Engineering has reviewed the received items and recommends conditional approval of the Final Plat. FINAL PLAT CONDITIONS OF APPROVAL: 1) City of Tucson Development Standards (DS) Section No.7-01.4, DS Sec.2-03.6.4.A, and DS Sec.2-03.2.3.C: The following may be done right before the mylar is goes to Mayor and Council. Fill in the blanks for: a) General Note 29 for the dkt/pg for recorded abandonment for the existing 20-ft Sewer Easement Bk5524 pg501. b) In the Dedication section, provide ordinance number regarding property and easement interest. 2) DS Sec.2-03.6.5.C: Address the following drafting or survey data comments on the mylar: a) On sheet 5, clarify floating crow's feet near southeast corner of project near text (89.36') in Commercial Block 'D'. b) Tie the 10' electrical easement to boundary on sheet 5 or sheet 4. c) On sheet 5, text near the southwest portion of lot 82 is unclear. Assure that any crow's feet and distances are legible in this area. d) On sheet 1, there are two Beneficiary statements; correct redundancy; there should be a beneficiary statement as one of the last elements of the Dedication. 3) Clarify any redundancy, combine, or clarify in response letter General Notes: 14, 15, 25, and 27. 4) Tucson Code Sec.29-23.A.5, DS Sec.2-03.6.2: The engineer's certification shall be included on the plat stating that the plat was reviewed by the certifying engineer for Landfill compliance and that the landfill information shown on the plat were prepared (or supervised etc.) by the certifying engineer. 5) DS Sec.2-03.7.1.B: Provide seal and signature for engineer on sheets 4 and 5. 6) DS Sec.2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the complete package of the financial assurances are updated, received, compared with the mylar, and accepted. It will be necessary to pick up the original assurances at the CDRC office, make corrections, and return the one set of the fully compiled package to CDRC office. a) Per a recent policy, the following language is to be made part of the list of assurable items contained in the Third Part Land Trust Agreement: "All applicable fees, e.g. permit fees, impact fees must be paid in full to the City of Tucson prior to the final release of subdivision assurances." Revise the assurable items list. b) Add that the following assurable item to Exhibit B of the list of assurable items: all off-site and on-site improvements as shown on Tentative Plat, Final Plat and improvement plans. c) Check to see that the Exhibit A of the Agreement to Construct reflects the current boundary data, as the closure calculations do not match this exhibit. d) Replace the schedule B's in the original assurance package with a current schedule B. e) Replace the old list of assurables with the current copy that is revised per 4a (above). f) Make sure all parts of the assurance package is returned, including: i) revised AGREEMENT TO CONSTRUCT SUBDIVISION IMPROVEMENTS ii) copy of the original Trust Agreement iii) AMENDMENT TO TRUST iv) The copy of a sample Warranty Deed i) most current title report 7) Regarding the November 16, 2005 original CC&R's, the drainage verbiage is acceptable. Provide attachment Exhibit A as referenced on page 2. 8) Please pick up the original CC&R's when you pick-up the original assurances. Provide the revised compiled assurance package and original complete CC&R's before or at time of mylar submittal. Submit to CDRC the revised Final Plat mylar, original signed copy of the CC&R's, one set of the revised complete original assurance package, and response letter with the mylar submittal.
