SUMMARY: Engineering has reviewed the Final Plat package and does not recommend approval of the Final Plat at this time. Address the following plat and assurances comments prior to resubmittal.

FINAL PLAT COMMENTS:
1) City of Tucson Development Standards (DS) Section No. 2-03.7.1.G: The final plat cannot be scheduled for Mayor and Council consideration until the financial assurances are approved. If a third party trust is proposed for the assurances for this project, provide the following:
a) Provide an original copy of the AGREEMENT TO CONSTRUCT SUBDIVISION IMPROVEMENTS / THIRD PARTY TRUST with the assurable items list.
b) Provide an original copy of the AMENDMENT TO TRUST / THIRD PARTY TRUST.
c) Provide a copy of the original Trust Agreement;
d) Provide a copy of the updated title report.
e) Provide a copy of a sample Warranty Deed;
f) For this and future projects, please provide two 8½" by 11" location map sheets for assurance submittals that go to Mayor & Council.
g) Assure that all exhibits are attached, and the case number "S04-051" is at the top of the first page of the AGREEMENT TO CONSTRUCT and AMENDMENT TO TRUST.
h) Assure that the subdivision description on the Final Plat title block match the descriptions of the subdivision common areas in the assurance paperwork.
2) DS Sec.2-03.7.1.E: Include in the CC&R's any maintenance checklist (for slope areas, other common use areas) as provided by the engineer. Provide signed original of CC&R's.
3) DS Sec.2-03.6.4.F: Besides the 100-year flood limits, address the following information for the floodplain:
a) DS Sec.2-03.2.3.J.2: Provide water surface elevations on the plat. Linear distance between water surface contour intervals should not exceed 200 feet.
b) Provide surveyable info for the separate delineation for FEMA floodplain with ties to intersecting lot lines or project boundary.
4) DS Sec.2-03.3.1.K: Provide copy of annexation agreement. Also provide status of payment of in-lieu fees associated with the annexation conditions.
5) DS Sec.2-03.6.4.A: Clarify whether TDOT has accepted the slope easements as public maintenance. Otherwise label slope easements as Private Slope Maintenance Easements.
6) DS Sec.2-03.6.3.C: Clarify 4th paragraph in Dedication section on sheet 1 to reflect include private easements.
7) DS Sec.2-03.6.3.C: Provide contact name for beneficiary section on sheet 1.
8) DS Sec.2-03.6.5.B: Address the following easement comments:
a) DS Sec.2-03.8.1.D: Submit an updated title report current within 30 days.
b) DS Sec.2-03.6.5.B: Assure that all easements listed on the Schedule B of title report are clearly drawn, labeled with Book/page or Docket/page, and/or listed as a blanket easement, and/or labeled with accurate dimensions and bearings on the plat. Show or add note regarding (name/type) easement Dkt.(number) pg.(number) per Schedule B item (number). Provide accurate dimensions and bearings if these utility easements cross within the project boundaries, and label Bk/pg or Dkt/pg for each easement. In response letter, please state whether the items (numbers) of Schedule B are shown on the plat.
9) DS Sec.2-03.6.4.G: Designate corner lots 1, 3, 4, and 16 with a star symbols indicating access or general location of driveway away from intersection or adjacent access entrances.
10) DS Sec.2-03.6.5.C: Address the following boundary data and other survey comments:
a) On planview clarify and label distances and bearings between all boundary monuments as measured (M) or calculated (C) or recorded (R).
b) DS Sec.2-03.6.5.A: Provide subdivision corner ties to section monuments with recordation information on the plat. Include a description of corner markers.
c) DS Sec.2-03.6.5.C.3: Provide closure sheet for project boundary with error calculation.
d) DS Sec.2-03.6.4.G: Provide survey data for access easement on north end of project across lot 1.
e) Explain access to northern most corner of lot 1 on project.
f) DS Sec.2-03.6.5.C.4.a: All boundary monumentation must be labeled as "found" or "set." Fully describe and show all markings on found monuments. Provide information for three boundary corners.
g) DS Sec.2-03.2.3.A: Label and show the basis of bearing on the planview. The basis of bearings should be established from 2 found, physically monumented points described and shown on the final plat.
11) The revised drainage report shall be submitted at grading plan and/or Final Plat review stage.

Submit revised Final Plat, updated title report, revised CC&R's, assurance package, annexation agreement paperwork, copy of the complete compiled bound drainage report, and response letter. COMMENTS: Please resubmit revised drawings along a response letter, which states how all Zoning Review Section comments regarding the Land Use Code and Development Standards were addressed.

1. An applicant has one (1) year from the date of approval of tentative plat to obtain approval of a final plat that complies with zoning and other development requirements in effect at the time of application. As of this final plat review date the tentative plat has not been approved therefore the one year date of the final plat approval is based on the date of submittal of the final plat documents, which is December 4, 2007. Once the tentative plat has been approved the approval date of the final plat will be on one year from the tentative plat approval date. This date will be provided on a future review of the final plat.

2. Please darken the hatch pattern use to identify the project site within the location map.

3. Please change all dates listed in the dedication, approval, and recording blocks from 2006 to 2007.

4. Please remove the rezoning case number C9-82-11 from the plat. This case is not related to this site. Please add case number C9-82-71, which is the annexation case that covers this site. Add note that reads "This subdivision is subject to Ordinance No. 5817 which established zoning in the El Camino Del Cerro/I-10 Annexation Area".
