--The easement is 20' wide and City standards are 24' wide for roadway.
--The proposed in/egress easement serves a private owner and as shown, the City would be responsible to maintain the easement corridor.

Request the easement be established by separate instrument for in/egress for the benefit to parcel 101-21-011B.
Request the easement be delineated with a broken line to show the easement is part of Lot 1.

SUMMARY: Engineering has reviewed the revised Final Plat package, including closure calculation sheets, the Agreement to Construct and Amendment to Trust, copy of the drainage report, title report, copy of unsigned CC&R's, and response letter and does not recommend approval of the Final Plat at this time. Address the following plat and assurances comments prior to resubmittal.

FINAL PLAT COMMENTS:
1) City of Tucson Development Standards (DS) Section No. 2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are approved. For the third party trust, address the following:
a) Regarding the Agreement to Construct and the Amendment to Trust, assure that the title block verbiage for the description of the plat exactly matches wording on the assurance document (recitals/first pages and legal descriptions in the exhibits) to prevent delays/rejection from the legal office.
b) Add subdivision case number S04-051 to each page, including exhibits, of the Agreement to Construct and the Amendment to Trust.
c) For the Exhibit "B" of the AGREEMENT TO CONSTRUCT, add 'onsite' to required improvements for assurable item 8.
a) For this and future projects, please provide two 8½" by 11" location map sheets for assurance submittals that go to Mayor & Council.
d) Revise assurance package, address comments, compile the package, and then resubmit the revised assurance package with the resubmittal. Provide:
i) original copy of the signed AGREEMENT TO CONSTRUCT SUBDIVISION IMPROVEMENTS / THIRD PARTY TRUST;
ii) original copy of the signed AMENDMENT TO TRUST / THIRD PARTY TRUST;
iii) assure that all exhibits are attached, and the case number "S04-051" is on the AGREEMENT TO CONSTRUCT and AMENDMENT TO TRUST;
iv) copy of the original Trust Agreement;
v) copy of a sample Warranty Deed;
vi) copy of the updated/current Title Report.
vii) Three copies of the 8 ½ x 11 location map
2) DS Sec.2-03.7.1.E: Address the remaining CC&R comments:
e) Assure that the descriptions of the common areas of the Final Plat title block match the CC&R's descriptions of the subdivision common areas in appendix, as well as the descriptions in the assurance paperwork.
f) Add easement maintenance verbiage to CC&R's: All erosion protection and revegetation in all easements shall be the responsibility of the Homeowners Association.
g) Add case number S04-051 to first sheet of CC&R's.
h) Provide page numbering for every and all pages of the CC&R's including appendix and update table of contents accordingly.
i) An original signed copy of the CC&R's will be required for Final Plat approval.
3) DS Sec.2-03.6.4.F: Provide additional surveyable ties between floodplain and intersecting lot lines or project boundary. One tie per lot provides minimal tie at individual lot grading review stage.
4) DS Sec.2-03.6.4.A: Clarify whether TDOT has accepted the slope easements as public maintenance. Otherwise label slope easements as Private Slope Maintenance Easements. Provide copy of TDOT correspondence for public slopes.
5) DS Sec.2-03.6.3.C: Clarify 4th paragraph in Dedication section on sheet 1 to reflect include private easements.
6) DS Sec.2-03.6.3.C: Provide contact name for the beneficiary section on sheet 1. Move beneficiary section below the dedication section.
7) DS Sec.2-03.6.5.B: Assure that all easements listed on the Schedule B of title report are clearly drawn, labeled with Book/page or Docket/page, and/or listed as a blanket easement, and/or labeled with accurate dimensions and bearings on the plat. For item 5 of schedule B, easement dkt.6876 pg.506, clarify limits of easement on sheet 5.
8) DS Sec.2-03.6.4.G: Designate corner lot 4 with a star symbols indicating access or general location of driveway away from intersection or adjacent access entrances.
9) DS Sec.2-03.6.5.C: Address the following boundary data and other survey comments:
a) On planview clarify and label distances and bearings between all boundary monuments as measured (M) or calculated (C) or recorded (R).
b) DS Sec.2-03.6.5.C.3: Provide closure sheet for project boundary with error calculation. Only individual lot closures were provided.
c) DS Sec.2-03.6.4.G: Provide survey data by describing with bearings and distances on planview the ingress/egress easement at north side of lot 1.
d) DS Sec.2-03.6.5.C.4.a: All boundary monumentation must be labeled as "found" or "set." Fully describe and show all markings on found monuments. Provide information for three boundary corners.
e) DS Sec.2-03.2.3.A: Label the basis of bearing on sheet 1 planview.
10) DS Sec.2-03.6.2.E: On sheet 1, provide lot numbers and add a general note: "Prior to issuance of any building permit, a Flood Plain Use Permit may be required for Lots ____."
11) DS Sec.2-03.6.2.F: Since the property is subject to the requirements of the Hillside Development Zone, add as a general note to sheet 1: "Prior to the issuance of any building permits, Hillside Development Zone approval is required for all lots."

(1) Check made payable to "Pima County Recorder" in the amount of $20.00 per plat page plus a $4.00 handling fee, along with CC&R fees if applicable. CC&R fees are $9.00 for the first 5 pages and $1.00 for each additional page.
(1) Executed and notarized CC&R's document (if applicable).

*Please do not combine the checks for the printing charges. They are processed at different times and require separate checks. An account number is also acceptable and you can include this information on your transmittal sheet when submitting the above listed items.

Assurances (if applicable) must be reviewed by the City Attorney's Office prior to being presented to the Mayor and Council. Plats, CC&R's and assurances must be approved at the same Mayor and Council Meeting. Please expect 5-6 weeks from the date submitted to the date scheduled for Mayor and Council approval.

Prior to submitting the mylars to the CDRC office, they must be reviewed and approved by Pima County Addressing and City of Tucson Real Estate. Approvals must be written (E-mail is sufficient).
