Tucson Electric Power Company (TEP) has reviewed the final plat submitted
for review August 3, 2005. TEP is unable to approve the plat at this time.

As previously advised, there are existing facilities (46kv poles) on
Alvernon Way, the poles from where the south property line starts going
north to just south of Benson Highway will need to be relocated. There will
be billable costs to relocate the poles because of the road widening. TEP
has been waiting on a decision from the developer regarding the relocation
of the poles in order to proceed with the preliminary design. The final
plat cannot be approved until we complete the design which will determine
the easement requirements.

This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.


A public Sewer Service Agreement for the proposed number of residential lots has been sent to your office. After three original Sewer Service Agreements have been signed by the Owner of Record, the three originals should be returned to Pima County Wastewater Management in order to satisfy the necessary requirements needed to approve the final plat.

Subject to the above, the Pima County Department of Environmental Quality and Wastewater Management Department hereby approve the above referenced submittal of the tentative plat. The required revision(s) may be shown on the Mylars.

Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. 1. An applicant has one (1) year from the date of approval of tentative plat to obtain approval of a final plat that complies with zoning and other development requirements in effect at the time of application. This final plat must be approved and recorded on or before August 2, 2006. As of this final plat review date the tentative plat has not been approved therefore the one year date of the final plat approval is based on the date of submittal of the final plat documents. Once the tentative plat has been approved the approval date of the final plat will be on one year from the tentative plat approval date. This date will be provided on a future review of the final plat.

2. The drawing should be drawn at a scale no greater than 1 inch equal to forty feet. Revise as required. DS 2-03.6.1.A

3. Revise the title block to include the block designations as listed on the title of the tentative plat. DS 2-03.6.1.H.1

SUMMARY: The Final Plat, and assurance documents were received by Engineering on August 3, 2005. Engineering has reviewed the received items and does not recommend approval of the Final Plat or assurances at this time. Please address the Tentative Plat issues as well as the following Final Plat comments prior to resubmittal.

FINAL PLAT COMMENTS:
1) City of Tucson Development Standards (DS) Section No.2-03.7: The submittal of this final plat prior to approval of the tentative plat is done at the applicant's risk since changes could be required of the tentative that may affect the final plat.
2) DS Sec.2-03.6.4.K: In response letter discuss status of Antrim Loop vacation as well as Lakota Drive regarding public streets on this plat that will guarantee acceptable access. With the increased ADT from the new lots proposed in the adjacent Desert Point 2 project as well as existing ADT traffic from the south which enter the subdivision at the east end of Lakota Drive, cross section minimum widths for some portions of streets in the Cantera subdivision will need to be increased to show conformance to cross section DS Sec.3-01.10 figure 5 of this development standard.
3) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are approved. If a third party trust is proposed for the assurances for this project, provide the following:
a) Provide AMENDMENT TO TRUST / THIRD PARTY TRUST.
b) Provide AGREEMENT TO CONSTRUCT SUBDIVISION IMPROVEMENTS / THIRD PARTY TRUST.
c) If the final plat is approved before the grading plan, provide a list of assurable items, prepared by the engineer, for the AGREEMENT TO CONSTRUCT, which includes the fill to bring the lots out of the floodplain.
d) Provide copy of sample Warranty Deed.
e) For this and future projects, please provide two 8½" by 11" location map sheets for assurance submittals that go to Mayor & Council.
Assure that the descriptions of the common areas on the plat and in the descriptions in the Final Plat title block match the descriptions of the subdivision common areas in the assurance paperwork.
4) DS Sec.2-03.8.1.B, & 2-03.6.6: A final signed original copy of the CC&R's will eventually be needed for approval of the Final Plat. Submit a revised copy of the CC&R's assuring that it provides for:
a) Assure that the drainage maintenance verbiage from DS Sec.10-02.14.3.3 is added to the CC&R's as provided in Drainage Report.
b) Include any Drainage Report Maintenance checklist to the CC&R's.
c) In response letter include page number in the CC&R's where the maintenance verbiage is found.
5) DS Sec.2-03.6.4.F: Address the following floodplain comments:
a) Show the limits of the 100-year floodprone area in a surveyable and readily retraceable manner with frequent ties to intersecting lot lines for all flows of 100 cfs or more. Provide bearing and distances on all floodplain lines.
b) DS Sec.10-02.12.5: The offsite floodplain line adjacent to 12' easement on the southeastern side of the project is incorrectly depicted. The existing floodplain line remains in existing conditions until it connects with the easement. Revise the existing floodplain line.
c) DS Sec.2-03.6.2.E: If the final plat is approved before the grading plan, the proposed lots are subject to floodplain requirements; add the following general note: "Prior to issuance of any building permit, a Flood Plain Use Permit is required for Lots ____." (those lots partially or wholly located in the existing jurisdictional floodplain.
6) DS Sec.2-03.6.5.B: Address the following easement comments:
a) Submit a title report current within 30 days of going to Mayor & Council. Assure that any and all easements listed in the forthcoming title report are labeled with docket and page on the plat.
b) DS Sec.11-01.9: For any proposed offsite construction, maintenance, or other easements, notarized permission from adjacent property owner is necessary. Provide surveyable construction / maintenance easements with docket and page and labeled dimensions addressing Tentative Plat comments.
c) Width of the drainage easements that will be needed at the southeast side of the project has not been approved yet; the width of the easements shall reflect the approved Tentative Plat.
d) Provide crow's feet or other clarification for the location of the water easement along boundary of Blocks A&B.
7) DS Sec.2-03.6.1.K: Check General Note 5 verbiage per this section.
8) DS Sec.2-03.6.3.B.2.a: Under the second paragraph of the Dedication portion, assure that the verbiage is complete "(I/We) hereby dedicate and convey to the Public forever all rights-of-way as shown hereon, including all streets, roads, parks, easements, and drainageways."
9) DS Sec.2-03.6.1.D.2: Label major watercourse Earp Wash on location map.
10) DS Sec.2-03.6.3.C: Under Beneficiary, provide contact person's name.
11) DS Sec.2-03.6.3.D: It is recommended that under RECORDING DATA to provide more space for Seal.
12) DS Sec.2-03.6.5.C.5: Label / indicate for the distance and bearing between all monuments used as measured (M) or calculated (C) or recorded (R).
13) DS Sec.2-03.6.5.C.3: Provide copy of closure calculations.
14) DS Sec.2.4.K & 11-01.8: Please provide status of differential grading.

It is advised that the revised Tentative Plat be approved prior to submitting the revised Final Plat. For the revised Final Plat resubmittal it will be necessary to address all the above comments, submit the revised Final Plat, assurance package, and detailed response letter. 10/17/2005 FRODRIG2 COT NON-DSD REAL ESTATE Approv-Cond All requested materials are in and approved, the general note on the plat showing the vacation of right of way is perfect. The most important part of this transaction now is the timing of our item and the subdivision plat approval by the Mayor and Council. It is imperative that the Real Estate Division be keep informed as to the scheduled date for the plat approval. We will be scheduling the Atrim Loop right of way vacation for the same Mayor and Council agenda.
