As indicated on the previous (1st submittal), a request to review the tentative plat at this time cannot be completed. Prior to review of this tentative plat by staff, the Menlo Park Mercado District PAD-10 submittal, which is currently in process, has to be accepted. At this time the PAD has yet to be accepted and the review completed. Once the PAD document is accepted any review prepared for CDRC review, using the PAD document, comments may run the risk of being incomplete until actual approval by Mayor and Council of the PAD. A first review cannot be accomplished without an accepted PAD criteria with which to review the tentative plat. Most, if not all comments made on the PAD review are probably the same comments that would be made for the tentative plat. Again, be assured that this department will provide a review in a timely manner on this tentative plat submittal, once the Menlo Park Mercado district PAD-10 has been accepted.

SUMMARY: The revised Tentative Plat, revised Landscape Plan, and revised Drainage Report were received by Engineering on July 21, 2004. Engineering has reviewed the received items and does not recommend approval of the Tentative Plat. The Drainage Report was reviewed for PAD and Tentative Plat purposes only.

DRAINAGE REPORT COMMENTS:
1) Tucson Code Sec.29.22.D & 23.A.5: For Tentative Plat approval, it is necessary to provide certification that the landfill to the south will not adversely effect neighboring property. Per this section of code, the developer of the property which is within 1,000 feet of a designated landfill may file with the director of development services center a certified statement that, after full and appropriate investigation and analysis, the designated landfill does not currently, nor can reasonably be expected in the future to, pose a health or safety risk to development of the property as a consequence of the generation and/or migration of methane gas or any other potentially dangerous substances from the designated landfill. The certified statement shall be signed by a professional who is licensed by the Arizona Board of Technical Registration and who is knowledgeable regarding landfills, methane gas and related health and safety issues. The certified statement may not be accepted for any property which is on or above a designated landfill. Reasons for constructing the storm drain easement to the north of the platted easement (Bk57 pg40) should be discussed in the landfill report / certification documents. TENTATIVE PLAT COMMENTS:
2) City of Tucson Development Standards (DS) Section No.2-03.3.1.J: Per the PAD, it is stated that surface and underground parking beneath each block of the Town Center is proposed. Underground parking may be restricted if not constructed prior to construction of adjacent areas of the non-residential areas; explain intent.
3) DS Sec.2-03.2.4.J: Show and explain how the proposed pedestals near the utility niches shall not interfere in the 24 feet of travel lanes in alley areas.
4) DS Sec.10-01.III.3.5.1.3.a & Sec.2-03.2.4.K, Sec.10-02.14.2.6, Sec.2-05.2.4.I: A geotechnical assessment shall address the following remaining items:
a) Explain how project design for proposed building layout meets recommendations for the setback distance for proposed foundations from hydro-collapsing soils encountered.
b) Provide status of methane gas monitoring for landfill at south of the project as well as any percolation results and infiltration test location map.
5) DS Sec.2-03.2.3.I: Regarding extents of the landfill boundaries at the south side of the project, it was stated in the recent response letter that a Terracon report is being prepared to verify landfill boundary; submit this document. This document should be a part of the assessment of the landfill per comment below.
6) DS Sec.2-03.2.4.L.4: Provide further clarification for proposed grades and ground elevations for reference to future grading and site drainage. Along newly proposed portion of Landers Drive and Clearwater Drive, provide existing and proposed spot elevations to indicate proposed drainage design.
7) DS Sec.2-03.2.3.A: DS Sec.2-03.2.3.A: Complete tie for to property boundary from section 14. Also, some monuments are shown in Bk57 pg40 which are not shown on this plat; all monuments found or set will be described on plan view.
8) DS Sec.6-01.4.1.I & 3.2.A: There still remains a concern that convenient and accessible trash pick-up is not being provided for this project. The PAD indicates that the occupants of the units ("and / or" hired maintenance staff) will be bringing the trash to the south solid waste pick-up area. This appears to create a hardship for the future occupants; clarify Tentative Plat.
9) DS Sec.3-01.5.1.A.2: The Proposed parking stalls and building layout still appear to restrict the sight visibility. However, email correspondence from Transportation indicates acceptance of 12-foot stem side for this project.
10) DS Sec.2-03.2.3.D & 2.4.M: In order to clarify intent of and access in private alleys, provide scaling for detail 8 on sheet 5. The 3-foot setbacks only at garage openings may not give sufficient maneuverability for vehicles entering garages. Full 24 feet of clearance needs to be provided, or show that there is no encroachment in the travel area of the alley by depicting maneuverability with turn radii on plan views for typical vehicle.
11) DS Sec.2-03.2.3.G: The 30' public storm drainage easement along the south portion of the project is encroaching on some of the proposed southern lots. Provide dimensions at least on lots 83-84 from lot property line to north line of easement.
12) Provide layout with dimensions for any changes, including the area near lots 100-106.

Eventually a final approved PAD will need to be provided for final review of the Tentative Plat. The next submittal should address all the above items. Submit response letter, revised Tentative Plat, a copy of the approved PAD, and a bound copy of additional geotechnical assessment. COMMENTS

1. Section 4.1.7.1, LUC, permits a maximum of one year from the date of application to obtain approval of a tentative plat. If, at the end of that time, the tentative plat has not been approved, it must be revised to be in compliance with all regulations in effect at that time, and must be resubmitted for a full CDRC review. The one-year expiration date for this tentative plat is May 10, 2005.

2. Zoning cannot continue review of this plan until Mayor and Council has approved the PAD document.

3. Zoning has met with Gayle Marsland regarding issues that were still pending prior to submittal of the current tentative plat. The changes were to be made in the PAD document and incorporated on the tentative plat where applicable.

Without the approved PAD document it is not possible to review the tentative plat and insure that the drawing has been designed based on the final approval of the document.

4. Also, it has been brought to my attention that the tentative plat has changed some what as a result of comments by the Police Department related to the six foot wide common areas for pedestrian use and a proposal to construct condos on the southwest portion of the site. It is obvious that the changes are still being made to the plan. I understand that this project is still a work in progress and that changes will be made but it is not fair for the reviewers to have to review a plan that does not have an adopted PAD document and is changing during reviews.

I believe that prior to re-submittal of a future tentative plat, that a meeting be held with staff (reviewers and section heads) to iron out any pending issues or discuss necessary changes to the plat and the PAD document.

The proposed sewer collection lines to serve the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.


PCWMD Operations staff reviewed the revised tentative plat in coordination with this office, and PCWMD Operations still has concerns about being able to access several of the proposed public sewer lines in the narrow alleys of this subdivision. Please see the attached e-mail address from Eric Wieduwilt of PCWMD Operations.

This office recommends that we meet regarding what sewers may need to be private, and which may be public, after Operations has conducted their access tests in similar alleys.

3. Until the vehicular access issues are resolved, this office will be unable to approve this tentative plat.

Tim,

Per our earlier meeting, Wastewater is still concerned with the vehicular
access in the narrow alleys of this development using the combination
cleaning truck.

Our concerns are: 1) Turning into the alley from the street -
The turn from the street into the alley will require the full 18
feet in the alley public right-of-way, and will also require 20 feet of
vertical clearance (suction boom above vehicle). Due to this tight entry
turn, the vehicles will not be allowed to back-up.

2) Access through the alley -
Each alley should allow for a drive-through (entrance and exit are a
straight shot through), and that access should be as straight as
possible (no turn greater than 30 degrees without a widened alley). Any
obstructions in the alley (garbage cans, power poles, pedestals, etc.) will
further restrict the access.

Based on these access concerns, Wastewater will not accept the sewers that
extend more that one reach into the alley, which do not have linear access
through the alley to an exit, or an adequate turning area to navigate turns
greater than 30 degrees.

The allowance for a single reach into the alley is based on our maintenance
method, which primarily requires access to the downstream manhole, and
therefore a low probability that access will be needed at the terminal
manhole.

The one caveat on this decision is that we hope to coordinate with our
maintenance staff, an access evaluation in similar alleys to better define
our access limitations. We hope to complete these tests this week. The
developer therefore has the option to wait for our test results, which may
allow more variance to the above concerns.

I will let you know what the results are when we are complete.
