SUMMARY: Development Services Department Engineering Division has reviewed the received items (revised Final Plat, CC&R's, revised assurance package, response letter, and copy of title report) and recommends conditional approval of the Final Plat.

FINAL PLAT COMMENTS:
1) On sheet 1, revise scale for Sheet Index map as this does not scale to 1" = 200' as labeled.
2) For clarification of common area dimensions along east boundary, provide crow's feet for clarification of dimensions for common area "C" on sheets 5 and 6.
3) DS Sec.10-02.14.3.2: Provide an original signed copy of the Covenants, Conditions, and Restrictions (CC&Rs) that is revised to include verbiage regarding basin and drainage maintenance. The CC&R's or Final Plat shall have a note stating (a) that the owner or owners shall be solely responsible for operation, maintenance, and liability for drainage structures and detention basins; (b) that the owner or owners shall have an Arizona Registered Professional Civil Engineer prepare a certified inspection report for the drainage and detention/retention facilities at least once each year, and that these regular inspection reports will be on file with the owner for review by City staff, upon written request; (c) that City staff may periodically inspect the drainage and detention/retention facilities to verify that scheduled and unscheduled maintenance activities are being performed adequately; and (d) that the owner or owners agree to reimburse the City for any and all costs associated with maintaining the drainage and detention/retention facilities, should the City find the owner or owners deficient in their obligation to adequately operate and maintain their facilities. Per Standards Manual for Drainage Design and Floodplain Management, the drainage area maintenance and responsibility verbiage from DS Sec.10-02.14.3.2.a-d (above) as well as DS Sec.10-02.14.3.3 must be included on the CC&R's, or placed on the Final Plat.
4) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are approved. In the AGREEMENT TO CONSTRUCT SUBDIVISION IMPROVEMENTS / THIRD PARTY TRUST, for Exhibit "C" Public Notice on page 10, update subdivision description to reflect exact verbiage in title block. Please be aware that the legal office may reject the assurance paperwork if the verbiage does not match exactly the verbiage on the Final Plat's Title Block.

The revised Final Plat will be required to be submitted addressing all comments. Submit revised Final Plat, revised assurance package, and a response letter. The following required changes to the final plat have been shown on a

* An additional 10' wide easement is required north of Lot 14 as
highlighted in orange.
* The recording information must be properly depicted on the plat
for the easement through Common Area "D" as highlighted in yellow. If
there is no existing easement a 16' wide easement must be granted by the
final plat for the existing overhead facilities.
* Delete the second word FOR from the third paragraph of the

The proposed final plat for the above-referenced project has been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.

Per the agreements made between the PCWMD and your client on June 14, 2005, all 8” public sewers designed and constructed with a slope of less than 0.44% will be subject to special facilities charges. The Sewer Service Agreement previously transmitted to your office did not reference this agreement, and the signed and notarized originals of this Agreement returned to this office could not be processed.

A revised Sewer Service Agreement containing such provisions has been prepared and will be transmitted to your office via e-mail. Three originals of the Sewer Service Agreement must be printed out for notarized signature by the owner of record, and returned to this office after they have been signed.

This office’s standard operating procedures require the three signed and notarized originals of the Sewer Service Agreement to be returned to this office, before issuing a final plat approval, but we will make an exception to this procedure in this case.

NO ADEQ/PDEQ SEWER SERVICE AGREEMENT FORM FOR THIS PROJECT MAY BE SIGNED TO OBTAIN PDEQ’S SUBDIVISION APPROVAL, OR SEWER CONSTRUCTION PERMITS ISSUED UNTIL THE THREE SIGNED AND NOTARIZED ORIGINALS OF THE SEWER SERVICE AGREEMENT ARE RETURNED TO THIS OFFICE.

PCWMD engineering staff have expressed a number of issues regarding the design of the proposed sewers for this project, and informed the Development Services Department that no construction permit for the off-site sewer lines may be issued, and the sewer improvement plans for the on-site sewers may not be approved, until after these issues have been resolved.

Please set up a meeting with PCWMD and PCDSD staff to resolve these matters. Mr. Tim Rowe, Acting Manager of the PCWMD’s Development Services Section, or Mr. Eric Wieduwilt, PCWMD’s Chief Engineer, may be contacted to set up such a meeting. 4. Subject to the above, the Pima County Departments of Environmental Quality and Wastewater Management Department hereby approve the above referenced submittal of the final plat.

Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. Prior to the construction of such features, a Construction Authorization (Approval To Construct) may need to be obtained from the Pima County Environmental Quality.

Also, air quality activity permits must be secured by the developer or prime contractor from the Pima County Department of Environmental Quality before constructing, operating or engaging in an activity which may cause or contribute to air pollution.

The above referenced project has been CONDITIONALLY APPROVED by the Community Design Review Committee. Please make any necessary corrections and submit the following documents:

(1) * Check in the amount of $8.50 per plat page for Mayor & Council distribution made payable to the local print company of your choice or provide an account number to charge.
(1) * Check in the amount of $55.00 per plat page for recorded plat distribution made payable to the local print company of your choice or provide an account number to charge.
(1) Check made payable to "Pima County Recorder" in the amount of $20.00 per plat page plus a $4.00 handling fee, along with CC&R fees if applicable. CC&R fees are $9.00 for the first 5 pages and $1.00 for each additional page.
(1) Executed and notarized CC&R's document (if applicable).

*Please do not combine the checks for the printing charges. They are processed at different times and require separate checks. An account number is also acceptable and you can include this information on your transmittal sheet when submitting the above listed items.

Assurances (if applicable) must be reviewed by the City Attorney's Office prior to being presented to the Mayor and Council. Plats, CC&R's and assurances must be approved at the same Mayor and Council Meeting. Please expect 7 - 8 weeks from the date submitted to the date scheduled for Mayor and Council approval.

PRIOR TO SUBMITTING THE FINAL PLAT MYLARS TO THE CDRC OFFICE, TEP AND PIMA COUNTY WASTEWATER MANAGEMENT MUST SEND THE CDRC MANAGER WRITTEN CORRESPONDENCE THAT THE CONDITIONS OF APPROVAL HAVE BEEN MET ON THE MYLAR.
