| 09/13/2005 | JIM VOGELSBERG | ENGINEERING | REVIEW | Denied | DATE: September 16, 2005 TO: Patricia Gehlen; CDRC Coordinator SUBJECT: Bonillas Parkway Minor Subdivision Final Plat 2nd Submittal Engineering Review LOCATION: T15S R14E Section 7 REVIEWER: Jim Vogelsberg, E Eberbach ACTIVITY NUMBER: S04-148 SUMMARY: The assurance paperwork was submitted with the revised Minor Subdivision Final Plat, revised Drainage Report, Geotechnical Report, and response letters, and were received by Engineering on August 29, 2005. See separate letter for conditional approval of the Final Plat. Engineering has reviewed the received items and does not recommend approval of the assurances at this time until the following assurances comments are addressed: FINAL PLAT ASSURANCES COMMENTS: 1) City of Tucson Development Standards (DS) Section No.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are approved. Assurances must be approved by time of Final Plat mylar approval. See plat comments on separate comment letter. Address the following assurance package comments: a) For third party trust, provide a compiled package with the following: i) original copy of the AGREEMENT TO CONSTRUCT SUBDIVISION IMPROVEMENTS / THIRD PARTY TRUST; (1) Provide and attach Exhibit A property description as referenced on page 1. ii) original copy of the AMENDMENT TO TRUST / THIRD PARTY TRUST; (1) Provide and attach Exhibit A legal description. (2) Explain whether trust number 18108-T will be the trust number on the plat the dedication paragraphs. iii) Assure that all exhibits are correctly placed/attached, and the case number "S04-148" is at the top of the first page of the AGREEMENT TO CONSTRUCT, EXHIBIT B, and AMENDMENT TO TRUST at minimum; iv) Provide a copy of the original Trust Agreement; v) Provide a copy of a sample Warranty Deed; vi) Provide a copy of the Title Report. b) DS Sec.2-03.6.3.B.4: Provide a copy of the title report current within 30 days of recordation of the proposed plat. Assure that any/all easements listed in the title report have been accounted for in this last submittal. c) Before submitting the assurance paperwork, assure that the descriptions of the common areas of the Final Plat title block match the assurance paperwork descriptions of the subdivision common areas. Please be aware that the legal office may reject the assurance paperwork if the verbiage does not match exactly the verbiage on the Final Plat's Title Block. Check first pages of both the AGREEMENT TO CONSTRUCT and the AMENDMENT TO TRUST and make sure that the wording exactly matched the Title Block of the plat. d) For this and future projects, please provide a 8½" by 11" location map sheet for assurance submittals that go to Mayor & Council. Typically, these are similar to an enlarged location map on Final Plats. 2) DS Sec.10-02.14.3.2: Provide a signed original of the CC&R's. 3) The assurance package will be available at the CDRC Office for pick-up. Submit the complete revised complied assurance package. Submit revised assurances, other above listed documents, and detailed response letter with or before the Final Plat (mylar or bond).
