for review May 16, 2005. This Company is unable to approve the plat at this
time.

An electrical design to determine our easement requirements will be provided
on the Approved Tentative Plat with fifteen (15) working days upon receipt
of the plat. Additional plans necessary for preparation of the design are:
building plans including water, electrical, landscape, sidewalk and paving
plans. Also, submit the AutoCAD version of the plat on a CD or email to

The proposed sewer collection lines to serve the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.


A public Sewer Service Agreement for the proposed number of residential lots has been sent to your office. After three original Sewer Service Agreements have been signed by the Owner of Record, the three originals should be returned to Pima County Wastewater Management in order to satisfy the necessary requirements needed to approve the Mylars of the final plat.

Subject to the above, the Pima County Department of Environmental Quality and Wastewater Management Department hereby approve the above referenced submittal of the final plat.

Please note the following: Approval of the above referenced submittal does not authorize the construction of public or private sewer collection lines, or water distribution lines. Prior to the construction of such features, a Construction Authorization (Approval To Construct) may need to be obtained from the Pima County Department of Environmental Quality.

Also, air quality activity permits must be secured by the developer or prime contractor from the Pima County Department of Environmental Quality before constructing, operating or engaging in an activity which may cause or contribute to air pollution.

SUBJECT: Engineering review of the Encanto Village Final Plat. The activity number is S04-086.

SUMMARY: The Final Plat, the CC&Rs and the Assurance package were received by Engineering on May 18th, 2005. Engineering has reviewed the received items and does not recommend approval of the Final Plat, CC&Rs or the Assurance Package.

RESUBMITTAL REQUIRED: FINAL PLAT, CC&Rs ASSURANCES

SUBMITTAL REQUIRED: BOUNDARY CLOSURE CALCS

The next submittal must address the following items:

GENERAL COMMENTS

1. The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are approved. The complete assurances package must include a copy of the original trust, the original amendment to trust with exhibit A, the original agreement to construct with exhibit B, a copy of the warranty deed, a current title report and a location map on an 8 ½ x 11 sheet. DS Sec.2-03.7.1.G

The Final Plat will not be approved until the Assurance Package is received and approved.

CC&Rs COMMENTS

1. Submit revised copies of the CC & R's that specifically address the maintenance of the drainage facilities. Add language in the text, which addresses the maintenance of the drainage structures in detail (i.e. what facilities to be inspected and maintained, how, when, by whom, the retention basin maintenance list, record keeping and repair decisions, etc). Please be advised that this Office recommends including the Retention maintenance checklist in the CC & R's to allow the Home Owners Association access to it and facilitate their maintenance responsibilities. SMDDFM 14.03.2.

ASSURANCE COMMENTS

1. Typically an exhibit "legal description" is in the original trust agreement and a legal description was not provided. Include a legal description in the original trust agreement.

2. Include the activity number of the subdivision at the top of the page on the "Amendment to Trust" and the "Agreement to Construct" documents (first page).

3. Whenever a reference is made to the title of the subdivision in the Assurances Package the title must match the verbiage in the tile block of the plat. The Common Areas "A" and "B" must be included in section 1 of the "Amendment to Trust" and section A of the "Agreement to Construct" (page 1 of both documents).


FINAL PLAT

1. All lettering and dimensions will be the equivalent of twelve (0.12) point or greater in size. The purpose of this requirement is to assure that all lettering is legible when reproduced or when photographically reduced (microfilmed) for recordkeeping purposes. The font size on sheet 2 is under 12 point. Revise all lettering to be at least 12 point. DS 2-03.6.1.C.

2. Once the final plat is approved ensure that when the mylar is submitted the surveyor seal and signature is included under the Certification of Survey. DS 2-03.6.3.A.

3. Include the appropriate dedication notation for 4th Street (Book and page). DS 2-03.6.4.A.

4. Include the square footage for Common Area "A." DS 2-03.6.4.B.

5. At least one (1) corner of the subdivision will be tied by course and distance to a section corner or a quarter section corner. Provide the corner tie recordation information on the plat. DS 2-03.6.5.A.

6. Indicate on the plat whether all bearings and distances are calculated or measured. DS 2-03.6.5.C.5.
