LOCATION: T14S, R13E, Sec. 22

SUMMARY: The Final Plat mylar, and other documents were received by the CDRC office on August 9, 2005. Engineering Division does not recommend proceeding with the Final Plat mylar at this time.

FINAL PLAT MYLAR AND ASSURANCES COMMENTS:
1) City of Tucson Development Standards (DS) Section No.2-03.6.1.H.1 & DS 2-03.6.4.I: There still appears to be a discrepancies with the access to south offsite properties; this must be promptly resolved. If there is conflict in the location of the basin and the access easement, a revised location of the basin shall be provided. Show changes in the drainage design, including ponding depth and limits, in a revised Drainage Report. Once the basin location and revised Drainage Report is reviewed and is acceptable, the revised location of the detention/retention areas must be clearly identified on the plat, distinguishing them from the ingress/egress/utility/parking and drainage easement(s).
2) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are approved. Since there was no power of attorney submitted for each of the parcel owners, some of the documents need to be revised to show signatures for all parties. Pick up the assurance package from the CDRC office and address these assurance comments. Submit a completed revised compiled assurance package after revising the following:
a) All documents (Final Plat, Agreement to Construct, and Amendment to Trust) must include all parties affected by this platting. Address the following:
i) Provide clarification for as to why only one "beneficiary" appears on the Amendment to Trust, and as "subdivider" on the Agreement to Construct, when there appears to be more than one parcel owner for this project. Either provide all owners (beneficiaries or subdividers) or provide power of attorney from each for the beneficiary/subdivider listed on the Amendment to Trust/Agreement to Construct.
ii) The Title Report Special Report submitted indicates owners that do not appear on the plat; clarify whether any additional owner(s) are a part of the site area, or need to be added to the Final Plat, Agreement to Construct, and Amendment to Trust documents.
b) Correct the following for the third party trust assurances:
i) Provide an original copy of the AGREEMENT TO CONSTRUCT SUBDIVISION IMPROVEMENTS / THIRD PARTY TRUST which includes signature lines for each of the subdividers as listed on the mylar; revise pages 1 and 5.
ii) For the assurable items in the AGREEMENT TO CONSTRUCT SUBDIVISION IMPROVEMENTS / THIRD PARTY TRUST, clarify whether the ingress/egress easement to be paved is the proposed easement and/or the existing easement along the south boundary.
iii) Provide an original copy of the AMENDMENT TO TRUST / THIRD PARTY TRUST which is signed by all beneficiaries of the trust; there is only one subdivider listed on the cover and page 2.
iv) add the case number "S04-089" is at the top of the first page of the AMENDMENT TO TRUST;
v) resubmit the copy of the original Trust Agreement with the newly compiled assurance package;
vi) resubmit the copy of a sample Warranty Deed with the re-compiled assurance package;
vii) resubmit the copy of the Title Report with the re-compiled assurance package.
c) Provide a 8½" by 11" location map sheet for assurance submittals that go to Mayor & Council. Typically, these are similar to an enlarged location map on Final Plats.
d) Provide signed original financial assurances as described above.
e) Provide originals for the consents to dedicate.
3) DS Sec.10-02.14.3.2: Provide a signed original copy of the CC&R's.
a) The CC&R's shall be signed by all parties or provide a letter of authority that states that one person is the declarant.
b) Add CDRC case number S04-089 to the cover sheet.
c) CC&R's shall be notarized.
4) DS Sec.2-03.8.1.B: Submit original documents with appropriate signatures affixed since they will require recordation in conjunction with the plat.
5) DS Sec.2-03.6.5: Address the following boundary data / survey comments:
a) Clarify whether the distance / bearing data for the tie measurements are measured (M) or calculated (C) or recorded (R).
b) Provide crow's feet for "48.00", and 48.78" at right side of the plan.
6) DS Sec.2-03.6.5.B: Address the following easement comments:
a) The east portion of the sewer / access easement shows as to be abandoned. This is in conflict with access to south bounding parcel(s). Explain thoroughly in response letter how this conflict will be ameliorated.
b) Label Bk/pg or Dkt/pg for any portion of the ingress/egress easement that is abandoned.
c) In response letter, explain whether any easement items in the title report are not shown on the plat. Specifically, explain location of the communication line easement Bk76 pg84, as referenced in Title Report Schedule B item 5.
d) Assure that easements are labeled with accurate dimensions and bearings on the plat; in response letter, please explain why/whether the south ingress/egress easement has been revised on the plat.
7) For the subsequent revised grading plan, the following entities will need clarification or revision: water surface elevation for the basin / drainage areas, a typical lot grading detail, existing contours, slope information for the basin / drainage area, cross sections at north, east and south boundaries, basin dimensions, and outlet weir cross-sections. A revised grading plan may need to be submitted for review. One copy of the grading plan will be needed for the review of this revised drainage report.

For resubmittal, please submit a complete response letter, two copies of the revised drainage report, one copy of the revised grading plan for reference, the complete revised and re-compiled assurance package, signed original copy of the CC&R's, and the revised Final Plat mylar. SUMMARY: The Final Plat mylar, and other documents were received by the CDRC office on August 9, 2005. Additional documentation (including revised copies of the Final Plat and basin routing) was submitted by Delph Engineering on 23AUG05. Engineering Division does not recommend proceeding with the Final Plat mylar at this time. The following comments are given to provide further clarification of the remaining discrepancies that need to be addressed in order to further process the package for Mayor and Council scheduling.

Once the basin location and revised Drainage Report is reviewed and is acceptable, the revised location of the detention/retention areas must be clearly identified on the plat, distinguishing them from the ingress/egress/utility/parking and drainage easement(s). Also, to clarify ingress egress to existing Conner parcel, provide a letter from this affected property owner (and any other affected parcel owner) providing authorization to abandon the ingress/egress easement at their lot. Otherwise provide a copy of the dkt/pg for this ingress/egress easement highlighting the section where it does not require a mutual agreement to dissolve the easement.
