The proposed sewer collection lines to serve the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.


The wastewater review fee for this final plat is $266.00, however, only $100.00 was paid. Please refer to the last review comment on this letter to find out your total review fee for the next submittal.

ALL SHEETS. Add the project number, S05-077, to the title block of each sheet. This number should be shown larger or bolder than any cross-reference numbers.

A Sewer Service Agreement for the proposed number of residential lots will be prepared once the cover sheet of this final plat shows the owner name and address or it properly displays the title company with the appropriate trust number. After three original Sewer Service Agreements have been signed by the Owner of Record, the three originals should be returned to Pima County Wastewater Management in order to satisfy the necessary requirements needed to approve of the final plat.

Revise the fourth paragraph of the Dedication to read

“…EASEMENTS AS SHOWN HEREON FOR THE PURPOSES OF ACCESS, INSTALLATION AND MAINTENANCE OF PUBLIC SEWERS AND UTILITIES AND OTHER USES AS DESIGNATED BY THIS PLAT.”

Revise the fifth paragraph of the Dedication to read

“… ARE GRANTED TO THE PUBLIC AND ALL UTILITY COMPANIES FOR ACCESS, INSTALLATION AND MAINTENANCE OF ABOVEGROUND AND UNDERGROUND UTILITIES AND PUBLIC SEWERS.”

We will require a revised set of drawings and a response letter addressing each comment. Additional comments may be made during the review of these documents.

The next submittal of this project will be the 2nd submittal. A check for the review fee of this submittal in the amount of $216.00 ($166.00 due from first review + $50.00 for the next review) made out to PIMA COUNTY TREASURER must accompany the revised set of bluelines and response letter.

SUMMARY: The Final Plat and CC&R's were reviewed by Engineering on March 22, 2006. Engineering Division does not recommends approval of the Final Plat and CC&R's at this time.

1. Add the following note: "There will be no further division of lots without the expressed approval of the City of Tucson." The purpose of this note is solely for review for compliance with local and state laws governing subdivision and lot splits. (DS 2-03.6.2.H)
2. Revise the Covenants, Conditions and Restrictions to include the basin maintenance language from the Drainge Manual Section 14.3.2.
3. Clarify the nature of the basis of bearing. The notations refer to the book and page of the plat for Emery Park 2 (Judge Emery's Poultry Colony Unit 2.) The plat does not provide a bearing for Fontana Avenue and does not show the location of the indicated monuments. Provide ties to a section corner or quarter corner. Otherwise provide recordation data for the monuments referenced. The recorded documents must provide clear identification of the monuments referenced. (DS 2-03.6.5)
4. Label all lines as to exact nature. (DS 2-03.6.5.C.2)
5. Discuss in your response letter the assurances mechanism that will be used for this project. If a third-party land trust will be used, the notes on the Plat must reflect this.
A complete assurances package must be submitted and approved before the plat can be scheduled for Mayor and Council consideration.

Tucson Electric Power Co. (TEP) has received the final plat submittal
dated February 14, 2006 for this subdivision. TEP is unable to approve
the plat at this time. Enclosed is a copy of the tentative plat showing
where TEP will be placing the aboveground equipment for this
subdivision. TEP has provided this drawing to show where the proposed
locations are for transformers and pedestals.



In order for this Company to approve the final plat, the following
easements are required.



* An additional 4' x 10' easement is required at each of the
transformer locations, at Lots 6 and 7, also at Lots 2 and 3.

* A 10' wide easement is required for the cable along the
western boundary of Lot 7 and within Common Area A.



Show all requested easements on the resubmittal of the final plat.
Submit two bluelines to the the City of Tucson for TEP's final approval.
