However the CC&Rs and Assurances can not be approved at this time. 1. The CC&Rs do not provide for adequate maintenance of the basins and landscape areas. The CC&Rs do not mandate the creation of a Homeowner Association and do not address the maintenance of the basins in the event that an HOA is not created. The Plat indicates that the basins and landscape areas will be maintained by the HOA. Revise the CC&Rs to provide for maintenance of the basins and landscape areas. 2. Revise the legal description in the CC&Rs to provide the correct name of the subdivision. 3. Revise Exhibit B of the Agreement to Construct to include the language requested by the City Attorney for all new Assurances Agreements: "All applicable fees, e.g. permit fees, impact fees must be paid in full to the City of Tucson prior to the final release of subdivision assurances." 4. Revise Exhibit B of the Agreement to Construct to include the following clause: Required off-site improvements as shown on the approved improvement plans and grading plans. 5. Include two copies of the Location Map on letter sized paper. The Location Map generally can be provided by the engineer.
