As the purpose of a final plat is to establish the property rights for the underlying land, re-label those land areas shown as common elements as COMMON AREAS. Sheet 2: Show the retention / detention basin as COMMON AREA B. Sheet 2: The lot lines and common areas (common elements) shown on this submittal do not make sense. No land can be both a common area (or common element) and a privately owned lot, as this would create conflicting property rights, and confuse the ownership of those areas. Revise the plat to show the boundaries of Common Areas A & B with solid lines, just as you would any other lots, and Lots 1-3 being just the three condominium type units within the larger building. Alternately, one could keep the lot lines shown, and replace the common elements with easements of various types being created by this plat, but this would involve considerably more effort than what has been suggested in the preceding paragraph. This office will require a revised set of bluelines, and a response letter, addressing these comments. Additional comments may be made during the review of these documents. Pima County Code Title 13.20.030.A.2 requires that a wastewater review fee be paid for each submittal of the . The fee for the first submittal is $166 plus $50 per sheet. For the second submittal, the review fee is $50 per sheet. For all subsequent submittals, the review fee is $39 per sheet. The next submittal of this project will be the third (3rd) submittal. A check for the review fee in the amount of $78.00 (made out to PIMA COUNTY TREASURER ) must accompany the revised set of bluelines and response letter. If the number of sheets changes, please adjust the review fee accordingly.
