03/19/2007 | JASON GREEN | ENGINEERING | REVIEW | Approv-Cond | DATE: March 19, 2007 SUBJECT: Huachuca Condominiums Final Plat Submittal- 2nd Engineering Review TO: Patricia Gehlen, CDRC Manager LOCATION: 1709 N Huachuca Ave, T14S R13E Sec 03, Ward 1 REVIEWERS: Jason Green, CFM ACTIVITY: S05-162 SUMMARY: Engineering Division of Development Services Department has received the revised Final Plat, Sheet 1, 2 and 3, a copy of the Covenants, Conditions, & Restriction's (CC&R's), and the original Assurance Package. Engineering Division has reviewed the submitted Final Plat, CC&R's, and Assurance Package and recommends conditional approval of the Final Plat at this time. The Assurance Package is denied. The following items need to be addressed prior to Mylar submittal: FINAL PLAT COMMENTS: 1) DS Sec.2-03.6.5.C.4: Revise the Final Plat to include all boundary monumentation that needs to be labeled as found or set. Fully describe and show all markings on found monuments. A one-half inch iron rod tagged by a registered land surveyor is required to be set at all corners of the proposed subdivision. For this project if the 2 property corners on the west side can not be set because they fall within the drainage channel than provide 2 set points on top of bank and give calculated bearing and distances between the monuments and the actually property corners. 2) DS Sec.2-03.8.1.D: Revise the typo error on Sheet 2 of 3 of the proposed Final Plat for the existing 40-foot drainage easement. The Title Report shows the recordation information as Docket 946 Page 15 not Docket 649. 3) DS Sec.2-03.6.3: Revise Final Plat Standard Paragraphs under the Approval and Recording Data to show the applicable year, 2007 at all date lines. ASSURANCE PACKAGE COMMENTS: 4) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are approved. Revise the assurance package and address the following comments: I. Provide the legal description, Exhibit A, for the original Trust Agreement. II. Amendment to Trust: Revise the legal description in the Amendment to Trust, Exhibit "A" to accurately reflect the Title Block on the proposed Final Plat and all Assurance language. Specifically look at all comma uses. III. Agreement to Construct: Revise Item #4 of Assurable Items located in Exhibit "B to correctly state that all new sanitary sewer systems are private per the Tentative Plat review. IV. For this and future projects, please provide an 8½" by 11" location map sheet for assurance submittals that go to Mayor & Council. Typically, these are similar to an enlarged location map on Final Plats. 5) The original Assurance package, with seals and signatures must be submitted prior to Final Plat approval. 6) DS Sec.7-01.3.A: All easements that are shown on the Title Report must either be abandoned or the easement is to be shown on the Final Plat with the width, purpose of granting, and recording data of the original subdivision plat or separate instrument shown. Specifically explain Items #5, 7, and 8 in Schedule B of the Title Report. 7) DS Sec. 7-01.4.A: The developer must obtain from each entity having a record interest in an easement, as shown by the current submitted title report, a recordable document such as a quit-claim deed or abandonment of easement which relinquishes its interest in the easement. GENERAL COMMENTS: The Final Plat is conditionally approved provided that items 1-3 above are corrected at Mylar submittal. Provide a revised Assurance Package at re-submittal. The revised Assurance Package must address the comments provided above. Include a comprehensive response letter addressing in detail responses to all of the above comments.
