SUMMARY: The revised Final Plat, CC&R's, easement documentation, response letter, and the assurance package were received by Engineering on October 7, 17, and 21, 2005. Engineering has reviewed the received items and does not recommend approval of the Final Plat at this time. As stated in prior comment letters, the biggest engineering issue at this time for this plat is the remaining easement information; unless this issue is addressed promptly, the plat may not proceed to Mayor and Council.

FINAL PLAT COMMENTS:
1) City of Tucson Development Standards (DS) Section No.7-01.4, DS Sec.2-03.6.4.A, and DS Sec.2-03.2.3.C: There was a recorded easement release docket 12663 page 1110 submitted with the abandonment documents for the 30-ft Public Utility Easement and Sewer Easement. Letters from the utilities for the 20-ft Sewer Easement were also provided. Specifically address the following remaining easement comments. Clearly draw the following easements as listed in the recent title report schedule, or provide Book/page or Docket/page of abandonment information:
a) (Schedule B, Section 1, item 4) Remaining easements as shown on Bk56 pg45 and Bk57 pg40 which includes:
i) the existing 20-ft Sewer Easement Bk5524 pg501; provide dkt/pg for recorded abandonment;
ii) In this submittal, there was an abandonment of easement document (docket 12631 page 2431) that releases only the 20-ft sewer easement portion of Dkt5524 pg501. Explain whether the 50-ft ingress/egress easement described also in Dkt5524 pg501 has previously been released by Citizen Auto Stage Co. Provide a copy of this quitclaim documentation.
iii) the existing 10-ft Electric Easement Bk930 pg523; state whether this has been relocated or provide abandonment documents.
b) (Sch.B, Sec.1, items 7, 8, 8-1, 10, 10-1, 11, and 11-1) Gas, electric light and power easements as shown on Bk60 pgs237 and 238, Bk84 pg351, Dkt1045 pg380, Dkt1858 pg493, Dkt1894 pg265, and Dk1944 pg12.
c) (Sch.B, Sec.1, item 14) Phone easement Dkt8187 pg1870.
d) (Sch.B, Sec.1, item 16) Explain how/whether this item affects the property's platting.
2) DS Sec.2-03.6.5.C.5: Address the following boundary data / survey comments:
a) DS Sec.2-03.6.5.C.3: In response letter, the closure sheet was to be provided under separate cover, yet none was found; provide closure sheet for project boundary.
b) Provide full line survey data for the private utility easements at intersections (hatched areas).
2) DS Sec.2-03.6.1.L: There are still some boundary corners that need clarification; all boundary lines and curves need monument symbols on plan view sheets (see west boundary of sheet 3 and northwest boundary of sheet 4). The symbol shown in the legend on sheet 3 appears to be too small and not legible against the boundary linetype. Identify/clarify monuments as existing or proposed to be set by RLS.
3) DS Sec.2-03.6.6: It was stated in the response letter that a separate response for the CC&R's were to be submitted separately however the revised CC&R's were submitted without a response to these three comments. From page 14 of the CC&R's, the drainage area is mentioned for annual inspection, however other portions of this section were not addressed. Address the following remaining CC&R comments:
a) Per Standards Manual for Drainage Design and Floodplain Management section 14.3.2, the drainage area maintenance and responsibility verbiage from DS Sec.10-02.14.3.3 must be included on the CC&R's, or placed on the Final Plat.
b) DS Sec.10-02.14.3.2: The Covenants, Conditions, and Restrictions (CC&Rs), Final Plats, or Development Plans shall have note(s) stating:
i) that the owner or owners shall have an Arizona Registered Professional Civil Engineer prepare a certified inspection report for the drainage facilities at least once each year, and that these regular inspection reports will be on file with the owner for review by City staff, upon written request;
ii) that City staff may periodically inspect the drainage and detention/retention facilities to verify that scheduled and unscheduled maintenance activities are being performed adequately; and
iii) that the owner or owners agree to reimburse the City for any and all costs associated with maintaining the drainage and detention/retention facilities, should the City find the owner or owners deficient in their obligation to adequately operate and maintain their facilities
c) Also, the CC&R's shall provide the list of maintenance recommendations for the drainage areas as outlined in the Drainage Report or as provided by the engineer and accepted by the City of Tucson DSD Engineer.
4) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are approved. It will be necessary to pick up the assurances at the CDRC office, make corrections, and return the one set of the full compiled package to CDRC office. Provide revised compiled assurance package that addresses the following remaining assurance package comment regarding the AGREEMENT TO CONSTRUCT SUBDIVISION IMPROVEMENTS / THIRD PARTY TRUST. Revise the following items in the list of assurable items:
i) On Exhibit "B" assurable item #8 usually reads offsite improvements since the onsite improvements are covered by prior listed items. If there are no offsite improvements, #8 can be deleted.
ii) On Exhibit "B" assurable item #9 can also be deleted if it is not specifically related to an assurable item something like a roadway or drainage grading improvement not included in the grading plan.
iii) On Exhibit "B" assurable item #10 is not an assurable item unless they had to construct something specific like a methane extraction system. Clarify or remove.

Submit revised Final Plat, additional abandoned easement and/or quitclaim paperwork, original signed copy of the CC&R's, one set of the revised complete original assurance package, and complete response letter that addresses each easement comment above.
