Subject to the above, the Pima County Department of Environmental Quality and the Wastewater Management Department hereby CONDITIONALLY approve the above referenced submittal of the Final Plat as received by us on September 29, 2006. Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. SUMMARY: Engineering Division of Development Services Department has received, Sheet 1, 2 and 3 of the proposed Final Plat, and a copy of the Covenants, Conditions, & Restriction's (CC&R's). Engineering Division has reviewed the submitted Final Plat and CC&R's and does not recommend approval of the Final Plat at this time. The following items need to be addressed:


FINAL PLAT COMMENTS:

1) DS Sec.2-03.6.2.C: Revise General Note #10 to read "All Parking Area Access Lanes are privateā€¦" The pavement area was reviewed for Parking Area Access Lanes (PAALs).

2) DS Sec.2-03.6.2.C: Revise General Note #14 to correctly label total miles of private streets as "0". Pavement areas were reviewed as PAALs.

3) DS Sec.2-03.6.1.H.1: Revise the title block on the proposed Final Plat and all applicable wording in the Assurance package and CC&R's to read Common Element "A" (Parking Area Access Lane)

4) DS Sec.2-03.6.3.A: Revise the Certification of Survey paragraph to include "I further certify that this plat was prepared under my direction." This statement needs to be the last sentence in the Certification of Survey paragraph.

5) DS Sec.2-03.6.3.B.3: Revise the hold harmless paragraph to include the word "surface" so it reads "or damage caused by water, whether surface flood or rainfall."

6) DS Sec.2-03.6.3.C: Revise the Beneficiary paragraph to include the Trust Number and the contact name, address and phone number for the beneficiary.

7) DS Sec.2-03.6.3.D: Revise the Recording Data paragraph to allow for drafting recommendations

I. Revise to allow more room for the Official Seal next to the State of Arizona and County of Pima.

9) DS Sec.2-03.6.4.C: Clarify whether the saleable areas shown on the Final Plat are divided by building lines or unit numbers. Revise the proposed Final Plat to include the buildings within the Common Element description or Limited Common Element or enclose them with a solid line if they are part of the units being platted.

10) DS Sec.2-03.6.4.C: Tie saleable units to a property corner for surveyable purposes.

11) DS Sec.2-03.6.4.C: Remove all floating extraneous lines from plan view if they are part of a Common Element (i.e. parking stall dimensions, hashed area for concrete sidewalk, etc.).

12) DS Sec.2-03.6.4.F: Revise the Final Plat to show the limits of the 100-year floodplain in a surveyable and readily retraceable manner with frequent ties to intersecting property boundary lines.

13) DS Sec.2-03.6.5.A: Revise the Final Plat to indicate primary control points, or descriptions and ties to such control points, to which all dimensions, angles, bearings, and similar data on the plat will be referred. Specifically, at least one (1) corner of the subdivision must be tied by course and distance to the section corner or the quarter section corner shown on the Final Plat that was used to establish the basis of bearing. The plat must include a description of that corner marker and an indication of how the bearings were determined. Corner tie recordation information is to be provided on the plat.

14) DS Sec.2-03.6.5.C.1: Describe the basis of bearing provided on the proposed Final Plat. Provide a description for the basis of bearing and show the 2 found, physically monumented points required to establish the basis of bearing.

15) DS Sec.2-03.6.5.C.1: Clarify General Note #17. The 2 property corners on the west side have not been set therefor not all boundary bearing, distances, and ties to monuments are measured.

16) DS Sec.2-03.6.5.C.4: Revise the Final Plat to include all boundary monumentation that needs to be labeled as found or set. Fully describe and show all markings on found monuments. A one-half inch iron rod tagged by a registered land surveyor is required to be set at all corners of the proposed subdivision. For this project if the 2 property corners on the west side can not be set because they fall within the drainage channel than provide 2 set points on top of bank and give calculated bearing and distances between the monuments and the actually property corners.

17) DS Sec.2-03.6.5.C.3: Provide the boundary survey and section breakdown for the proposed project with information of closure calculations.



Covenants, Conditions, and Restrictions (CC&R's):

18) DS Sec.2-03.6.6.A: Revise the Introduction Paragraph in the CC&R's establishing responsibility for construction, maintenance, and ownership of all existing Common Elements, Limited Common Elements, or similar joint use. A final signed original copy of the CC&R's will eventually be needed for approval of the Final Plat. Assure that the CC&R's provide for:

I. Revise Page 1; paragraph 1 to accurately describe the property as Huachuca Condominiums Units 1 Thru 10, Common Element "A" (Parking Area Access Lane) and Common Element "B" (Landscape, Walkway, and Easement Areas).
II. Revise Page 18, Article 5; The Maintenance and Repairs of Common Elements and Units must include language for liability and maintenance verbiage of Common Elements "A" (Parking Area Access Lane) and "B" (Landscape, Walkway, and Easement Areas).


ASSURANCE PACKAGE COMMENTS:

19) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the Financial Assurances package is received and approved.

20) The original Assurance package, with seals and signatures must be submitted prior to Final Plat approval.

21) Before submitting the assurance paperwork, assure that the descriptions of the common elements of the Final Plat title block match the assurance paperwork descriptions of the condominium common elements. Please be aware that the legal office may reject the assurance paperwork if the verbiage does not match exactly the verbiage on the Final Plat's Title Block.

22) DS Sec.2-03.8.1.D: Provide a copy of a current Title Report for review. Assure that all easements that are included in Schedule B of the Title Report are on the Final Plat or that a Blanket Easement note has been added, if applicable.


GENERAL COMMENTS:

Provide a revised Final Plat, a revised original CC&R package, an Assurance Package, and a copy of the Title Report at re-submittal.

The revised Final Plat, revised CC&R's, Assurance Package, and Title Report must address the comments provided above. Include a comprehensive response letter addressing in detail responses to all of the above comments.

Further comments may be generated upon resubmittal of the Final Plat, CC&R's, Assurance Package, and Title Report.
