The activity number is S04-046. SUMMARY: The submittal was received by Engineering on July 26 , 2004. Engineering has reviewed the received items and does not recommend approval. SUBMITTAL REQUIRED: FINAL PLAT, SITE PLAN, ASSURANCES, CC&Rs APPROVAL: BOUNDARY CLOSURE CALCULATIONS, DRAINAGE STATEMENT GENERAL COMMENTS 1. The Drainage Report was reviewed for Final Plat purposes only. 2. Include the Assurance Package with the next Final Plat submittal. This package must include the original Third Party Trust, the original Amendment to Trust, a copy of the Trust Agreement, a copy of the Deed, and a recent Title Report. 3. Include a copy of the CC&Rs with the next Final Plat submittal. 4. A Grading Plan and Permit will be required if proposed fill exceeds 50 yd. The Site Plan does not show finish grades. Determination of Grading Permit requirements will be determined when grades are provided. IBC Chapter 36 5. Proposed fills in excess of two feet above existing grade at any location in the outer one hundred feet of the developing site adjacent to residentially zoned property require the procedure outlined in IBC Chapter 36 Section 13.1. This process must be complete prior to Grading Plan approval. The next submittal must address the following items: FINAL PLAT 1. The Final Plat says proposed private access/utility/pedestrian easement (Common Area A). Easements are totally different than common areas. Common Areas are similar to lots in being owned by a separate entity (i.e. a Homeowners Association). Easement areas are owned by the lot owner. It appears that the intention is to create an easement with actual ownership residing with the individual lot owners respectively. If this is the case, remove all mention of common areas (from the Title Block, street identification, CC&Rs, etc.). 2. Change the title of the Title Block from, "FINAL PLAT FOR" to "FINAL PLAT". 3. Note 3 says, "Total miles of new private streets is .45". It appears that this should be .045. 4. The dedication 2nd paragraph refers to common area. See comment 1 above for the removal of common area verbiage. It appears that the intention is for no common area. The dedication must refer to easements. 5. If the assurances are going to be provided through a 3rd Party Trust, the dedication will be signed by the Title Company, not the owner. The bottom of the Dedication paragraph should read: (Name of Trust Company), a (name of state) Corporation, as trustee under Trust Agreement No. (trust number) and not otherwise. By___________ Date________ 6. A Beneficiary paragraph must be included if this is a 3rd Party Trust. See DS 2-03.6.3.C 7. The Approval paragraph should read, "I, Kathleen S. Detrick........" 8. The Assurances must be signed by, "City of Tucson Development Services Department Engineering Administrator" and "City of Tucson Development Services Department Director". 9. Remove the address from the Title Block. 10. At least one corner of the subdivision must be tied by course and distance to a section corner, a quarter section corner, or an established City or County survey monument. The plat must include a description of that corner marker. Corner tie recordation information is to be provided on the plat. It is preferred that the tie be to a section monument. The tie must be readily retraceable (bearings and distances). 11. Show the distance and bearing between all monuments used. DS 2-03.6.5.C.5 Numerous monuments are shown on the plat that do not tie by bearing and distance to the proposed subdivision. 12. All easement lines must have a bearing and distance. DS 2-03.6.5.B SITE PLAN 1. Refer to the approved DSMR's in the General Notes. 2. Per DSMR Engineering approval conditions, "The private street must be constructed in accordance with DS 3-01.3.3.A.4. Vertical curbs are required and the pavement must be concrete." The plan is showing an asphalt street and wedge curb. Change the plan. 3. Show sight visibility triangles for the intersection of the private street to Lee Street. DS 2-02.2.1.A.10 4. Show proposed FFE and finish grades. Provide enough information to determine that the drainage will be in accord with the Drainage Report. 5. Show estimated cut and fill quantities. DS 2-02.2.1.A.17 6. An applicant has one (1) year from the date of approval of tentative plat to obtain approval of a final plat that complies with zoning and other development requirements in effect at the time of application. This final plat must be approved and recorded on or before April 19, 2005. 2. 1' no access easement labeled on the site plan drawing is not shown on the final and the recordation information for the proposed 29' private access easement is not labeled on the final plat. All existing and proposed easements on this site must be shown on the plat, including the type, width, recordation information, and whether they will be private or public. If an easement is to be recorded or abandoned by final plat, please so state. (D.S. 2-03.2.4.J) 3. Delete general note 10 on the final plat. The final plat may not be approved until a copy of this agreement has been provided to the Zoning Review Section for review. Under the Assurances block, revise the signature line from "Planning Director" to "Development Services Department Director." 6. Since a DSMR has been applied for, on the site plan sheet please list the DSMR case number, modifications granted, and conditions imposed.
