The proposed replating of the Neighborhood Center as condominiums is within the Neighborhood Center District, which is defined as the most intensive area of the Phase 1 development. Per specific plan section 3.1 the Neighborhood Center will consist of office, commercial, and entertainment uses surrounded by a pedestrian plaza. The listings of allowable uses are defined in Section 3.3.1 under the commercial services use group. These uses include administrative and professional office, alcoholic beverage service, communications subject to LUC sec. 3.5.4.20.C, D, F, & G, day care, entertainment subject to 3.5.4.4.A & C, financial service, food service subject to 3.5.4.6.D, medical service (extended health care - outpatient), parking, personal service, technical service, trade service and repair (minor), and travelers' accommodations (lodging). Any alterations or additions must meet defined development criteria as specified by this section of the PAD. The projected land use intensities map also limits commercial to 12,000-15,000 square feet. The above must be addressed to assure compliance to the PAD. 2. If space is being allocated to office, commercial, or entertainment that had not been allocated before parking calculations may be affected. If so, then the parking inventory must be updated and a copy submitted to Development Services and this Department. Any additional parking spaces required for non-residential land uses may be located off site and/or on-street provided it is within the Neighborhood Center District's boundary. This could also affect the number of provided Class II bicycle parking spaces. (PAD Sec. 3.4) 3. Per PAD Sec. 3.5 that addresses off-street loading requirements, the neighborhood center is to be designed as one unified development and shall be designed to contain one loading space, which may be located on street. Please identify the location of the required loading space. 4. CC&R Article 5.1.7.iii restricts uses on lots 162 and 165 to commercial/retail (although the PAD does not allow retail use within the Neighborhood Center). All proposed non-residential or mixed use condominium declarations for any lot or parcel must be approved in writing by the Declarant prior to the expiration of the Class B Membership, and by the Board thereafter per CC&R Article 5.2.12.1. A copy of this written approval from the Civano Board of Directors of the Association must be submitted prior to staff prior to approval of this final plat. Per the Civano Master Plan neighborhood centers are provided for each of the three phases, each of which contains neighborhood recreation facilities and 'meeting areas' (page 23). A meeting room or area is to be preserved for the use of the residents of Neighborhood I. The condos should not remove meeting rooms designated for this use. If removed an alternate site must be provided to meet this need within the Neighborhood Center District. |
