05/25/2004 JIM TATE ENGINEERING REVIEW Approved S04-035 Engineering Review Comments for final plat resubmittal 10MAY04

1. Assurable items must be completed prior to final plat approval. DSD Engineering will not sign off prior to construction and acceptance of the assurable items. (see previous comment #1)

2. Floodplain limits, including the FEMA 100-year floodplain limits, must be shown in a surveyable manner. Provide frequent ties to the building corners. Rick Engineering submitted and sealed the limits as shown on the approved development plan. The final plat requires surveyable limits with ties. (see previous comment #4)

3. The title block calls out Units 1-57 even though such units do not exist. Suggest saying "57 Condominium Units". (see previous comment #6)

4. Although we will not, at this time and for this project, require the common areas/elements to be called out separately in the title block, future submittals for other projects will be required to call out the uses of the common areas/elements. (see previous comment #7)

5. Please check the wall heights as compared to the elevations for the sections through the various buildings. There seems to be little to no correlation of the dimensions and elevations.

6. Article 7.1.4 in the Declaration calls out the approved development plan that does not appear to be part of the Declaration or Final Plat. Call out the recording information for the development plan or show the drainage facilities on the plat. Strike the words "and the Association fails to take corrective measures within a reasonable period of time" from Article 7.1.4. (see previous comment #19)

7. The areas for Units 6102-6105 could not be located. (see previous comment #27)

COMMENTS:

1. An applicant has one (1) year from the date of approval of tentative plat to obtain approval of a final plat that complies with zoning and other development requirements in effect at the time of application. This final plat must be approved and recorded on or before March 24, 2005.

2. The entire previous comment has been left as reference only. It is not common practice to sell parking spaces within a Condominium development. Please clarify how the sale of the spaces will be made. Per your response to Jim Tate's comment 20, the owner will have the option to purchase a parking space. How is the parking to be sold, fee simple, interest, included with the sale of the condo? Also parking spaces are based on the use for the commercial uses and based on the number of bedrooms for the residential units. A lot of questions have come up with the proposal for the sale of the required parking spaces. I cannot approve the final plat without clarification on this issue.

Please provide a detailed response letter regarding the sale of parking spaces as it pertains to the following, number of spaces a owner can purchase, does the location of the spaces affect the cost, what about the parking garages that are attached to the condos in buildings 5 and 6, what if a owner does not wish to purchase a space, how are the CC&R's affected and how will they be amended.

Please submit a revised copy of the CC&R's with changes reflecting the parking issue.

(Previous Comment: I have reviewed comments made by Jim Tate, Engineering Section Reviewer and most of the comments he has made would be similar to ones that I would make for Zoning. Please include in the Zoning comments response letter the responses to the following comments made by the Engineering reviewer; comments 7, 13, 14, 15, 16, 17, 18, 19, 20, and 22.)
