The proposed sewer collection lines to serve the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.


A public Sewer Service Agreement for the proposed number of residential lots has been sent to your office. After three original Sewer Service Agreements have been signed by the Owner of Record, the three originals should be returned to Pima County Wastewater Management in order to satisfy the necessary requirements needed to approve the Mylars of the final plat.

Subject to the above, the Pima County Department of Environmental Quality and Wastewater Management Department hereby approve the above referenced submittal of the final plat. The required revision(s) may be shown on the Mylars.

Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. Prior to the construction of such features, a Construction Authorization (Approval To Construct) may need to be obtained from the Pima County Department of Environmental Quality.

Also, air quality activity permits must be secured by the developer or prime contractor from the Pima County Department of Environmental Quality before constructing, operating or engaging in an activity which may cause or contribute to air pollution.

SUMMARY: The copy of the Final Plat and CC&R's were submitted for review March 1, 2005. Development Services Department Engineering Division has reviewed the Final Plat and offers the following comments.

FINAL PLAT COMMENTS:
1) City of Tucson Development Standards (DS) Section No.2-03.6.4.A: On the Tentative Plat, the southeast corner of the project was called out as being dedicated to the City of Tucson per plat. Show spandrel and dedication information.
2) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are approved. Submit the following for other portions of the assurance package:
a) If a third party trust is proposed for the subdivision assurances, provide:
i) original copy of the AGREEMENT TO CONSTRUCT SUBDIVISION IMPROVEMENTS / THIRD PARTY TRUST;
ii) original copy of the AMENDMENT TO TRUST / THIRD PARTY TRUST;
iii) assure that all exhibits are attached, and the case number "S05-005" is at the top of the first page of the AGREEMENT TO CONSTRUCT and AMENDMENT TO TRUST;
iv) copy of the original Trust Agreement;
v) copy of a sample Warranty Deed;
vi) copy of the Title Report.
b) DS Sec.2-03.6.5.B: Address the following easement comments:
i) Label Bk/pg or Dkt/pg for the 10-foot public utility easement (Keynote 3 on sheet 2) that is to be abandoned.
ii) Assure that any/all easements listed on the Schedule B of title report are clearly drawn, labeled with Book/page or Docket/page, and/or listed as a blanket easement, and/or labeled with accurate dimensions and bearings on the plat. In response letter, please explain whether any easement items in Schedule B are not shown on the plat.
c) Assure that the descriptions of the common areas of the Final Plat title block match the CC&R's descriptions of the subdivision common areas and the descriptions in the assurance paperwork. Please be aware that the legal office may reject the assurance paperwork if the verbiage does not match exactly the verbiage on the Final Plat's Title Block.
d) For this and future projects, please provide a 8½" by 11" location map sheet for assurance submittals that go to Mayor & Council. Typically, these are similar to an enlarged location map on Final Plats.
3) DS Sec.10-02.14.3.2: Clarify CC&R submittal - this was in separate sheets. Provide an original bound copy of the signed CC&R's that applies to phase 3.
4) Address the following comments for sheet 1:
a) DS Sec.2-03.6.3.C: Under the BENEFICIARY block, revise block and include the sentence: "The beneficiary of (Title Company Name and Trust Number) is ..." Include contact person's name.
b) DS Sec.2-03.6.2.E: If subject to floodplain requirements, add the following note: "Prior to issuance of any building permit, a Flood Plain Use Permit is required for Lots ____."
c) DS Sec.2-03.6.3.D: It is recommended that under RECORDING DATA to provide more space for Seal.
d) DS Sec.2-03.6.1.D.2: On the location map, identify phase 1 and 2 recorded subdivisions, and reference these plats by book and page numbers.
5) Address the following comments for sheet 2:
a) DS Sec.2-03.6.4.D: Provide bearing along rear lot lines of lots 46 and 47.
b) DS Sec.2-03.6.4.B: Provide/label square footage for Common Area A.
c) DS Sec.2-03.6.4.H: The south Access Control Easement is illegible; clarify delineation. This easement should be considered to be renamed as a "no-vehicular access easement".
d) DS Sec.2-03.6.5.A: The corner of the phase 3 of the project needs to clarified for tie by course and distance to the section 9 corner.
e) DS Sec.2-03.6.5.C.4: All boundary monumentation must be described and labeled as "found" or "set."
6) DS Sec.2-03.7.1.B: The plat shall be sealed by registered surveyor and engineer on both sheets.
7) DS Sec.2-03.6.5.C.3: Provide boundary closure calculation sheet for phase 3 of the project.

For resubmittal, please submit a response letter, the assurance package items, signed copy of the phase 3 CC&R's, and the revised Final Plat. For further clarification, call me at 791-5550, extension 2204.
