This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use. We will send to your office via e-mail, a .pdf file containing a Sewer Service Agreement for the proposed number of residential lots. Three originals will need to be printed out from this file for notarized signatures by the Owner of Record. The three signed originals of the Agreement must be returned to this office in order to satisfy the necessary requirements needed to approve the Mylars of the final plat. FINAL PLAT COMMENTS: 1) DS Sec.2-03.6.3.C: In the Beneficiary statement add contact name for company. 2) DS Sec.2-03.6.5.B: Assure that any/all easements listed on the Schedule B of title report are clearly drawn, labeled with Book/page or Docket/page, and/or listed as a blanket easement, and/or labeled with accurate dimensions and bearings on the plat. In response letter and on planview, please explain/show the following items: 3, 6, and 7 listed in the first amended Schedule B. 3) DS Sec.2-03.6.2.G: Remove Natural Vegetative Buffer from planviews. Typically, entities that are outside of the boundary of the plat are not to be drawn on a Final Plat as they are not part of the plat approval but rather supporting information for a Tentative Plat. The Vegetative Buffer may change in width per PIA review and thus should not be shown on planview. The variance with condition for the Natural Vegetative Buffer is noted on the cover sheet general note 9, so DS Sec.2-03.6.2.G is satisfied by the note. 4) DS Sec.2-03.6.4.C: Address the following common area comments: a) Provide exclusive common area(s) for the basins; these common areas shall be differentiated from other drainage improvements such as channels, and other common area elements. The basin shall be exclusive. Revise all planview sheets including the index map. b) Assure that the descriptions of the common areas of the Final Plat title block match the CC&R's descriptions of the subdivision common areas and the descriptions in the assurance paperwork. Please be aware that the legal office may reject the assurance paperwork if the verbiage does not match exactly the verbiage on the Final Plat's Title Block. This comment must be addressed for assurances approval. c) In General Note 1, update the common area descriptions to reflect the updated areas (common area(s) exclusive to basins). ASSURANCES COMMENTS: 5) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are approved. For the third party trust paperwork for the subdivision assurance, address the following remaining comments: a) In the AGREEMENT TO CONSTRUCT SUBDIVISION IMPROVEMENTS / THIRD PARTY TRUST, address the following: i) The assurable items list shall be corrected to include: (1) For item 8, "… all off-site and onsite improvements as shown on …" (2) Revise item 9, (per recent directive from the City Attorney) to read: "If any offsets against impact fees have been requested, all improvements that are the subject of the requested offsets shall be completed and accepted by the City prior to the final release of assurances. Assurances may be partially released prior to the completion of all improvements provided the releases are proportional to the level of completion of improvements." ii) For Exhibit "C" Public Notice on page 10, some of the common area verbiage is repeated; correct this page. iii) Update project description on the 2nd paragraph of the first page to reflect title block and/or revision for exclusive basin common area. iv) On page 8, update project description in Exhibit A to reflect title block and/or revision for exclusive basin common area. v) Also update Exhibit "C" on page 10 to reflect common area revision for exclusive basin common area. b) Regarding the original copy of the AMENDMENT TO TRUST / THIRD PARTY TRUST, address the following: i) Update project description on the 2nd paragraph of the first page to reflect title block and/or revision for exclusive basin common area. ii) Update project description in Exhibit A to reflect title block and/or revision for exclusive basin common area. c) DS Sec.2-03.6.5.C.3: Exhibit A of assurances has incorrect boundary data that does not match plat or boundary closure calculation. Revise 7th paragraph of Exhibit A for the "measured" arc distance of 2873.32 which should be 287.32 per plat and closure calculation. d) Pick up the original assurance package, revise and address comments, recompile, and then resubmit the revised assurance package, including the original revised Agreement to Construct, original revised Amendment to Trust, copy of Warranty deed sample, copy of original Trust, and title report. The revised Final Plat will be required to be submitted addressing all comments. Submit revised Final Plat, revised assurance package, and a response letter.
