However the CC&Rs and Assurances can not be approved at this time. 1. The CC&Rs do not provide for adequate maintenance of the basins and landscape areas. The CC&Rs do not mandate the creation of a Homeowner Association and do not address the maintenance of the basins in the event that an HOA is not created. The Plat indicates that the basins and landscape areas will be maintained by the HOA. Revise the CC&Rs to provide for maintenance of the basins and landscape areas. 2. Revise the legal description in the CC&Rs to provide the correct name of the subdivision. 3. Revise Exhibit B of the Agreement to Construct to include the language requested by the City Attorney for all new Assurances Agreements: "All applicable fees, e.g. permit fees, impact fees must be paid in full to the City of Tucson prior to the final release of subdivision assurances." 4. Revise Exhibit B of the Agreement to Construct to include the following clause: Required off-site improvements as shown on the approved improvement plans and grading plans. 5. Include two copies of the Location Map on letter sized paper. The Location Map generally can be provided by the engineer. Provide a copy of the previously submitted grading plan which shows setbacks, street and basin cross sections and other details not shown on the final plat. It is not clear on the final plat that the minimum street width is provided to allow parking on both sides of the street. 2. Place a note on the plan regarding DSMR approval(s) and add the case number, date of approval, what the DSMR was approved for and any conditions imposed on the plat. At least one case (# DSMR 05-12, approved june 5, 2005 to allow for less than 150 feet for a jog in local alignments) has been previously approved for this project. DS 2-03.2.2.B.6 3. The CC&R's must address the formation of a homeowners association as being mandatory since there are maintenance and liablity issues for the retention/detention basin and drainage/landscape easement. Revise conditions 11 and 13 in the CC&R's accordingly. |

These previous comments still apply: 1. Demonstrate compliance with LUC 3.7.2.4.A.4 along Elvira Road on the landscape plans. The unpaved right-of-way area is required to comply with the dust control provisions. LUC 3.7.2.4.A.4 states "Except as otherwise provided by this Division, the area between the right-of-way line and sidewalk and the area between the sidewalk and the curb, if not covered with vegetation, shall be covered with an appropriate inorganic ground cover, such as decomposed granite". 2) Basin slopes may not exceed 2: 1 for protected slopes for depths less than three feet. However structures, such as retaining walls, are acceptable for up to 35% of the basin perimeter. Revise the plans for the basins to comply.
