The revised Final Plat is acceptable and it is recommended for approval subject to revising the assurances and the CC & R's as required below: Assurances: 1. Provide the Subdivision Case Number. 2. The project name should match exactly the name in Final Plat Title Block including the common area descriptions (i.e. on the original Third Party Trust agreement and the Amendment". 3. Include 2 copies of Exhibit "A" to the original agreement and the amendment. Exhibit "A" describes the project exactly as it is shown in Final Plat Title Block. 4. Remove the street names from item 1 of Exhibit "B". Leaving the street names out allows the description in item 1 to include all the streets without the concern of missing a street or misspelling a street name. 5. Exhibit "B" should include the correct S04-XXXX number. 6. Check to see if there is a "Special Warranty Deed" document that should be included in the Assurances. 7. Include a recent Title Report with the Assurances documents. 8. Include a copy of the Trust Agreement Document. The Document will not be recorded with the Final Plat, but it is needed to be included in the assurance package. CC & R's: · Submit revised copies of the CC & R's that specifically address the maintenance of the drainage facilities. Add language in the text, which addresses the maintenance of the drainage structures in details (i.e. what facilities to be inspected and maintained, how, when, by whom, the detention/retention basin maintenance list, keeping records, and repair decisions, etc). Additionally, reference Exhibit "A" in the text. Prepare a detailed response that explains the revisions that were made and references the exact location in the CC & R's where the revisions were made.
