Tucson Electric Power Company (TEP) has reviewed the tentative plat dated May 6, 2004. This Company is unable to approve the plat at this time. There are existing electrical facilities within the boundaries of the development. The facilities along with the easement recording information must be shown on the plat prior to approval.

A copy of a TEP facilities map showing the approximate location of the existing facilities is enclosed. All relocation costs will be billable to the developer.

TEP will provide a preliminary electrical design on the Approved Tentative Plat within fifteen (15) working days upon receipt of the plat. TEP's approval of the tentative plat is necessary if you request a preliminary electrical design prior to the signed Approved Tentative Plat. Additional plans necessary for preparation of the design are: building plans including water, electrical, sidewalk and paving.

The proposed sewer collection lines to serve the above-referenced project have been reviewed on behalf of the Pima County Department of Environmental Quality (PDEQ) and the Pima County Wastewater Management Department (PCWMD). This review letter may contain comments pertaining to the concerns of either Department. The following comments are offered for your use.


This project will be tributary to the Roger Road Wastewater Treatment Facility via the Northwest Outfall. Obtain a letter from the PCWMD Planning Services, written within the past 90 days, stating that treatment and conveyance system capacity for the project is available, and provide a copy of that letter to this office. PCWWM Planning Services may be contacted regarding this matter at 520-740-6500.
The tentative plat for this project cannot be approved until a copy of this letter has been received by this office.

Based on our records for Rio Nuevo, Blocks 1-15 and Common Areas A-C under subdivision plat case number, S02-003, the bulk of this project would qualify for the Non-Participating sewer connection fee rate. However, more must be known about how the southern portion of the project will be sewered.

All Sheets: Add the tentative plat case number, S04-053, to the title block of each sheet. This number should be shown larger or bolder than any cross reference numbers. No wastewater review fees will be charged for sheets where this is the only required revision.

All Sheets: Add cross reference number, S02-003, to the title block of each sheet.

Sheet 1: Combine General Notes 10 and 13 into a single general note that states:

THE ON-SITE SANITARY SEWAGE COLLECTION LINES WILL BE PUBLIC AND DESIGNED AND CONSTRUCTED TO PIMA COUNTY WASTEWATER MANAGEMENT DEPARTMENT STANDARDS AND MUST BE ACCEPTED AND RELEASED FOR SERVICE BY THE PIMA COUNTY WASTEWATER MANAGEMENT DEPARTMENT PRIOR TO THE ISSUANCE OF SEWER CONNECTION PERMITS.

Sheet 2: Show the plan number for the existing public sewer line in the Congress Street right of way.

Sheets 2-6: The alleys must be a minimum of 20' if they are to be utilized as public sewer and utility easements.

Sheets 2-5: Show the sewer design data, on the sheets where the sewer lines have been shown.

Sheet 4: Show the size and the plan number of the existing public sewer to which you are proposing to connect. Also show the manhole number of the existing public sewer manhole to which you are proposing to connect.

Note: The Pima County Wastewater Management Department's section and base maps do not show any existing public sewer lines in this area.

We will require a revised set of bluelines, and a response letter, addressing these comments. Additional comments may be made during the review of these documents.

County Ordinance 2003-29 went into effect on April 11, 2003. This ordinance requires that a wastewater review fee be paid for each submittal of the tentative plat. The fee for the first submittal is $166 plus $50 per sheet. For the second submittal, the review fee is $50 per sheet. For all subsequent submittals, the review fee is $39 per sheet.

The next submittal of this project will be the second (2nd) submittal. A check for the review fee of this submittal in the amount of $250.00 (made out to PIMA COUNTY TREASURER ) must accompany the revised set of bluelines and response letter.

If the number of sheets changes, please adjust the review fee accordingly.

SUMMARY: The Tentative Plat, PAD Report, Landscape Plan, Site Analysis, Drainage Report, and title report paperwork were received by Engineering on December 29, 2003. Engineering has reviewed the received items and does not recommend approval of the Tentative Plat or the Drainage Report at this time. The Drainage Report was reviewed for PAD and Tentative Plat purposes only.

DRAINAGE REPORT COMMENTS:
1) City of Tucson Development Standards (DS) Section No. 2-03.2.4.L.1: Discuss and provide data in drainage report for the potential for ponding at water harvest areas and stormdrain inlets. Show locations on drainage exhibit.
2) DS Sec.2-03.2.4: On drainage exhibit, provide more general spot elevations in areas of Plazas, commercial pads, project perimeter areas, and storm drains to indicate flow for proposed drainage in these areas. Provide size, type, and invert elevations for stormdrain pipe.
3) DS Sec.10-01.III.3.5.1.3.a: Discuss in Drainage Report areas of Water Harvesting.
4) DS Sec.3-01.4.4.D: Provide assessment for all weather access. Include cross sections and spot elevations for streets showing depths (not to exceed 1-foot deep), velocities, and flow rates.
5) Tucson Code Sec.29.22.D: For Tentative Plat approval, it is necessary to provide certification that the landfill to the south will not adversely effect neighboring property. Per this section of code, the developer of the property which is within 1,000 feet of a designated landfill may file with the director of development services center a certified statement that, after full and appropriate investigation and analysis, the designated landfill does not currently, nor can reasonably be expected in the future to, pose a health or safety risk to development of the property as a consequence of the generation and/or migration of methane gas or any other potentially dangerous substances from the designated landfill. The certified statement shall be signed by a professional who is licensed by the Arizona Board of Technical Registration and who is knowledgeable regarding landfills, methane gas and related health and safety issues. The certified statement may not be accepted for any property which is on or above a designated landfill.

TENTATIVE PLAT COMMENTS:
6) City of Tucson Development Standards (DS) Section No. 2-03.2.1.G.3: Provide brief legal description and a statement as to whether the project is a resubdivision. Provide the recording information of the existing subdivision plat for resubdivisions. Explain how blocks 3, 8, and 10 of the Amended Final Plat for Rio Nuevo meet General Note 7 on Bk57 pg40.
7) DS Sec.2-03.2.1.F: Since the project is located within the boundaries of Rio Nuevo Planned Area Development (PAD) zone, include a reduced-scale map of the entire PAD District on the first sheet and indicate the location of the portion being developed.
8) DS Sec.2-03.3.1.J: Address the following PAD comments:
a) Per the PAD, it is stated that surface and underground parking beneath each block of the Town Center is proposed. Show in the Tentative Plat how and where this is provided.
b) It is stated on page 11 of the PAD Report that parking will be provided on both sides of the streets for the residential portion of the site. Revise section detail 7 for Street "A" to comply with PAD and development standards.
9) DS Sec.2-03.2.4.J: For detail on page 41 of the PAD Report, clarify whether the utility companies have accepted close proximity of proposed utility pedestal locations for the proposed utility niches.
10) DS Sec.10-01.III.3.5.1.3.a & Sec.2-03.2.4.K, Sec.10-02.14.2.6, Sec.2-05.2.4.I: Sheet 1 states that the Soils Report was submitted with this submittal per general note 29. It does not appear to be in the Attachment to the Menlo Park Mercado District PAD Report Item 8 of the Site Analysis. Please submit a separate bound report of the geotechnical evaluation for this project. The geotechnical report shall address the following items:
a) existing geotechnical conditions
b) suitability of the soils for this project
c) assessment of gravel/borrow pit or any other manmade soil conditions onsite
d) proposed recommendations for foundations and pavement design
e) recommendations for proposed slope grades
f) setback distance from proposed building foundations to edge of drainageways
g) specifically address all criteria listed in section DS Sec.10-02.14.2.6. See last sentence of this section for items 6 (c) & (d) regarding hydro-collapsing soils and 30-foot test boring for basin design
h) boring data
i) status of methane gas monitoring for landfill at south of the project as well as any percolation results and infiltration test location map
j) any other typical geotechnical recommendations used to review the Tentative Plat
11) DS Sec.2-03.2.3.I: Indicate the existing conditions on site and within 100 feet of the site. Conditions on adjacent land significantly affecting the design of the subdivision will be shown. Show extents of the landfill boundaries at the south side of the project on plan view on sheet 4.
12) DS Sec.2-03.2.4.L.4: Provide further clarification for proposed grades and ground elevations for reference to future grading and site drainage:
a) Clarify discrepancy in high point spot elevation and manhole #2 rim elevation on sheet 2.
b) Manholes and concentration points have similar keynote types. Clarify differences between manhole callouts and storm drain inlet locations on sheets 2 and 3 of the Tentative Plat. Clarify drainage direction at manhole #3. Provide details for the storm drain inlets with spot elevations on plan view.
c) On sheets 2, 3, and 4 provide more spot elevations in areas of Plazas to indicate flow for proposed drainage in these areas.
d) At west end of Landers Drive provide existing and proposed spot elevations to indicate proposed drainage design at this location.
e) Provide proposed spot elevations to indicate proposed drainage design along Avenida Del Convento.
f) Provide finished pad elevations for commercial pads.
g) Provide other typical grading details to show minimum grades away from structures to accommodate flow around buildings.
13) DS Sec.2-03.2.4.L.1: On sheets 2 and 3, show 100-year ponding limits on planview.
14) DS Sec.2-03.2.4.L.6: The 100-year flood limits with water surface elevations for all flows of 100 cfs or more will be drawn on the plat.
15) DS Sec.2-03.2.1.C: Increase font size descriptions in the Title Block.
16) DS Sec.2-03.2.2.B.7: Reference any of the following special overlay zones that are applicable, and add a note stating that the plat is designed to meet the overlay zone(s) criteria. LUC Sec. 2.8.3, Major Streets and Routes (MS&R) Setback Zone.
17) DS Sec.2-03.2.3.D: The following information regarding the existing public right-of-way for Grande Avenue and Congress Street will be provided: the names, MS&R right-of-way widths, recordation data, type and dimensioned widths of paving, curbs, curb cuts, and sidewalks. Revise sheets 2 and 4.
18) DS Sec.2-03.2.4.C: There are common areas used for proposed alleys, sewer easement, plazas and existing storm drain easement. Clarify common area description information in title block to clarify use of the Common Areas. Assurance paperwork will need to match common area descriptions on the plat. At a minimum, this will need to be done at Final Plat submittal.
19) DS Sec.2-03.2.3.F: Label and identify the basis of elevation as described in General Note 7 on a plan view.

21) DS Sec.2-03.2.3.A: DS Sec.2-03.2.3.A: Provide dimensions and bearings for tie to property boundary from section 14. All monuments found or set will be described.
22) DS Sec.2-03.2.4.F: The proposed streets do not meet Development Standards for typical cross section and horizontal geometry. Address the following comments for the proposed street alignments "A", "D", "B", "C":
a) horizontal geometry at intersections and street curves should meet minimum curb return radii per DS Sec.3-01.10.Figure 6;
b) Parking lanes of 7 feet may only be used for ADT up to 1000;
c) If any modification to DS Sec.3-01.10 for cross sections 3, 6, and 7 are proposed, and if Fire and Solid Waste (Environmental Services) accepts proposed reduced widths, submit Development Standard Modification Request (DSMR);
d) Add a general note identifying by case number any modifications that are applicable to the project, including any DSMR together with the date and conditions of approval or, if the review has not been completed, a statement that it is in process.
23) DS Sec.6-01.4.1.I & 3.2.A: Address the following solid waste service comments:
a) Only three solid waste service areas are proposed for the entire project; show how the lots and commercial sites will be accommodated by solid waste pick-up.
b) Solid waste containers are to be placed so that the collection vehicle does not have to back into moving traffic, on or off the premises. Show maneuverability for safe pick-up at Street "C" and on Clearwater Drive.
24) DS Sec.2-03.2.4.F: A portion of the MS&R arterial Grande Avenue is where a signal is warranted on page 28 of the TIA and a roundabout is proposed. Although the plans state that the turnaround will be submitted under separate cover, this turnabout should be an integral part of the Tentative Plat review and approval. In response letter, provide status of this review.
25) DS Sec.3-01.5.1.A.2: Assure locations for parking stalls for proposed parking do not restrict the sight visibility within the corrected sight visibility triangles. On plan view, show associated setbacks for buildings on lots that are restricted by SVT's.
26) DS Sec.2-03.2.3.D: The minimum distance between curb cuts for residential driveways is 12 feet per Tucson Code Section 25.38(a). Clarify how lots will have access.
27) DS Sec.2-03.2.4.M: Explain purpose of 3 foot setbacks on private alley detail 8 on sheet 5.
28) DS Sec.2-03.2.4.F: On plan view, label streets as public or private. Per page 1 of the Drainage Report, the proposed streets are public; clarify. If 16' Paseo is for non-motorized vehicle use only, depict bollards or other traffic control device at ends of the Paseo.
29) DS Sec.2-03.2.3.C: All existing easements will be drawn on the plat, and recordation information, locations, widths, and purposes shall be included. If the easement is not in use and proposed for abandonment, so indicate. Blanket easements should be listed in the notes, together with recordation data and proposed status. Also, specifically address the following:
a) include any existing easements as listed in Title Report;
b) as it pertains to Bk57 pg40, show ingress/egress easement at Avenida Del Convento;
c) show other sewer and utility easements and right-of-ways that fall within this project's boundaries as shown on Bk57 pg40;
30) DS Sec.2-03.2.3.G: Delineate and label 30' public storm drain easement per Bk57 pg40.
31) DS Sec.2-03.2.4.J. All proposed easements (utility, sewer, drainage, access, etc.) are to be dimensioned and labeled as to their purposes and whether they will be public or private.
32) Tucson Code Sec.6-34.Chap.36.Sec.9: A Grading Plan and Permit will eventually be required. Grading in excess of 5,000 yards is designated as "engineered grading". Proposed developments exceeding 1 acre are subject to NPDES requirements. Contact Loren Makus, 791-4251 for submittal requirements.

LANDSCAPE PLAN COMMENTS:
33) LUC 3.7.4: Show how water harvesting will be provided on Landscape Plan.
34) DS Sec.3-01.5.1.A.2: Assure correct SVT's are shown on Landscape Plan.

The next submittal should address all the above items. Submit the revised Tentative Plat, revised Landscape Plan, revised Drainage Report, and a bound copy of soils report.
