12/02/2005 DAN CASTRO ZONING REVIEW Denied COMMENTS

1. An applicant has one (1) year from the date of approval of the tentative plat to obtain approval and recordation of a final plat that complies with zoning and other development requirements in effect at the time of application. Since the tentative plat for this subdivision has not yet been approved, the approval date for this final plat may not be determined. In addition, the final plat may not be approved prior to approval of the tentative plat. Since the tentative plat has not yet been approved, any revisions made to the tentative plat which effect the final plat must also be made to the final plat.

2. The CC&R's submitted require an addendum providing a revised cover sheet which describes all subdivision information found in the title block located on each sheet of the final plat (i.e. subdivision name, number of lots, and common areas).

RECEIVED: Final Plat, Assurances and CC & R's on November 18, 2005

The subject project has been reviewed. We offer the following comments:

1. Since any proposed development/encroachment near Mesquite Wash must comply with the W.A.S.H. Ordinance requirements, and since the 50' study area was taken from the 10-year floodplain limits, the 10-year floodplain and the 50' study area should be shown on the Final Plat and their symbols shall be included in the Legend (D.S. 2-03.6.1.L).
2. The limits of the 100-year floodprone area is not shown in a surveyable and readily retraceable manner as required by D.S. 2-03.6.4.F. Revise as necessary.
3. Detention basins 3 and 4 appear to be combined on sheet 14/14. Separate the two basins and show them in a surveyable and readily retraceable manner (D.S. 2-03.6.4.I.). Please be advised that showing the common areas, within which the detention/retention basins are located, in a surveyable manner is not sufficient.
4. It appears that the boundary survey and closure calculations report were not included in this last submittal. Submit a copy of the boundary survey in accordance with D.S. 2-03.6.5.C.3.
5. Submit a copy of an up-to-date Title Report.

CC & R's:

1. Response letter was not submitted for the previous CC & R's comments.
2. Section 5.7 on page 22 describes a drainage easement that does not appear to be shown on the Final Plat. Address this issue.
3. Submit a copy of the CC & R's amendment specific for the subject development that includes a revised project sketch.
4. The CC & R's shall specifically address the maintenance of the drainage facilities. Add a paragraph, which addresses the maintenance of the drainage structures in more details (i.e. what facilities to be inspected and maintained, how, when, by whom, the detention/retention basin maintenance list, keeping records, and repair decisions, etc). The maintenance checklist should be referenced in the CC & R's.
5. This Office recommends including the proposed drainage facilities maintenance checklist in the CC & R's to allow the Home Owners Association access to it and facilitate their maintenance responsibilities.

ASSURANCES:

1. Common Area "A" description in the Recitals and in the Amendment does not include the word "Utilities" as shown on the Final Plat.
2. Common Area "A" description in the Recitals and in the Amendment, contains "Private Access Lanes", which is different from what is shown on the Final Plat (i.e. Private Streets).
3. The original Assurances and the Amendment do not include Exhibit "A" to "A", Exhibit "A", the Trust Agreement, the Warranty Deed and the Title Report.

Prepare a detailed response that explains the revisions that were made and references the exact location in the CC & R's and on the Final Plat where the revisions were made.

The proposed sewer collection lines for the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.



The requested Sewer Service Agreements have not been returned to our office for processing.

A public Sewer Service Agreement for the proposed number of residential lots has been sent to your office. After the three original Sewer Service Agreements have been signed by the Owner of Record, the three originals should be returned to Pima County Development Services in order to satisfy the necessary requirements needed to approve the final plat.

Sheet 1: Item #1 of the 1st final plat submittal, dated October 12, 2005, has not been adequately addressed. In the Dedication block, 4th paragraph, last sentence;

After the word DRAINAGEWAYS add the word PRIVATE, before the word SEWERS.

Sheets 3, 5, 7, 9 & 10: Revise Keynote #3 so that;

The PRIVATE SEWER EASEMENT is correctly identified as a PUBLIC SEWER EASEMENT.

Subject to the above, the Pima County Department of Environmental Quality and Wastewater Management Department hereby approve the above referenced submittal of the final plat. The required revision(s) may be shown on the Mylars.

Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. Prior to the construction of such features, a Construction Authorization (Approval To Construct) may need to be obtained from the Pima County Environmental Quality.

Also, air quality activity permits must be secured by the developer or prime contractor from the Pima County Department of Environmental Quality before constructing, operating or engaging in an activity which may cause or contribute to air pollution.
