The subdivision CC&Rs and shall reference the maintenance standards in Sec. 3.7.6. The DSD Director may allow the recording of a public use easement with the subdivision plat in cases where the requirements of this section is the only reason for the creation of an HOA. However, the response letter indicates that an HOA will be formed. Identify, label and dimension the Common areas on the final plat, landscape plan and grading plan. LUC 3.7.2.4.A.1.c 2) Demonstrate compliance with LUC 3.7.2.4.A.4 along Elvira Road on the landscape plans. The unpaved right-of-way area is required to comply with the dust control provisions. LUC 3.7.2.4.A.4 states "Except as otherwise provided by this Division, the area between the right-of-way line and sidewalk and the area between the sidewalk and the curb, if not covered with vegetation, shall be covered with an appropriate inorganic ground cover, such as decomposed granite". 3) Basin slopes may not exceed 2: 1 for protected slopes for depths less than three feet. However structures, such as retaining walls, are acceptable for up to 35% of the basin perimeter. Revise the plans for the basins to comply.
